A RESOLUTION ESTABLISHING A SELECT ADVISORY
COMMITTEE TO CONDUCT A REVIEW OF
APPLICATIONS FOR THE POSITION OF CITY
ATTORNEY INCLUDING PERSONAL INTERVIEWS OF
THE APPLICANTS; APPOINTING INDIVIDUALS AND
DESIGNATING THE CHAIRPERSON THEREOF; FURTHER
REQUESTING SAID COMMITTEE TO: (A) FOLLOW
CERTAIN CRITERIA IN ITS CONSIDERATION; (B)
RECOMMEND NO LESS THAN THREE AND NO MORE
THAN FIVE APPLICANTS FOR SAID POSITION; AND
(C) CONCLUDE ITS PROCESS, IF POSSIBLE,
BEFORE MARCH 17, 1998.
WHEREAS, the position of City Attorney is currently vacant
and it is now in order for the City Commission to appoint a new
permanent City Attorney; and
WHEREAS, the City Commission wishes to make its appointment
of the City Attorney from a list of applicants who have been
recommended by a "select" or "blue ribbon" committee comprised of
prominent persons in the legal profession;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. A ten (10) member Select Advisory Committee
is hereby established to conduct a review of applications for the
position of City Attorney including personal interviews of the
applicants. The Committee shall establish its own rules and
guidelines; however, the Committee is requested to consider, as a
minimum, the following criteria and qualifications:
(a) Practicing in Florida with a minimum of five
years experience.
(b) Experience in the practice of municipal law
or experience in representing federal, local
or state governments.
(c) Administrative or supervisory experience
within a bureaucratic structure.
(d) Wide range of civil practice with due
significance being given to expertise in
matters dealing with torts, land use,
contracts and labor law.
(e) Demonstrated sensitivity to social process
including the area of international law and
issues of affirmative action and civil
rights. Personal integrity, ethics and
reputation for good character generally and
in the legal community, must be beyond
reproach.
The Committee is hereby further requested to recommend
no less than three and no more than five applicants for said
position to the City Commission by March 17, 1998.
Section 3. The Select Advisory Committee shall be
composed of the following members:
(a) VICE-CHAIRMAN ARTHUR E. TEELE, JR., ESQ., who is the
Chairperson of the City Legal Committee, shall serve as
a non -voting ex-officio member.

(b) LUCIA A. DOUGHERTY, ESQ., former City Attorney for the
City of Miami and the City of Miami Beach, shall serve
as Chairperson.
(c) JONI ARMSTRONG COFFEY, ESQ., who is Chairperson of the
Legal Affairs Management Committee of the City of Miami
Financial Emergency Oversight Board, or her designee,
chosen from among the membership of that Committee.
(d) LYNN LEWIS, ESQ., who is Chief Advisor of the City
Commission's Legal Evaluation Committee, chaired by
Commissioner Wifredo Gort; or in the event that
Ms. Lewis is unable to participate, a designee, who
shall be an attorney, appointed by the Mayor.
(e) Six (6) members who shall be appointed as follows:
(i) One (1) member appointed by the Mayor, who
shall be an attorney.
(ii) Five (5) members appointed by the City
Commission, three (3) of whom shall be
attorneys. The Chairman of the City
Commission and each City Commissioner shall
each make one (1) of the herein five (5)
appointments.
Section 4. Pursuant to Section 2(e)(i) hereinabove, the
following individual is hereby appointed by the Mayor as a member
of said Select Advisory Committee:

a. Suggestion by Vice Chairman Teele: Regarding Mayor's insurance policy, the
City should be designated as a co -beneficiary for twenty-five percent of the value
of the policy (key person policy payable to the City)
b. Suggestion by Vice Chairman Teele: Regarding Commission's insurance
policy, City should be designated as a co -beneficiary for 3/4ths of the value of the
Mayor's policy
4. Health Benefits
a. Enhanced dental and vision benefits
5. Deferred compensation (457 Plan)
a. Suggestion by Vice Chairman Teele: All executives should get this
6. Expense allowance/ club allowance
G. Cash bonuses
1. City Manager, City Attorney and City Clerk should be entitled to an annual cash
bonus that must be determined and paid during the fiscal year and cannot exceed
twenty-five percent of the annual salary

2. Suggestion by Vice Chairman Teele: City Commission will also qualify for cash
bonuses subject to mayoral veto, inasmuch as this is a budgetary item and subject
to veto pursuant to Ordinance 11564
3. Suggestion by Vice Chairman Teele: Department Heads shall also be
recommended for cash bonuses by the Manager
4. Suggestion by Vice Chairman Teele: Mayor may exercise veto regarding any
bonuses
H. Cars
1. Suggestion by Vice Chairman Teele: Should include cellular phones which
would be limited to local calls
I. Specialized occupations (licensed architects, Engineers, CPAs, Attorneys,
Medical Director and psychologists)
1. Suggestion by Vice Chairman Teele: Should establish a Tier/Class 3(a)
a. Bonuses of 10% should be provided to the above class subject to same occurring
in the current budget fiscal cycle
b. Continuing education should be provided as a requirement within this category to
maintaining license
J. Group 99 Benefits
1. Suggestion by Vice Chairman Teele: On a first come first serve basis every
employee should be entitled to tuition reimbursement to enhance their respective
positions
a. Full reimbursement would be based on employees attaining an academic letter
grade of "A"; partial reimbursement of 75% of cost would be based on employees
attaining an academic letter grade of "B"; partial reimbursement of 50% of cost
would be based on an academic letter grade of "C"
2. The total amount of tuition reimbursement for employees shall not exceed $1,200
during the fiscal year; subject to budgetary availability and departmental head
approval
3. The City Manager, City Attorney and City Clerk shall also be eligible for tuition
reimbursement, where applicable and exercise the discretion to waive benefit to
their respective employees
4. It is anticipated that city employees receive individual or group training on Word
processing and other applications (including Internet access)
K 401A Plan
1. Manager given the option to join another pension plan other than the City
a. Suggestion by Vice Chairman Teele: The City Manager nor City Attorney nor
City Clerk can prescribe to any other defined benefit other than what is prescribed
in their proposed tier plan
b. Direction to the City Attorney: by Vice Chairman Teele to draft an ordinance
which would make the City Manager, Assistant City Manager(s), Special
Assistant to City Manager, City Clerk, Assistant City Clerk, City Attorney,
Deputy City Attorney(s) eligible for a 401 A plan

Attorney for your perusal and consideration. This information is predicated
on your proposed selection date of March 24, 1998.
ATTACHMENT No. I. A copy of a proposed Resolution establishing and
appointing individuals to a Select Advisory
Committee to conduct a review of applications and
make recommendations to the City Commission for the
position of City Attorney.
ATTACHMENT NO. 2. Proposed Timetable.

ATTACHMENT NO. 3• Copy of memorandum providing information concerning
the mailout to solicit all of the Members of the
Local Government Section of the Florida Bar
Association. Please note that if optimum conditions
prevail, this mailout will take place on February
17, 1998.
ATTACHMENT NO. 4. A copy of the advertisement that is being published
in the newspapers. The advertisement sets forth
criteria for the full time position and establishes
a date of February 27, 1998, for deadline submittal
of applications.
For purposes of discussion and consideration of the attached proposed
resolution, I have scheduled this item on the February 10, 1998 City

The time schedule, is based upon a deadline of February 27, 1998 by which to receive the
applications. A hypothetical scenario in which the order is placed with Tallahassee on February
6th should result in our receiving the disk on February 12th. (3-4 days for their production, plus
one day shipping). ASAP will give us a 24 hour turnaround time which will have the mailing
ready for the City Mailroom on February 13. If this is in the morning, the Mailroom can get

1984 VACANCY IN OFFICE OF CITY ATTORNEY
Section 1. Committee Shall Conduct Its Business in
the Public.
The selection committee is charged with conduct of public
business that will be done in public. Specifically, the
Florida open meetings and public records laws will be applied
to the committee's work. All official documents will be
maintained by the City Clerk who will also provide all notices,
advertisements and other official communications necessary
for the performance of the committee's work. Committee members
will be responsible for knowing the details of the committee's
rules including the requirements of the open meetings law.
Discussions between committee members other than at open
meetings will be restricted to the discussion of scheduling
of meetings.
Section 2. Notice.
The City Clerk shall keep the official record of the
committee's work and will take responsibility for sending
notice of the vacancy and notice of all meetings of the commission
to the public.
Section 3. Initial Procedure; Investigative Sources: Notice.
The committee shall actively seek receive and review
the approved background statements submitted by those who
request consideration and by those who otherwise consent
to such consideration. Each such background statement shall
be in substantial compliance ..ith the approved form attached

to these rules and shall include a waiver of confidentiality
of all material necessary to adequately investigate each
proposed nominee, including but not limited to, disciplinary
records of The Florida Bar, records of the Florida Board
of Bar Examiners, credit records, judges, records of the

should receive recommendations from all interested citizens
and groups.
Section 4. Initial Screening.
After background statements have been received from
proposed nominees, the committee shall meet, evaluate and
classify those nominees who are tentatively "fully qualified."
A list of nominees tentatively deemed "fully qualified" shall
be selected by the commission for further investigation.
Before classification as tentatively "fully qualified", it
shall affirmatively appear from the information available
that the proposed nominee possess all the qualification prescribed
by law for the office to be filled and that such person appears
to possess the personal qualities competence and other personal
characteristics essential to the job.
Section 5. Further Investigation; Interviews.
Upon selection by the committee of proposed nominees
tentatively found upon preliminary evaluation to be "fully
qualified" and deserving of further consideration, the committee
shall further investigate the fitness and qualifications
of each person, utilizing all sources reasonably available

including such public interviews as the committee deems appropriate.
Section 6. Final Selection of Nominees.
Upon conclusion of all investigation reasonably obtained
by the committee, the committee shall meet to evaluate and
select by majority vote of its entire eligible membership,

From among those persons it shall have found "fully qualified"
and eligible the committee shall select and recommend for
appointment no less than three (3) nominees and no more than
five (5) nominees. The names of such nominees recommended
shall be forwarded to the Mayor and City Commissioners in
alphabetical order (or such other order as the committee
determines) and a copy of all investigative information and
documents relating to each such nominee shall be turned over
to the City Clerk.
Section 7. Standards and Qualifications; Criteria.

Due to the announcement on Tuesday, March 20, by City Attorney Josd Garcia Pedrosa
that it is his intention to run for State Attorney, it is my opinion that we should
immediately proceed to implement the ccrnplicated and sometimes long process of
selecting his replacement. Mr. Garcia Pedrosa notified us he will resign effective
June 30.
In the past, we have used a formula of establishing a blue-ribbon committee cam -
prised of prominent people in the legal world and, subsequently, we have made our
selection from their recommendations. May I suggest we follow this procedure once
again.
With your concurrence, I would like to appoint the following people to the committee:
as Chairman, Mr. Talbot ("Sandy") D'Alemberte, recently appointed Dean of the School
of Law of Florida State University. A prominent Miami attorney, he has a distinguished
record and impeccable credentials in the legal profession. Former award -winning
Legislator fran Dade County for many years, Chairman of the Constitutional Revision
Co mdttee and involved in pro-bono work, Mr. D'Alemberte brings with him the know-
ledge needed in such an important task. In addition, I feel that Mr. George Knox,
former City of Miami Attorney, would add specific knowledge required of the job in
the selection process.
The other recommended seven msnbers would be: Claude Sowle, Dean of the University
of Miami School of Law; Dr. Ovid Lewis, Dean of Nova University School of Law;
former Dean of the University of Miami School of Law, Soia Mentschikoff; the
President of the Dade County Bar Association, Neal Sonnett; the President of the
Cuban American Bar Association, Rogelio del Pino; the President of the Black Lawyers
Association, Marilynn Koonce; and the President of the Florida Association of Warren
Lawyers, Debra Weiss Goodstone.
The City Attorney's office will make staff available to the committee to keep minutes

Due to the announcement on Tuesday, March 20, by City Attorney Josd Garcia Pedrosa
that it is his intention to run for State Attorney, it is my opinion that we should
immediately proceed to implement the omplicated and sometimes long process of
selecting his replacement. Mr. Garcia Pedrosa notified us he will resign effective
June 30.
In the past, we have used a formula of establishing a blue-ribbon committee com-
prised of prominent people in the legal world and, subsequently, we have made our
selection fran their recatuendations. May I suggest we follow this procedure once
again.
With your concurrence, I would like to appoint the following people to the committee:
as Chairman, Mr. Talbot ("Sandy") D'Alemberte, recently appointed Dean of the School
of Law of Florida State University. A prominent Miami attorney, he has a distinguished
record and impeccable credentials in the legal profession. Former award -winning
Legislator from Dade County for many years, Chairman of the Constitutional Revision
Committee and involved in pro-bono work, Mr. D'Alemberte brings with him the know-
ledge needed in such an important task. In addition, I feel that Mr. George Knox,
former City of Miami Attorney, would acid specific knowledge required of the job in
the selection process.
The other recanm>xxW seven members would be: Claude Sowle, Dean of the University
of Miami School of Law; Dr. Ovid Lewis, Dean of Nova University School of Law;

During the January 27, 1998, meeting, the City Commission passed Motion No. 98-96
requesting that an RFQ be issued within the next seven days for the selection of a City
Attorney and, further, that the City Manager, the City Clerk and the Interim City
Attorney work together to determine the minimum requirements and set up an interview
process.
Attached, as requested by you, is a package on the City Attorney selection process for
the City of Coral Gables which was provided by City Manager Jack Eads. In their case,
the City Commissioners each appointed one person to the City Attorney Search
Committee. Advertisements were placed in local newspapers and media (as noted in
the package) for either in-house counsel or outside firms. Outside firms were required
to submit a statement of qualifications (as noted in the ad).
Carol Marchner, the Florida League of Cities' Labor Relations Director, was not aware
of any other RFQ process for City Attorney but thought that the City of Orlando had the
most recently appointed City Attorney. We contacted Orlando and were advised that
they did not have a structured selection process - the Mayor recommended someone
and the City Commission agreed. A copy of their City Attorney's professional services
agreement is also attached.
The term "RFQ" infers that there will be a contract. Please note, however, that Section
21 of the City Charter forbids a contract by stipulating that the City Attorney be a full-
time government employee and shall not engage in private practice of law. Attached
are sections of the City Charter and Code regarding the City Attorney.

CHARTER AND RELATED LAWS
Sec. 19-A. Authority to create and discon-
tinue departments by ordinance
not limited by other charter pro-
visions.
The force and effect of any ordinance passed
and adopted pursuant to this act shall not be
limited, subject to, or controlled by, any limita-
tions, definitions, or delegations of power, author-
ity, duties or functions in other sections of the
charter of the City of Miami.

Sec. 20. Directors of departments.
The city manager shall appoint a director for
each department and, in his discretion, may con-
solidate two departments under one director. Each
such director shall serve until removed by the city
manager or until his successor has been ap-
pointed and qualified, shall conduct the affairs of
his department in accordance with rules and
regulations made by the city manager, shall be
responsible for the conduct of the officers and
employees of his department, for the performance
of its business, and for the custody and preserva-
tion of the books, records, papers and property
under its control, and, subject to the supervision
and control of the city manager in all matters,
shall manage the department. None of the provi-
sions of this section, however, shall be applicable
to the department of law or to the department of
water and sewers.*

Sec. 21. Department of law.
The city attorney shall be the director of the
department of law and an attorney -at -law admit-
ted to the practice in the State of Florida. He shall
be the legal advisor of and attorney and counsel
for the city, and for all officers and departments
thereof in matters relating to their official duties.
He shall prosecute and defend all suits for and in
behalf of the city, and shall prepare all contracts,
bonds and instruments in writing in which the
city is concerned and shall endorse on each his
approval of the form and correctness thereof.
*Note —Transfer of the operations of the city's department
of water and sewers to Metropolitan Dade County was autho-
rized by Res. No. 73-225, adopted March 22, 1973.
The city attorney shall be the prosecuting at-
torney of the municipal court. He shall have such
number of assistants as the commission by ordi-
nance may authorize. He shall prosecute all cases
brought before such court and perform the same
duties, so far as they are applicable thereto, as are
required of the prosecuting attorney of the county.
When required to do so by the resolution of the
commission, the city attorney shall prosecute or
defend for and in behalf of the city all complaints,
suits and controversies in which the city is a
party, and such other suits, matters and contro-
versies as he shall, by resolution or ordinance, be
directed to prosecute or defend.
The commission, the city manager, the director
of any department, or any officer or board not
included within a department, may require the
opinion of the city attorney upon any question of
law involving their respective powers and duties.
The city attorney shall be a full-time govern,
mental empoyyes; shall not engage in the private
practice of law-, and upon his election by the city
commission shall serve until the time for the
election of the city officials specified in section 4(c)
of the charter which follows the neat general

(a) The city attorney shall draft, with the as-
sistance of any individual the city attorney deems
necessary, a Charter amendment within 120 days
after the city commission adopts a resolution
directing the city attorney to prepare such amend-
ment or after the certification of a petition of ten
percent of the qualified electors of the City of
Miami requesting such amendment.
(b) The Charter amendment drafted by the city
attorney shall be approved in final form by the
city commission in a resolution calling for a spe-
cial election upon the amendment. The resolution
calling for the special election shall include the
text of the amendment draft approved by the city
commission, and such draft shall be deemed sub-
mitted to the electorate by the adoption of said
resolution.

(a) For the preparation and issuance of photo-
copies of resolutions, ordinances and all other

collect the maximum fee as provided in state law.
(b) For the preparation and issuance of copies
of resolutions, ordinances and all other official
records on microfilm, the city clerk shall collect
the maximum fee as provided in state law.
(c) For the service of duplicating cassette tapes
from original tapes used by the city clerk in the
voice recording of city commission meetings, the
city clerk shall collect a fee as provided in state
law for such service, provided the person request-
ing such service furnishes his or her own cassette;
if the city clerk furnishes the cassette, he shall
collect a fee of $8.00.
(d) For certifying any document, the city clerk
shall collect a fee of $2.00 for each document.

Sec. 2-143. City archives and records man-
agement program.
(a) Short title, purpose. The "City of Miami
archives and records management program" is
hereby established to provide for the proper and
efficient management of the city's public records,
and for the operation of a central repository for
same, including the city's historically valuable
records.
(b) Definitions: The following words, terms and
phrases, when used in this section, shall have the
meanings ascribed to them in this section, except
where the context clearly indicates a different
meaning:
Archival records means those public records,
manuscripts and other records which document
the origin and history of the government of the
City of Miami and the development of its depart-
ments which are worthy of permanent preserva-
tion and administration because of their impor-
tance.
City clerk means the city clerk of the City of
Miami, Florida, or his/her duly designated repre-
sentative, who has primarily supervisory author-
ity over the records management program.

The City Attorney Search Committee has concluded its deliberations
and is hereby submitting to you the names of five candidates that
it recommends for consideration for the position of City Attorney.

After four months of careful study, the Committee offers the
following brief synopsis of other recommendations with regard to
staffing and the usage of outside counsel.
In the spirit of minimizing outside legal services in order to
effect to substantial cost saving to the City, the Search Committee
recommends the appointment of a full-time Assistant City Attorney.
The Committee is prepared to present names of applicants for this
position at the Commission's convenience.
A further recommendation is that the City Commission consider
impanelling a cost containment board with the duty to oversee the
costs of the City's outside legal services, and recommend to the
City the names of lawfirms to be used for such work.

The meeting was called to order by Chairman Perez at 4:20 p.m.
The minutes of the July 6, 1994 meeting were approved upon
motion made by Ms. Delgado and seconded by Mr. Efthimiou.
The Committee discussed the mandate of the City Commission
given to the Search Committee, and it was felt that clarification
was required as to whether the Commission expected the Committee to
select the in-house counsel or lawfirm for ratification and
appointment by the City Commission, or whether one, two, three or
more names are to be submitted to the Commission for their
selection.
It was moved by Ms. Delgado and seconded by Mr. Russo that
Chairman Perez would appear before the City Commission to address
the issue and obtain clarification as to what, precisely, the
Commission would like to receive from the Committee.
The questions, to be submitted to the City Commission in
writing prior to the August 30, 1994 meeting, would be as follows:
Does the City Commission wish the Search Committee's Final
Report to consist of:
A. one recommendation for the position of City Attorney,
be it in-house or outside counsel, or

The Committee selected the following dates for conducting
interviews, to be scheduled by the Secretary, (contingent upon the
availability of Mr. Friend) allowing 30 minutes for lawfirms, and
20 minutes for individuals, as follows:
August 23, 24 and 30, 1994
(4:00 p.m. thru 8:00 p.m,.)
September 7, 1994
(5:00 p.m. thru 7:00 p.m.)
Mr. Russo suggested that we allow one question per Committee
member at a time, and go around the table as often as needed, so
that the questioning is evenly distributed amongst the members.
September 17, 1994 (8:00 a.m. thru 12:00 p.m.) was chosen as
the date upon which the Committee will meet to make its final
deliberations.
At the conclusion of the September 7 meeting, the Committee
will delegate to its members the task of calling to verify the
candidates' references, the reports of which will be considered at
the September 17 meeting. By September 17, the Secretary will have
contacted the Florida Bar to ascertain if the finalists are in good
standing and whether there have been any disciplinary hearings or
if any are contemplated in the near future.
The meeting adjourned at 5:45 p.m. on motion made by Ms.

The meeting was called to order by Chairman Perez at 4:10 p.m.
The minutes of the June 20, 1994 meeting were approved upon
motion made by Mr. Friend and seconded by Ms. Delgado.
The Chairman provided an update to the Committee on his brief
presentation to the City Commission on June 22, 1994. The
Committee discussed phone calls that had been received by
individual members of the Committee from the Miami Herald reporter,
Christina Samuels. It was the consensus that the Secretary should
be the designated person to respond to members of the press,
conferring with the Chairman when necessary.
Ms. Delgado reported that the press release had been forwarded
to the Secretary along with a list of the media. The Secretary
stated that Sandy Youkilis, Assistant City Manager, will handle the
press release which, with the Committee's concurrence, will include
an introduction containing Bob Zahner's pending retirement after 27
years of service with the City.
The Chairman distributed a grading sheet to assist the members
of the Committee in the initial stage of assessing the
applications. It was moved by Mr. Friend and seconded by Ms.
Delgado that the applications be graded A, B, or C per batch, and
returned to the Secretary by Monday, July 11, 1994; that a
candidate must attain an A or B rating from at least three members
of the Committee in order to continue to be considered for the
post; and that if a committee member so desires, he may select one
candidate per batch to be kept on the list who has not received the
required number of votes.

By motion made by Mr. Friend and seconded by Ms. Delgado, the
Committee instructed the Secretary to prepare a checklist letter to
be sent to those who have submitted incomplete applications, and
putting the applicant on notice that the application will not be
considered until the deficiencies are met by the August 19
deadline.
It was the consensus of the Committee to pull two applications
(Brake and Ginsburg), so that the Secretary might write to each to
clarify whether they wish to be considered as lawfirms or
individuals.
The Committee selected a tentative date of July 21 at 4:00
p.m., for the next meeting.

The meeting was called to order by Chairman Perez at 4 : 20 p . m .
The minutes of the July 5, 1994 meeting were approved upon
motion made by Ms. Delgado and seconded by Mr. Efthimiou.
The Committee discussed the mandate of the City Commission
given to the Search Committee, and it was felt that clarification
was required as to whether the Commission expected the Committee to
select the in-house counsel or lawfirm for ratification and
appointment by the City Commission, or whether one, two, three or
more names are to be submitted to the Commission for their
selection.
It was moved by Ms. Delgado and seconded by Mr. Russo that
Chairman Perez would appear before the City Commission to address
the issue and obtain clarification as to what, precisely, the
Commission would like to receive from the Committee.
The questions, to be submitted to the City Commission in
writing prior to the August 30, 1994 meeting, would be as follows:
Does the City Commission wish the Search Committee's Final
Report to consist of:
A. one recommendation for the position of City Attorney,
be it in-house or outside counsel, or
B. a short list (5 or less) for the Commission to choose
from, or
C. a complete list of the finalists, ranked by the
Committee in order of preference, from which to make
their selection?
Furthermore, would the City Commission prefer to receive the
Search Committee's Final Report at its meeting on September 27,
1994 (the day of the Second Budget Hearing), or at the next
regularly scheduled meeting on October 11, 1994?

The Committee selected the following dates for conducting
interviews, to be scheduled by the Secretary, (contingent upon the
availability of Mr. Friend) allowing 30 minutes for lawfirms, and
20 minutes for individuals, as follows:
August 23, 24 and 30, 1994
(4:00 p.m. thru 8:00 p.m,.) ,
September 7, 1994
(5:00 p.m. thru 7:00 p.m.)
Mr. Russo suggested that we allow one question per Committee
member at a time, and go around the table as often as needed, so
that the questioning is evenly distributed amongst the members.
September 17, 1994 (8:00 a.m. thru 12:00 p.m.) was chosen as
the date upon which the Committee will meet to make its final
deliberations.
At the conclusion of the September 7 meeting, the Committee
will delegate to its members the task of calling to verify the
candidates' references, the reports of which will be considered at
the September 17 meeting. By September 17, the Secretary will have
contacted the Florida Bar to ascertain if the finalists are in good
standing and whether there have been any disciplinary hearings or
if any are contemplated in the near future.
The meeting adjourned at 5:45 p.m. on motion made by Ms.
Delgado and seconded by Mr. Efthimiou.

Committee member Gus Efthimiou,

water, said Coral Gables needs an attor-

seems to be that from the past it was a-
part -time position, and part time couldn't
handle it," he said.
Margarita Delgado, who owns a public
relations and market research firm, said
she will look at the types of cases the

The City Attorney Search Committee has concluded its deliberations

impanelling a cost containment board with the duty to oversee the
costs of the City's outside legal services, and recommend to the
City the names of lawfirms to be used for such work.

The minutes of the June 20, 1994 meeting were approved upon
motion made by Mr. Friend and seconded by Ms. Delgado.
The Chairman provided an update to the Committee on his brief
presentation to the City Commission on June 22, 1994. The
Committee discussed phone calls that had been received by
individual members of the Committee from the Miami Herald repo:. -ter,
Christina Samuels. It was the consensus that the Secretary should
be the designated person to respond to members of the press,
conferring with the Chairman when necessary.
Ms. Delgado reported that the press release had been forwarded
to the Secretary along with a list of the media. The Secretary
stated that Sandy Youkilis, Assistant City Manager, will handle the
press release which, with the Committee's concurrence, will include
an introduction containing Bob Zahner's pending retirement after 27
years of service with the City.
The Chairman distributed a grading sheet to assist the members
of the Committee in the initial stage of assessing the
applications. It was moved by Mr. Friend and seconded by Ms.
Delgado that the applications be graded A, B, or C per batch, and
returned to the Secretary by Monday, July 11, 1994; that a
candidate must attain an A or B rating from at least three members
of the Committee in order to continue to be considered for the
post; and that if a committee member so desires, he may select one
candidate per batch to be kept on the list who has not received the
required number of votes.

By motion made by Mr. Friend and seconded by Ms. Delgado, the
Committee instructed the Secretary to prepare a checklist letter to
be sent to those who have submitted incomplete applications, and
putting the applicant on notice that the application will not be
considered until the deficiencies. are met by the August 19
deadline.
It was the consensus of the Committee to pull two applications
(Brake and Ginsburg), so that the Secretary might write to each to
clarify whether they wish to be considered as lawfirms or
individuals.
The Committee selected a tentative date of July 21 at 4:00
p.m., for the next meeting.

The City of Coral Gables is accepting applications for the Office of City Attorney. In
April of 1994, the City Commission was informed by current City Attorney Robert Zahner that
he was planning to retire at the end of the summer, after 25 years of service. The City
Commission immediately appointed a five -member Search Committee which is to make
recommendations to the Commission. The Committee members include Richard E. Friend,
Gus Efthimiou, Margarita Delgado, Alfonso J. P6rez, and Edmund P. Russo.
In addition to filling the position of City Attorney, the Search Committee will consider
the creation of an Assistant City Attorney position and the possibility of hiring on an outside
law firm to conduct the City's legal business. The Committee has announced that in-house
counsel applicants for City Attorney must have litigation experience and have a minimum of
five years admission to the Florida Bar. Applicants for the Assistant City Attorney position
must have three years admission to the Florida Bar. The Committee has determined that
experience in government and administrative practice, with emphasis on planning, land use,
zoning, code enforcement, ordinance drafting, civil rights, personnel issues and applicable
municipal county, state and federal law will be important factors considered. All interested
parties who are applying foreither position are being asked to submit a resume and three work -
related references. Law firms which are interested in becoming in-house counsel should submit

five copies of a Statement of Qualifications (less than 10 pages) and three work -related
references. The salary or fees for the position will be commensurate with experience and
ability.
The Committee has announced that all applications and proposals are to be submitted

The current City Attorney, Robert Zahner, started with the City in 1967 as an Assistant
City Attorney and elevated to the City Attorney's position in 1979. Mr. Zahner, a native of
Beacon, New York, served in the China -Burma -India Theater during World War 11. He is a
graduate of the University of Miami School of Law and previously served as Municipal Judge
and as City Attorney for the City of Miami.

The meeting was called to order at 2:00 p.m.
Mayor Valdes-Fauli addressed the Committee, on behalf of the
City Commission,.thanking the members for agreeing to serve. He
stressed the importance of doing a thorough study of the options
available, i.e., privatization, or having one or more in-house
counsel, either on a full or part-time basis. With $250,000 to
$500,000 per year being spent in legal fees annually, the City is
making one of the most important decisions that it will have to
make for many years to come. He had no one particular person in
mind for the job, he said, but two lawfirms have expressed
interest, namely, Adorno and Zeder, P.A., and Weiss, Serota, and
Helfman, P.A. The Mayor said he hoped that the Committee will be
in a position to make its recommendations to the City Commission by
the early Fall.
Vice Mayor Thomson concurred with the Mayor's statements but
stressed the importance of finding someone who knows the City and
its particular problems who is strong on zoning and familiar with
municipal law.
Commissioner Kerdyk also thanked the members for serving on
the Committee and he was glad to see a good mix including someone
from the business world.
Bob Zahner explained the Sunshine Law, §286.011, F.S. He
discussed the City's self-insurance program with Gallagher Bassett
which has been in effect for approxiately fifteen years to handle
tort claims. He felt that we got very preferred rates while
dividing the work between three or more firms paying, on average,
$125.00 per hour. We currently use such firms as George, Hartz,
Lundeen, Flagg and Fulmer, P.A.; Zack, Hanzman, Ponce, Tucker,
Korge and Gillespie, P.A.,; and Akerman, Senterfitt and Eidson,

P.A. Our labor work is handled by Jim Crosland of Muller, Mintz,
et al, who has been doing this for the City for about twenty years.
Mr. Zahner stated that he intends to stay with the City until a
successor is found and has agreed to make himself available to the
City as an advisor after retirement. If the committee were to go
with .an individual attorney to fill the position, it was his
opinion that the demands of the job necessitated someone being in
the office on a daily basis, so that no outside practice of ' law
would be practical (though not prohibited by the City Charter).
Mr. Perez was then unanimously chosen as Chairperson, upon
motion by Mr. Russo.
Continuing the discussion of lawfirm v. individual(s), Mr.
Perez said he foresaw a problem with hiring a lawfirm, in that no
one particular attorney is in control.
Mr. Efthimiou discussed the West Miami experience and wondered
whether a lawf irm would be a good way to go f or a City such as
Coral Gables.
Mr. Friend suggested that if we were to go with a lawfirm, a
fixed cost basis would be advisable.
Mr. Russo wondered if we could exclude the lawfirm option at
this time.
Mr. Friend said that he was not ready to exclude that option.
Ms. Delgado asked if we had a study of cities of comparable
size, as to how they handled their legal defense.
The Committee then selected ten cities for study, with each
member assigned different ones to report on and present their
findings at the next meeting. The cities selected were: Miami,
North Miami, North Miami Beach, Naples, West Miami, Boca Raton,
Sarasota, Miami Beach, Vero Beach and Hialeah.
Mr. Friend asked the Secretary to provide the Committee with
a cost breakdown of fees paid to outside counsel giving specifics
as to what cases had been handled by each firm over the past year.
The Secretary reported that the National Institute of
Municipal Law Officers had promised to run a free add in the next
issue of Municipal Attorney (readership 20,000 nationwide). Also,
the secretary will contact NIMLO to see if any studies or
statistics are available to the Committee.
The Committee then selected Tuesday, June 7, 1994, at 4:00
p.m. as the date of the next meeting. The meetirP adjourned at

Board and appeals from the Code Enforcement Board.
This includes the time spent in preparation and the time
