A RESOLUTION ESTABLISHING A LAND DISPOSITION
POLICY RELATING TO THE DISPOSITION OF SURPLUS
CITY -OWNED VACANT PARCELS FOR THE PURPOSE OF
DEVELOPING HOUSING AFFORDABLE TO VERY LOW,
LOW- AND MODERATE -INCOME FAMILIES AND
INDIVIDUALS THEREBY: (1) ESTABLISHING FIFTY
(50%) PERCENT OF THE CITY'S SITE ACQUISITION COST,
AS THE AMOUNT TO BE PAID TO THE CITY OF MIAMI AS
THE CITY'S REIMBURSEMENT FOR ITS COST OF SITE
ACQUISITION FOR HOUSING PARCELS ACQUIRED WITH
FEDERAL FUNDS PROVIDED FROM THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
THROUGH THE CDBG PROGRAM AND HOME PROGRAM;
(2) ESTABLISHING FIFTY (50%) PERCENT OF THE
APPRAISED VALUE OR THE CITY'S ACTUAL COST,
WHICHEVER IS GREATER, AS THE AMOUNT TO BE PAID
TO THE CITY OF MIAMI FOR OTHER CITY -OWNED
SURPLUS PROPERTIES NOT ACQUIRED WITH FEDERAL
FUNDS; (3) AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY ATTORNEY TO PREPARE THE
NECESSARY DOCUMENTS TO EFFECTUATE THE
CONVEYANCE AND DISPOSITION OF SAID SURPLUS
PARCELS, SUBJECT TO THE APPROVAL OF THE CITY
COMMISSION.
WHEREAS, there exists in the City of Miami, a severe shortage of housing within the
affordability range of families and individuals of low- and moderate -income; and

WHEREAS, the City Commission recognizes that the participation of both the public and
private sector is necessary to foster the development of housing affordable to low- and moderate -
income families and individuals in the City; and
WHEREAS, in the City, there exists a number of City -owned vacant parcels which have
been acquired by the City utilizing Community Development Block Grant ("CDBG") Program
and HOME Program funding for the development of new single-family residential homeownership
units throughout several of the City's CD Target Areas; and
WHEREAS, in addition, there exists a number of City -owned parcels which have been
acquired by the City through means other than with federal funds and have been identified as
surplus properties and are available for the development of new affordable housing units in the
City; and
WHEREAS, the City Administration recommends that a land disposition policy be
established by the City Commission relating to surplus properties that are suitable for the
development of housing affordable to very low, low- and moderate -income families and
individuals in the City; and
WHEREAS, Section 29-B of the City Charter allows for the conveyance or disposition of
City -owned property in connection with the implementation of City -assisted housing programs or
projects, which are intended to benefit persons or households of low- and/or moderate -income
without being subject to competitive bidding requirements and fair value to the City; and
WHEREAS, the City Administration recommends that a land reimbursement value of fifty
percent (50%) of the City's cost for site acquisition be established for parcels acquired utilizing
federal funds through the CDBG and HOME Programs, subject to certain terms and conditions;
and

WHEREAS, the City Administration further recommends that a land reimbursement value
of fifty percent (50%) of the appraised value or the City's actual cost, whichever is greater, be
established for other City -owned surplus properties that are suitable for the development of
housing affordable to very low, low- and moderate -income families and individuals, subject to
certain terms and conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Commission hereby establishes fifty percent (50%) as the
reimbursement amount to be paid to the City as reimbursement for its cost of site acquisition, for
surplus parcels that have been acquired by the City utilizing federal funding from the U. S.
Department of Housing and Urban Development, for the development of affordable
homeownership housing units by not -for -profit community development corporations and/or
private sector for profit developers.
Section 3. The City Commission hereby establishes fifty percent (50%) as the
reimbursement amount to be paid to the City based on an updated appraisal report, for surplus
City -owned parcels acquired through means other than federal funding, or the City's actual cost,
whichever is greater, which are suitable for the development of affordable homeownership
housing units to be developed by not -for -profit community development corporations and/or
private sector developers.

Section 4. The City Manager and City Attorney are hereby authorized/ and directed to
prepare the necessary documents to effectuate the conveyance and disposition of any City -owned
surplus properties suitable for the development of homeownership housing units affordable to
very low, low- and moderate -income families and individuals, subject to the approval of the City
Commission.
Section 5. This Resolution shall become effective immediately upon its adoption.

In accordance with Miami Code Sec. 2-36, since the Mayor did not indicate approval of
this legislation by signing it in the designated place provided, said legislation now
becomes effective with the elapse of ten (10) days from the date of Commission action
regarding same, without the Mayor exercising a veto.

of City -Owned Property for
Affordable Housing

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached resolution, which
establishes a land disposition policy pertaining to the disposition of surplus City -owned vacant
parcels, suitable for the development of affordable housing for very low, low and moderate -income
families and individuals. The attached resolution establishes fifty (50%) percent of the City's cost
of site acquisition, as the amount to be paid to the City for parcels acquired with federal funds.
These funds are from the U.S. Department of Housing and Urban Development, through the CDBG
and HOME Programs. The attached resolution further establishes the lesser of, fifty (50%) percent
of the appraised value or the City's actual cost, as the amount to be_ paid for other City -owned
properties acquired through other means such as donations, code enforcement and other forms of
legal actions instituted by the City.
BACKGROUND:
There exists a severe shortage of housing in the City of Miami, within the affordability range of
families and individuals of very low, low and moderate -income. This problem is even more critical
in the City's Community Development Target Areas, where there exists a severe shortage of owner -
occupied residential units. The cost of land, construction materials, and labor in the Miami
marketplace has effectively precluded the private housing industry from developing new single-
family homes within the purchasing power and affordability range of the City's very low, low and
moderate -income families.
The City of Miami recognizes that the participation of both the public and private sector is
necessary, in order to foster the development of housing affordable to very low, low and moderate -
income families and individuals in the City. The City could assist the private sector in the
development of new affordable housing units by providing available vacant surplus City -owned
properties, at a write -down for the construction of new affordable housing units. This strategy
would result in reducing the overall cost of the housing product by allowing the cost savings to be
passed on to the potential homebuyer and/or tenant.

Section 29-B of the City Charter, allows for the conveyance or disposition of City -owned property
which would be used for the implementation of city -assisted housing programs or projects for very
low, low and moderate -income households, without being subject to competitive bidding
requirements and fair market value return to the City.
The City is in a position to assist the private sector in fostering the development of new affordable
housing units in the City, by making available vacant surplus City -owned properties available for
such development. In an effort to further promote the construction of new affordable housing in the
City, the Department of Community Development and the Office of Asset Management recommend
City Commission ratification of the attached resolution.
