RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NEGOTIATED AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, IN AN AMOUNT
NOT TO EXCEED $525,000.00 WITH EVANS
ENVIRONMENTAL & GEOSCIENCES, TO PROVIDE
PROFESSIONAL ENVIRONMENTAL ENGINEERING
SERVICES FOR THE CITY OF MIAMI BROWNFIELDS
REDEVELOPMENT PROJECT; ALLOCATING FUNDS
THEREFOR FROM THE SPECIAL REVENUE FUNDS
ENTITLED "CITY OF MIAMI BROWNFIELDS
REDEVELOPMENT PROJECT" ($425,000.00) AND
"CITY OF MIAMI BROWNFIELDS DEMONSTRATION
PILOT" ($100,000.00), FOR SAID SERVICES.
WHEREAS, on December 9, 1997, the City Commission pursuant
to Resolution No. 97-874 authorized the City Manager to accept an
award from the State of Florida Office of Tourism, Trade and
Economic Development for a Brownfields Redevelopment Grant in the
amount of $500,000.00; and
WHEREAS, on December 9, 1997, the City Commission pursuant
to Resolution No. 97-873 authorized the City Manager to accept an
augmentation of an a award from the U.S. Environmental Protection
Agency increasing the original award for a Regional Brownfields
Demonstration Pilot Project by $100,000.00; and
WHEREAS, the selection procedures were performed in
accordance with the Consultants Competitive Negotiation Act as
defined in F.S. Section 287.055 and Section 18-81 of the Code of
the City of Miami, Florida, as amended; and

WHEREAS, on January 13, 1998, the City Commission pursuant
to Resolution approved the findings of the Consultant Selection
Committee as to the most qualified teams, in rank order, to
provide the required professional services for the City of Miami
Brownfields Redevelopment Project; and
WHEREAS, on January 13, 1998, the City Commission pursuant
to Resolution authorized the City Manager to negotiate with the
most qualified teams to provide professional environmental
engineering services, in rank order, based on the findings of
Selection Committee for the City of Miami Brownfields
Redevelopment Project, until he arrives at an agreement which is
fair, competitive and reasonable; and
WHEREAS, on January 13, 1998, the City Commission pursuant
to Resolution further authorized the City Manager to undertake
negotiations with the number one ranked team, Evans Environmental
& Geosciences, in rank order until he arrives at an agreement
which is competitive and reasonable; and
WHEREAS, an agreement between the City of Miami and Evans
Environmental & Geosciences, has been negotiated in a fair and
reasonable manner and is in the best interest of the parties and
provides for compensation to the firm for professional services
in the total amount not to exceed $525,000.00; and
WHEREAS, said agreement consists of professional
environmental engineering services for environmental site
assessments (Phase I and Phase II), risk based corrective action,
and site remediation activities; and

WHEREAS, funds in the total amount of $500,000.00 are
available in the Special Revenue Fund entitled "City of Miami
Brownfields Redevelopment Project" and funds in the total amount
of $100,000.00 are available in the Special Revenue Fund,
entitled "City of Miami Brownfields Demonstration Project";
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals set forth in the Preamble to
this Resolution are hereby adopted by reference thereto and
incorporated herein as if full set forth in this Section.
Section 2. The City Manager is hereby authorized�l to
execute a negotiated Agreement in a form acceptable to the City
Attorney, in an amount not to exceed $525,000.00, with the firm
of Evans Environmental & Geosciences for the City of Miami
Brownfields Redevelopment Project, to provide professional
environmental engineering services for environmental site
assessments (Phase I and Phase II), risk based corrective action,
and site remediation activities.
Section 3. Funds therefor, in an amount not to exceed
$525,000.00, are hereby allocated from the Special Revenue Fund
entitled "City of Miami Brownfields Redevelopment Project", in an
amount not to exceed $425,000.00, and from the Special Revenue
Fund entitled "City of Miami Brownfields Demonstration Pilot
Project", in an amount not to exceed $100,000.00, for said
services.
l� The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing the City Manager to execute the negotiated agreement, in a form acceptable to the
City Attorney, in an amount not to exceed $ 525,000 with Evans Environmental & Geosciences.
The Agreement is to provide professional environmental engineering services for environmental
site assessments (Phase I and Phase II), risk based corrective action, and site remediation
activities.
BACKGROUND:
The Department of Planning and Development, with the City Manager, has negotiated an
agreement between the City of Miami and Evans Environmental & Geosciences for professional
environmental engineering services for environmental site assessments (Phase I and Phase II),
risk based corrective action, and site remediation activities for the City of Miami Brownfields
Redevelopment Project.
On July 17, 1997 by Resolution No. 97-536, the City Commission designated this as a Category
B Project, for the acquisition of environmental engineering services. The selection procedures
were performed in accordance with the consultant competitive selection process as defined in
Section 18.81 of the Code of the City of Miami and in F.S. Chapter 287. Later, by a Resolution
adopted on January 13, 1998, approved the findings of the Competitive Selection Committee as
to the most qualified teams, in rank order, to provide the required professional services. Further,
directed by that Resolution, the City Manager conducted negotiations were conducted with the
number one ranked team, Evans Environmental & Geosciences, to arrive at an agreement, which
is competitive and reasonable. The agreement stipulates that Evans Environmental &
Geosciences will provide all required professional services for a fee not to exceed $525,000.
Funding is available to cover the cost of these services from the Special Revenue Fund entitled
"City of Miami Brownfields Redevelopment Project" and the existing Special Revenue Fund,
No. 066002, entitled "City of Miami Brownfields Demonstration Pilot Project".
