A RESOLUTION BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDING OF
EMERGENCY CIRCUMSTANCES, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES AND APPROVING MANUCY
AND ASSOCIATES, INC. TO PERFORM
PROFESSIONAL SURVEY SERVICES IN CONNECTION
WITH THE SALE OF THE F.E.C. TRACT TO MIAMI-
DADE COUNTY; ALLOCATING FUNDS THEREFOR IN
AN AMOUNT NOT TO EXCEED TEN THOUSAND
DOLLARS ($10,000) FROM ACCOUNT NUMBER 921002-
270.
WHEREAS, on October 14, 1997 the City Commission passed and adopted
Resolution No: 97-726 thereby approving an Interlocal Agreement by and between the City
and Miami -Dade County (the "County") for the sale of approximately 19.0420 acres of the
real property commonly known as the FEC Tract (the "Property") to the County; and
WHEREAS, under the terms of the Interlocal Agreement the City was to obtain and
provide to the County a certified survey of the Property the cost of which, in an amount not
to exceed five thousand dollars ($5,000) was to be reimbursed to the City by the County at
closing; and
WHEREAS, Manucy and Associates was selected by the City to provide professional
surveyor services under a contract in the amount of was Four Thousand Two Hundred
Dollars ($4,200); and
WHEREAS, as result of matters revealed in the course of examining title additional

services were required of the surveyor in connection with the City's obligation under the
Interlocal Agreement to convey good title; and
WHEREAS, on October 21, 1997, the Director of Planning & Development
submitted to the City Manager in writing a request for approval of additional survey work
providing a full explanation of the circumstances of the emergency and based thereon the
City Manager authorized the allocation of Ten Thousand Dollars ($10,000) to cover the
costs associated with the survey;
WHEREAS, in accordance with the terms of the Interlocal Agreement, at Closing,
the County reimbursed the City the agreed to maximum amount of Five Thousand Dollars
($5,000) of the costs incurred by the City in connection with the survey work performed;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City
Commission, ratifying, approving, and confirming the City Manager's finding that a valid
public emergency existed, waiving the requirements for competitve sealed biddingj
procedures, and approving Manucy and Associates, Inc., to perform survey services in
connection with the sale of the Property in an amount not to exceed Ten Thousand Dollars
($10,000), with funds therefor hereby allocated from Account No. 921002-270.
Section 3. This Resolution shall become effective immediately upon its adoption.

ENCLOSURES:
The administration recommends the City Commission approve the attached Resolution
ratifying the City Manager's finding of emergency in authorizing Manucy and Associates
("Manucy") to perform survey services in connection with the sale of the FEC Tract to Miami -
Dade County. Funds to cover the cost of these services in an amount of Nine Thousand Five
Hundred Dollars ($9,500) are available in Account No. 921002-270.
BACKGROUND:
In accordance with the Interlocal Agreement, dated January 8, 1998, (the "Interlocal"), between
the City of Miami and Miami -Dade County for the County's purchase of a portion of the land.
commonly known as the FEC Tract (the "Property"), the City was required to provide to the
County a survey and legal description of the Property. It was determined by the City that since
Manucy had previously performed a survey of the Property, they would be the most
knowledgeable of the site, and could provide the necessary survey services at the most
reasonable price and in the most expeditious manner. The cost for these services was not to
exceed Four Thousand Two Hundred Dollars ($4,200).
After completion of the survey and legal description, the County requested to purchase
additional land to the north of the original property line. To accommodate this request,
Manucy needed to produce a new survey and legal description.
During the County's examination of title, the County discovered four deeds identifying
encumbrances on the Property. In order for the City to convey clear title, it was necessary to
increase the scope of work to be performed by Manucy to include a review of the encumbrances,
and certify that the same did not lie within the boundaries of the Property. The cost for these
additional services were approximately Five Thousand Three Hundred Dollars ($5,300). Under
the terms of the Interlocal, the County reimbursed the City an amount of Five Thousand
Dollars ($5,000) as its contribution towards the cost of these survey services. Approval for this
additional funding was authorized by the City Manager's memo dated October 21, 1997.
To date the amount spent on the survey work and the certified affidavits is Nine Thousand Five
Hundred Dollars ($9,500.00). Of this amount, Six Thousand Five Hundred Dollars ($6,500) has
been paid leaving an outstanding balance of Three Thousand Dollars ($3,000).
