RESOLUTION NO. 9 v - 94
A RESOLUTION AUTHORIZING THE DADE COMMUNITY
FOUNDATION ("THE FOUNDATION") TO ESTABLISH A
GENERAL ACCOUNT IN THE NAME OF THE CITY OF MIAMI'S
OVERTOWN NEIGHBORHOOD PARTNERSHIPS PROGRAM,
AND SIX ADDITIONAL ACCOUNTS IN THE NAME OF THE
MAYOR AND INDIVIDUAL CITY COMMISSIONERS,
RESPECTIVELY, FOR PURPOSES OF RAISING AND
DISPERSING TAX DEDUCTIBLE CHARITABLE FUNDS
ACCORDING TO THE FOUNDATIONS' GUIDELINES;
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
TRANSFER FUNDS IN THE CITY'S OVERTOWN
NEIGHBORHOOD PARTNERSHIPS' ACCOUNT TO THE
FOUNDATION'S OVERTOWN NEIGHBORHOOD
PARTNERSHIPS' ACCOUNT; AND, DIRECTING THAT ALL
REQUISITE ACCOUNTING AND LEGISLATIVE STEPS BE
TAKEN TO IMPLEMENT THE AFOREMENTIONED.
WHEREAS, the City Commission desires to develop a mechanism and procedure to
receive tax-deductible funds to assist charitable endeavors in the City of Miami like the
Three Kings Parade, the Martin Luther King Day Parade, and the Puerto Rican, Haitian and
Nicaraguan Festivals, which otherwise may be neglected due to the City's present financial
crisis; and
WHEREAS, during the fourth quarter of 1995, the administration of Miami -Dade
Community College and its Board of Trustees made a decision to discontinue the Overtown
Neighborhood Partnerships Program ("Program") as an initiative of its institution; and

WHEREAS, in January 1996 Miami -Dade Community College and the City of Miami
("City") agreed that the Program would be placed under the auspices of the City, and on
July 1, 1996, the City assumed administrative supervision and responsibility for the
Program; and
WHEREAS, the Program's objective under the City's auspices has been to continue
the economic, social, educational, and physical revitalization and transformation necessary
to take Overtown from a state of impoverishment and dependence, to a holistic state of
self sustenance and independence, through the engagement of residents and a cross -
sector of partners; and WHEREAS, Dade Community Foundation (the "Foundation"),
Miami's permanent philanthropic endowment, is a nonprofit, tax-exempt public charity,
which receives gifts from individuals, families, businesses, foundations and other
organizations eager to make a difference in the future of Miami -Dade County; and
WHEREAS, the City Commission agrees with the Foundation, that no one person or
entity has the resources to provide solutions to all the challenges faced by a community
this diverse. But by combining the financial and human resources of many individuals, we
can make a significant difference; and
WHEREAS, donated funds comprise the Foundation's assets, most of which are
part of the Foundation's permanent endowment, and are used to support local, nonprofit
organizations through grants and technical assistance; and
WHEREAS, the philanthropic impact of the Foundation is evident throughout Miami -
Dade County's neighborhoods, community development corporations, health and social
service agencies, cultural organizations, and other community groups; and
WHEREAS, Dade Community Foundation's mission is to bring together the diverse
groups in Miami -Dade County to work toward building a greater sense of community and
improving the quality of life for all Miami -Dade residents; and

WHEREAS, The Foundation accomplishes its mission by:
•Encouraging philanthropy and charitable giving;
•Providing grantmaking expertise and philanthropic services to donors with diverse
interests, at all levels of giving;
•Protecting and managing the assets of philanthropic funds established by donors;
•Supporting local nonprofit organizations through grants and technical assistance;
•Serving as a resource and catalyst for philanthropic activities, bringing together
different forces in the community to develop new ways to use the community's
vast capacities and assets; and
•Developing a permanent endowment - a resource for future generations to meet
the challenges of their times;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The Dade Community Foundation (the "Foundation") is hereby
authorized to establish a general account in the name of the City of Miami Overtown
Neighborhood Partnerships' Program, for purposes of receiving and dispersing tax
deductible funds to be used for charitable purposes.
Section 3. Further, said Foundation is hereby authorized to set up six individual
accounts in the name of the Mayor and each City Commissioner. Said accounts will be
able to receive and disperse any deductible funds donated to the Foundation in the name
of the particular elected official.

Section 4. The City Manager and City Attorney are hereby authorized and
directed to take all requisite legislative and accounting steps, including preparation and
submittal to City Commission for its consideration, to transfer funds presently in the City's
Overtown Neighborhood Partnerships Program's, to the Foundation.
Section 5. This Resolution shall become effective immediately upon its adoption.

REFERENCES:
I hereby request that you add to the agenda for the Commission Meeting of January 27,
1998, a resolution authorizing the Dade Community Foundation to establish a general
account for charitable purposes to receive and disperse donations; and, further providing
that six separate accounts with the Mayor and each Commissioner being able to raise and
disperse funds according to the Dade Community Foundation guidelines.
The purpose of this account would be to receive tax-deductible funds to assist in charity
purposes in the City of Miami like the Three Kings Parade, the Martin Luther King Day
Parade and the Puerto Rican, Haitian and Nicaraguan Festivals, which otherwise may be
neglected due to the City's present financial crisis.
