HomeMy WebLinkAboutR-98-0190J-98-181 2/10/98 RESOLUTION NO. 9 U— 190 A RESOLUTION AUTHORIZING THE CITY MANAGER TO CREATE AND ESTABLISH A POSITION OF HEARING OFFICER WHO SHALL: HEAR DISPUTES OF BILLS ISSUED BY THE SOLID WASTE TASK FORCE; TAKE TESTIMONY OF AGGRIEVED PROPERTY OWNERS; DETERMINE THE TOTAL NUMBER OF DWELLING UNITS FOR SOLID WASTE BILLING PURPOSES; DETERMINE THE NUMBER OF YEARS OF ARREARAGE FOR WHICH THE PROPERTY OWNER IS LIABLE; AND CONSIDER ANY SPECIAL CIRCUMSTANCES THAT RESULT IN AN UNDUE BURDEN UPON THE PROPERTY OWNER; MAKING ALL DECISIONS OF THE HEARING OFFICER FINAL; PROVIDING FOR SAID POSITION TO BE ABOLISHED UPON DISSOLUTION OF THE SOLID WASTE TASK FORCE. WHEREAS, the Solid Waste Task Force was created in order to identify, catalogue and ultimately bill those properties that heretofore have not been paying for solid waste collection services; and WHEREAS, Inspectors from the Solid Waste Task Force have inspected numerous properties and found that some of them have extra dwelling units for which a solid waste fee has not been paid for several years; and WHEREAS, the creation of the position of hearing officer will allow the City to fairly and equitably resolve any disputes from aggrieved property owners until such time as the Solid Waste Task Force is dissolved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. CITY COMMISSION MEETING OF FEB 1 0 M8 Resolution No. s- 190 Section 2. The City Manager is hereby authorized to create and establish a position of hearing officer who shall: hear disputes of bills issued by the Solid Waste Task Force; take testimony of aggrieved property owners; determine the total number of dwelling units for solid waste billing purposes; determine the number of years of arrearage for which the property owner is liable; and consider any special circumstances that result in an undue burden upon the property owner. Section 3. All decisions of the hearing officer shall be final. Section 4. The position of hearing officer as described herein shall be abolished upon the dissolution of the Solid Waste Task Force. Section 5. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this loth day of Fe rua , 1998. WALTE J.
