HomeMy WebLinkAboutR-98-0293J-98-303 3/12/98 RESOLUTION NO. 9 8- 293 A RESOLUTION, WITH ATTACHMENT(S), APPROVING THE DESIGNATION OF THE HABITAT FOR HUMANITY OF GREATER MIAMI, INC., A NOT -FOR -PROFIT CORPORATION, AS DEVELOPER, TO UNDERTAKE THE DEVELOPMENT OF ONE (1) NEW SINGLE-FAMILY HOME, AFFORDABLE TO A VERY LOW, LOW AND/OR MODERATE -INCOME FAMILY ON THE CITY -OWNED PARCEL LOCATED AT 7623-7631 NORTHEAST 3RD AVENUE, IN THE LITTLE HAITI NEIGHBORHOOD, (MORE PARTICULARLY AND LEGALLY DESCRIBED ON EXHIBIT "A," ATTACHED HERETO AND MADE A PART HEREOF); ESTABLISHING $11,000.00 AS THE AMOUNT TO BE PAID TO THE CITY OF MIAMI BY THE AFOREMENTIONED CORPORATION BASED ON THE APPRAISED VALUE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE LEGAL DOCUMENTS IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO CONVEY THE SAID PARCEL, SUBJECT TO CERTAIN TERMS AND CONDITIONS. WHEREAS, The City of Miami has a severe shortage of housing within the affordability range of families and individuals of very low, low and moderate -income; and WHEREAS, the City Commission recognizes that the participation of both the public and private sector is necessary to foster the development of housing affordable to very low, low and moderate -income families and individuals in the City; and ATTACHMEN t ` 1 CONTAINED CITY COMMSSION MEETWO OF MAR 2 4 1998 PaeohvAon rim WHEREAS, in the City, there exists a number of City -owned vacant parcels which have been acquired by the City utilizing CDBG Program funding for the development of new single- family residential homeownership units throughout several of the City's CD Target Areas; and WHEREAS, there exists in the Little Haiti neighborhood one (1) vacant parcel which was acquired by the City through means other than with federal funds, which has been identified as surplus property and is suitable for the development of one (1) new single-family residential unit; and WHEREAS, in May of 1995, through Resolution No. 95-413.1, the City Commission allocated $100,000.00 in 21" Year CDBG Program funding to Habitat For Humanity of Greater Miami, Inc., for the purpose of acquiring vacant parcels suitable for the development of new single-family homes in the Little Haiti neighborhood; and WHEREAS, in January of 1998, Habitat For Humanity of Greater Miami, Inc., made a request to the City in connection with the purchase of a vacant City -owned parcel located at 7623-7631 Northeast 3'd Avenue; and WHEREAS, the subject parcel has been declared surplus property and is suitable for the development of one (1) new single-family home, affordable to low- and moderate -income families; and WHEREAS, Section 29-B of the City Charter allows for the conveyance or disposition of City -owned property in connection with the implementation of City -assisted housing program or projects which are intended to benefit persons or households of very low, low and/or moderate - income without being subject to competitive bidding requirements and fair market value return to the City; and -2- 98- 293 WHEREAS, in an effort to promote the development of new affordable housing in the City, the City Administration recommends the granting of development rights to Habitat For Humanity of Greater Miami, Inc., for the development of one (1) new single-family home on the subject City -owned parcel, subject to certain terms and conditions; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Habitat For Humanity of Greater Miami, Inc., is hereby designated as developer to undertake the development of one (1) new single-family home affordable to very low, low and moderate -income families on a vacant City -owned parcel located at 7623-7631 Northeast 3rd Avenue in the Little Haiti neighborhood. Section 3. The City Commission hereby establishes $11,000.00 as the acquisition amount to be paid to the City by Habitat For Humanity of Greater Miami, Inc., for the acquisition of the subject City -owned parcel. Section 4. The City Manager is hereby authorized-'/ to execute the appropriate documents, in a form acceptable to the City Attorney, conveying the subject parcel, more particularly and legally described in the attached Exhibit "A" to the said corporation. '-/ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including, but not limited to, those prescribed by applicable City Charter and Code provisions. -3- 98- 293 Section 5. Habitat For Humanity of Greater Miami, Inc., is hereby directed to commence construction on the subject City -owned parcel within twelve (12) months from the date of conveyance by the City, or the subject parcel shall revert back to the City. The attached resolution further establishes $11,000.00, as the acquisition amount, based on an appraisal, to be paid to the City of Miami by the aforementioned Corporation. The attached resolution further authorizes the City Manager to execute the appropriate legal documents, in a form acceptable to the City Attorney, to convey the said parcel, subject to certain terms and conditions. BACKGROUND: The Department of Community Development and the Office of Asset Management recommend the approval of the attached resolution, designating Habitat For Humanity of Greater Miami, Inc., as developer to undertake the development of one (1) new single-family home on one (1) parcel of vacant land, currently under City -ownership in the Little Haiti neighborhood. In May of 1995, through Resolution No. 95-413.1, the City Commission allocated $100,000.00 in 21 `-Year CDBG Program funding to Habitat For Humanity of Greater Miami, Inc., for the purpose of acquiring vacant parcels suitable for the development of new single-family homes in the Little Haiti neighborhood. To date, six (6) vacant parcels have been acquired by Habitat For Humanity of Greater Miami, Inc., for the construction of seven (7) new single-family homes for very low, low and moderate -income families in the Little Haiti neighborhood. The attached resolution further establishes $11,000.00, as the amount to be paid to the City by the aforementioned Corporation. The subject parcel was recently appraised and determined to have a fair market value of $11,000.00. This amount would reimburse the City- for monies used to acquire this property. In the event Habitat For Humanity of Greater Miami, Inc., is unable to commence construction of the home within twelve (12) months from the date of conveyance by the City, the subject parcel will revert back to the City. 98- 293 The Honorable Chairman and Members of the City Commission March 11, 1998 Page 2 The City is in a position to assist the private sector in the development of one (1) new single- family home in the Little Haiti neighborhood, by making one (1) vacant City -owned lot, located at 7623-7631 N.E. 3' Avenue available for such development. In an effort to further promote the construction qf new affordable housing in the Little Haiti neighborhood, City Commission approval of attached resolution is respectfully recommended.
