HomeMy WebLinkAboutR-98-0370J-98-386 4/2/98 RESOLUTION NO. 9 S _ 370 A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO ENGAGE THE SERVICES OF OUTSIDE BOND COUNSEL, IN AN AMOUNT NOT TO EXCEED $10,000, FOR SERVICES RELATED TO THE DISCONTINUANCE OF THE DEPARTMENT OF OFF-STREET PARKING AND THE CREATION OF THE DEPARTMENT OF PARKING OF THE CITY OF MIAMI, FLORIDA; ALLOCATING FUNDS THEREFOR FROM SPECIAL PROGRAM AND ACCOUNTS, ACCOUNT CODE NO. 92-1002-270. WHEREAS, the Department of Off -Street Parking (DOSP) was discontinued pursuant to Ordinance No. , adopted and the Department of Parking of the City of Miami (the Department) was subsequently created to assume all duties and functions of DOSP; and WHEREAS, the Department will be under the control of the City Manager and among other conditions of the assumption, all funds and accounts pertaining to DOSP's activities are to be transferred to the Department subject to the defeasement of any bonds issued by the City of Miami on behalf of DOSP; and WHEREAS, to assure a fiscally prudent transition, it is deemed necessary to engage the services of outside bond counsel; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. The City Attorney is hereby authorized to engage the services of outside bond counsel, in an amount not to exceed $10,000, for services related to the discontinuance of the Department of Off -Street Parking and the creation of the Department of Parking of the City of Miami, Florida, with funds therefor hereby allocated from Special Program and Accounts, Account Code No. 92-1002-270. This Ordinance also declares all assets and property of the Department of Off -Street Parking the property of the City of Miami, and requiring the conveyance of title of all property and assets of DOSP to the City of Miami, transferring all funds and accounts subject to defeasement of any bonds if required, and further authorizing the City Manager to execute all documents necessary to effectuate the discontinuance of the department and the assumption by the City Manager of all the duties and functions of the same. BACKGROUND The Department of Off -Street Parking was created and established by Ordinance No. 561, passed and adopted by the City Commission on November 2, 1955, as amended. Pursuant to Section 19 of the City Charter, it has been deemed that the City Commission can discontinue the Department of Off -Street Parking and create a new department under the supervision of the City Manager. As part of the Five -Year Plan adopted by the City Commission on December 30, 1997, the defeaseance of City of Miami bonds issued on behalf of the Department of Off -Street Parking was recommended. Furthermore, it was recommended that in connection with the defeaseance of bonds, that the City exercise control and supervision over all functions and duties pertaining to the operation of parking activities. Adoption of the Ordinance will enable the City of Miami to benefit from the annual revenue stream currently generated by the Department of Off -Street Parking.
