HomeMy WebLinkAboutR-98-0239J-98-272 3/10/98 RESOLUTION NO. 98- 239 A RESOLUTION AUTHORIZING THE EXTENSION OF THE TERM OF THE AGREEMENT BETWEEN THE CITY OF MIAMI AND LAWMEN, INC., FOR THE PROVISION OF VICTIM ASSISTANCE COUNSELING SERVICES FOR THE DEPARTMENT OF POLICE, FOR AN ADDITIONAL TERM OF ONE YEAR, AND INCREASING THE AMOUNT OF COMPENSATION PAYABLE DURING THE EXTENDED TERM TO $60,000; ALLOCATING FUNDS THEREFOR FROM "VICTIMS OF CRIME" ACT GRANT FUNDS; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO EVIDENCE SAID EXTENSION. WHEREAS, pursuant to Resolution No. 96-662, adopted September 12, 1996, and under the terms of a $30,41 1 grant awarded to the City by the United States Department of Justice, Office for Victims of Crime, the City of Miami executed an agreement (the "Agreement") with Lawmen, Inc. to provide professional counseling and victim advocacy services to victims of crime;and WHEREAS, the Agreement is for an initial term of one (1) year, with the City having the option to extend the term for two (2) additional one (1) year periods, subject to obtaining additional funding; and WHEREAS, pursuant to Resolution No. 97-637, adopted September 16, 1997, additional grant funds were awarded the City increasing the amount of compensation under the Agreement to $38,391.08 to extend said counseling services; and CITY COMMISSION MEETING OF MAR 1 0 1998 Resolution No. 98- 239 WHEREAS, the grant has been extended for the period of October 1, 1997 through September 30, 1998 and additional funds, in the amount of $60,000, have been awarded to the City to increase the services to be provided thereunder; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The extension of the term of the Agreement between the City and Lawmen, Inc., for the provision of victim assistance counseling services for the Department of Police; for an additional term of one year, from October 1, 1997 through September 30, 1998 and the increase in the amount of compensation payable during the extended term to $60,000, is hereby approved, with funds therefor hereby allocated from Victims of Crime Act Grant Funds. Section 3. The City Manager is hereby authorized' to execute an amendment, in a form acceptable to the City Attorney, to said Agreement, to evidence said extension. Section 4. This Resolution shall become effective immediately upon its adoption. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2- 9�� 239 PASSED AND ADOPTED this loth day of March , 1998. Funding is to be provided from the Victims of Crime Act Fund, Project Number 142011. BACKGROUND: The Department of Police has been awarded additional grant monies from the State of Florida, Office of the Attorney General, to be utilized towards payment of salaries for in-house Victim Assistance Counselors. The Victims of Crime Act Grant was refunded for the period of October 1, 1997 to September 30', 1998 for $60.000.00. These monies are to be used towards the payment of salaries for the counselors. The Department of Police requests an increase of the Professional Services Agreements from $38,391.08 to $60,000.00, which is an increase of $21,608.92. The Department of Police responds to approximately 80,000 calls per year where -there is a victim of a crime. Approximately 6,000 of these are related to homicide, child abuse, sexual battery or domestic violence cases. All these victims have certain mandated rights in our State. The Victim Assistance Counselors are utilized by the Department of Police under executed Professional Services Agreements to assist victims and refer them to available services. c: The Honorable Xavier L.
