Q - 15 0 A RESOLUTION TO TEMPORARILY RESTRICT VEHICULAR ACCESS TO CORNELIA DRIVE AT ITS INTERSECTION WITH S.W. 27 AVENUE AND TIGERTAIL AVENUE IN THE CITY OF MIAMI, FLORIDA, SUBJECT TO THE PROVISIONS CONTAINED WITHIN THIS RESOLUTION. WHEREAS, Cornelia Drive between S. W. 27 Avenue and Tigertail Avenue is a poorly developed public right of way occupied by dense vegetation; and WHEREAS, the pavement on Cornelia Drive is insufficiently wide and in poor condition which does not allow for good passage for vehicular traffic; and WHEREAS, all of the property owners abutting Cornelia Drive have expressed concern about unsafe conditions within this poorly developed right of way and have petitioned the City to restrict vehicular access to Cornelia Drive at its intersection with S. W. 27 Avenue and Tigertail Avenue; and WHEREAS, the Police Department, Fire -Rescue Department and General Services Administration / Solid Waste Department have been notified of the proposed vehicular access restriction of Cornelia Drive and have expressed no substantial objection to the restriction of vehicular access to Cornelia Drive at its intersection with S. W. 27 Avenue and Tigertail Avenue; and WHEREAS, the proposed vehicular access restriction shall be accomplished by the placement of a fence across Cornelia Drive at its intersection with S. W. 27 Avenue and at Tigertail Avenue; and CITY COIwIIassma MEETING OF FE B 1 0 1998 Resolution No. 08- 150 WHEREAS, Section 54-16 of the Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing, to recommend that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on this date as to any objections to the implementation of prohibition of vehicular access to Cornelia Drive at its intersection with S. W. 27 Avenue and Tigertail Avenue on a temporary basis and no objections of substance were sustained by the City Commission; and WHEREAS, the City Commission finds that the herein prohibition should be instituted until such time that Cornelia Drive is closed and vacated in accordance with the subdivision regulations contained in Chapter 55 of the Code of the City of Miami, Florida, or until such time that the Director of the Department of Public Works makes a finding that Cornelia Drive should be reopened to vehicular access; and WHEREAS, the City Commission finds that the herein prohibition is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in The Preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. 2 08- 150 Section 2. The restriction of vehicular access to Cornelia Drive at its intersection with S. W. 27 Avenue and Tigertail Avenue in the City of Miami, Florida, is hereby authorized and permitted on a temporary basis, subject to the following conditions: (a) The Department of Public Works shall approve the design of the temporary fence to prohibit vehicular access; (b) the herein prohibition shall be instituted until such time that Cornelia Drive is closed and vacated in accordance with the subdivision regulations contained in Chapter 55 of the Code of the City of Miami, Florida, or until such time as the Director of the Department of Public Works makes a finding that Cornelia Drive should be reopened to vehicular traffic. W. 27 Avenue and Tigertail Avenue REFERENCES: ENCLOSURES: The purpose of the February 10, 1998 public hearing is to hear comments and consider a Resolution authorizing the restriction of vehicular access to Cornelia Drive at its intersection with S. W. 27 Avenue and Tigertail Avenue. BACKGROUND Cornelia Drive between S. W. 27 Avenue and Tigertail Avenue in Coconut Grove is a poorly developed public right of way with a substandard pavement width in poor condition. Very little vehicular and pedestrian traffic utilize this roadway where the adjacent properties are either undeveloped or consists of abandoned structures. The Ritz -Carlton Hotel is currently under design for the entire block of land east of Cornelia Drive. In order to construct the new hotel, the owners of the Ritz Carlton have joined with the owners of the Coconut Grove Bank to replat and close Cornelia Drive. Since the replatting process will take several months to complete, these property owners are very concerned about security, public safety and illegal dumping on Cornelia Drive and the vacant land adjacent to the roadway, and have requested that access to Cornelia Drive be temporarily restricted until completion of the platting process. it is respectfully recommended that the restriction to vehicular access be implemented on a temporary basis until such time that the right of way is closed and vacated in accordance with the City Code or until such time that the Director of the Public Works Department makes a finding that Cornelia Drive should be reopened to vehicular access. fig- 150 CITY OF MIAMI, FLORIDA TO : SEE BELOW FROM :� James J.
