A RESOLUTION AUTHORIZING AN INCREASE IN FEES, NOT
TO EXCEED $53,000, (FROM $74,500 TO $127,500) TO THE
PROFESSIONAL SERVICES AGREEMENT (PSA) BETWEEN THE
CITY OF MIAMI AND COASTAL SYSTEMS INTERNATIONAL,
INC., FOR THE PROVISION OF ADDITIONAL
ENVIRONMENTAL PERMITTING AND STRUCTURAL
INSPECTION SERVICES REQUIRED DURING CONSTRUCTION
FOR THE "DINNER KEY BOATYARD - MARINA DOCK
PROJECT H-1088" ALLOCATING FUNDS THEREFOR FROM
PROJECT NO. 418406 AS APPROPRIATED BY FISCAL YEAR
1995-1996 CAPITAL IMPROVEMENT ORDINANCE NO.
11337, AS AMENDED; AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AMENDMENT TO SAID PSA, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, TO EVIDENCE SAID
INCREASE.
WHEREAS, on March 21, 1995, the City of Miami and Coastal Systems
International, Inc., entered into a Professional Services Agreement to provide designs,
environmental permitting and construction plans for new marina docks at the Dinner Key
Boatyard to replace the pier facilities destroyed by Hurricane Andrew and additional marina
services as authorized per Resolution No. 92-551 for emergency procurement of services;
and
WHEREAS, said Professional Services Agreement contemplates the provision of
additional services, if required by the environmental permitting agencies beyond the
permitting agencies, but does not provide for the rendition of professional services beyond
the preparation of construction plans; and
WHEREAS, it is necessary for CSI to perform additional professional services in the
form of other related services during the construction phase as required by the South
Florida Building Code; and

WHEREAS, the cost of additional environmental permitting services is $15,000, and
the cost of structural inspection and related professional services is $38,000;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. An increase in fees, not to exceed $53,000 (from $74,500 to
$127,500) to the Professional Services Agreement (PSA) between the city of Miami and
Coastal Systems International, Inc., for the provision of additional environmental permitting
and structural inspection services required during construction for the "Dinner Key
Boatyard - Marina Dock Project H-1088", is hereby authorized, with funds therefor hereby
allocated from Project No. 418406 as appropriated by Fiscal Year 1995-1996 Capital
Improvement Ordinance No. 11337, as amended.
Section 3. The City Manager is hereby authorized'-' to instruct the City Manager
to execute an amendment to said PSA, in a form acceptable to the City Attorney, to
evidence said increase.
Section 4. This Resolution shall become effective immediately upon its adoption.
1� The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.

BACKGROUND
The Dinner Key Boatyard Marina Docks (DKBMD) is a Hurricane Recovery project
that began as a pier replacement project funded largely with FEMA monies. The
project is located on a City lease property formerly known as the Merrill Stevens
Boatyard.
For a number of years, the City has been trying to redevelop the upland portion of
the site through a Unified Development Process ("UDP"). The City's Planning
Department decided to make DKBMD, i.e. pier replacement, part of the UDP
package for this site, although the upland portion of any proposed development
was not determined at that time. A decision was made to move forward with the
FEMA funded pier replacement project and to install a new re -configured seawall
funded by the City. The plan was to have a consultant prepare conceptual designs,
obtain the required environmental and regulatory permits, and to prepare
construction plans for bidding.
After evaluating three (3) consulting engineering firms, Coastal Systems
international (CSI) was selected to work with the Public Works Department. On
March 21, 1995, the City entered into a Professional Services Agreement with CSI
for the design, permitting, and preparation of construction plans for the FEMA
approved fifty-two (52) boat slip marina at the Dinner Key Boatyard site. The
Agreement did not include any construction phase professional services.
The processing of permit applications and the preparation of construction plans in
conjunction with the Planning Department's UDP process was difficult to
coordinate and implement largely due to the uncertain future use of the site. The
environmental permitting agencies imposed several additional permitting
requirements on the project which resulted in additional services being required
from the consultants. The State of Florida Department of Environmental
Protection (DEP) requested additional hydrographic analyses, a project review by
the Governor's Planning and Budgeting Department, and a Fuel Spill Prevention
and Response Plan. Dade County DERM required approval by the County Board of
Commissioners as well as an Operating Permit after construction. In order to
obtain the required environmental permits, CSI did the work and requested
$15,000 in additional services which have already been approved by FEMA for
reimbursement.

After the environmental permits were resolved, the construction plans were
completed and bids were finally received on February 6, 1997. Before submitting
the project for award, the City needed verification of funding and approval from
FEMA as well as its own staff. On September 23, 1997, by Resolution No. 97-642, the
City Commission awarded a contract to Cone Constructors, Inc. in the amount of
$2,301,500 to construct the project. Construction is now underway and the City
needs to increase the Professional Services Agreement for additional
environmental permitting and to provide the professional services needed during
the construction phase. These services include structural inspections, attendance
at construction and regulatory agency meetings, review of shop drawings and test
reports, resolution of plans with job problems, and final certification of the
finished work. CSI is the engineer of record -on the project and it is necessary for
them to perform all of the structural inspections and related professional services
as required under South Florida Building Code.
Based on a $2.3 million construction contract and a construction phase period of
approximately 8 months, the cost of the construction phase services is estimated
at $38,000. These construction phase professional services costs are also FEMA
approved expenses reimbursable to the City.
RECOMMENDATION
it is recommended that the City Commission adopt the attached Resolution
increasing the contract amount in the Professional Services Agreement with CSI
for the Dinner Key Boatyard Marina Docks, H-1088 to provide $15,000 for additional
services and $38,000 for construction phase professional services, for a total
increase in the amount of $53,000.
This increase will bring the total amount of CSI's fees and expenses on the Dinner
Key Boatyard project from $74,500 to $127,500 under their Professional Services
Agreement including all environmental permitting, preparation of construction
plans and specifications, and for all structural inspections and related services
during the construction phase. The funding for the project has been appropriated
in FY 95/96 Capital Improvement Ordinance No. 11337, under Project No. 418406
and these costs are FEMA reimbursable expenses.

Dear Alan:
This letter presents a follow-up to our June 27, 1997 letter to Grant Sheehan regarding additional
permitting fees and request for authorization of construction administration services to our
existing contract with the City.
As mentioned in our earlier letter, Coastal Systems has incurred additional expense in processing
the environmental permits due to requests for additional information by the Department of -
Environmental Protection (DEP), U.S. Army Corps of Engineers (COE), and Metropolitan Dade
County DERM. These expenses are as follows:
Fuel Spill Prevention And Response Plan: The original Merrill -Stevens docks had a fuel
facility and through discussions with regulatory staff, it was determined that a new facility could
be authorized. As part of the review process a fuel spill plan had to be submitted and approved
prior to issuance of the DEP permit. A separate permit from the upland Developer must be
issued when the facility is built. The fuel plan should be FENIA reimbursable. Total costs for
this work is $4,000.00.
Hydrographie Analysis: As a result of the first completeness summary, the regulatory agencies
requested a study of flushing characteristics of the project area to verify adequate dispersal of
hypothetical pollutants. This requirement must be satisfied in order to obtain the required
permits and as such should be entirely reimbursable by FEMA. The cost for this work is
S3,500.00.
Dade County Board of Commissioners Approval: The DERM Class I Permit was required by
staff to be put forth and approved by the Dade County Board of Commissioners due to dredge
and fill activities to realign the bulkhead and interior basin. All meetings and the subject
mitigation plan required before Commission approval should be reimbursable by FEMA. The -
costs are $2,500.00.

OMB Circular A-95: The DEP permit completeness summazy required this project to be
reviewed through the Governor's Planning And Budgeting Department as a prerequisite for DEP
permit issuance. This was clearly not part of the original scope of work and therefore subject to
FEMA reimbursement. The costs are $5,000.00.

Construction Administration: As we mentioned previously, the original scope and engineering
services covered permitting, design and contract bid and award, but Project Administration of
construction was not included in the original authorization. This work must be performed, as is
currently being done and therefore reimbursable in full by FEMA.

We have performed all services in order to obtain the environmental permits and continue to
assist the City during construction and we respectfully request your assistance to enable the City
Commission to authorize additional monies in the amount of $53,000.00.
