HomeMy WebLinkAboutR-98-0194J-98-254 2/24/98 RESOLUTION NO. 9 8 - 1,94 A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE AWARD OF A CONTRACT WITH RECIO AND ASSOCIATES, INC. FOR LANDSCAPE MAINTENANCE SERVICES FOR STATE ROAD 5 (U.S. 1) MEDIANS SOUTH OF U.S. HIGHWAY I-95, FOR A ONE (1) YEAR PERIOD, IN THE AMOUNT OF $69,922.00; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 310501-340; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID ACQUISITION. WHEREAS, the City of Miami has an agreement with the Florida Department of Transportation to maintain the newly landscaped medians on State Road 5 (U.S. 1), south of U.S. Highway I-95 to Southwest 37th Avenue, Miami, Florida; and WHEREAS, on February 2, 1998, a severe wind and rain storm struck the City causing the toppling of newly planted trees in the U.S. 1 medians on to the highway which was an endangerment to the public and exposed the City to substantial liability risks; and WHEREAS, the City lacks the necessary resources and requires an experienced, reputable landscape maintenance firm with the supervision, manpower and proper equipment to immediately assume the maintenance and clean-up of the U.S. 1 medians; and CITY CONU —S 011 MEETING OF FEB 2 4 1998 Resolution No. 98- 194 WHEREAS, Recio and Associates, Inc., a Hispanic -minority firm, registered with the City of Miami with the experience of maintaining landscape medians on Brickell Avenue, in the City of Miami, and U.S. 1 in the City of Coral Gables, with adequate supervision, manpower and equipment, submitted a proposal in the amount of $69,922.00, to maintain the landscaped medians on U.S. 1 south of U.S. Highway I-95 to Southwest 37th Avenue (Douglas Road); and WHEREAS, due the potential liability risks to the City of Miami and the endangerment to the public, the City Manager has issued a finding that the need to immediately maintain the landscaped medians on U.S. 1 is an emergency; and WHEREAS, the Department of Public Works recommend that a contract be awarded to Recio and Associates, Inc. on an emergency basis to immediately provide landscape maintenance for the U.S. 1 medians; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive formal sealed bids be waived and the acquisition of said services from Recio and Associates, Inc. be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. - 2 - 98- 194 Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency is hereby ratified, approved and confirmed, the 01. requirements for competitive sealed bids is hereby waived and the Department of Public Work's request to award a contract to Recio and Associates, Inc. is hereby approved for landscape maintenance services for State Road 5 (U.S. 1) medians south of U.S. Highway I-95, for a one (1) year period, in the amount of $69,922.00, with funds therefor hereby allocated from Account Code 11 No. 310501-340. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for said acquisition. Section 4.
