HomeMy WebLinkAboutR-98-0023J-98-03 12/22/97 RESOLUTION NO. 9 _ 23 A RESOLUTION TRANSFERRING PORTIONS OF CITY- ONWED PROPERTY ON WATSON ISLAND, WITHIN THE CITY OF MIAMI, FLORIDA, TO THE JURISDICTION OF THE STATE HIGHWAY SYSTEM IN CONFORMANCE WITH SECTION 337.29, FLORIDA STATUTES; FURTHER AUTHORIZING THE FLORIDA DEPARTMENT OF TRANSPORTATION TO RECORD A RIGHT-OF-WAY MAP OF THE SUBJECT ROAD IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DEEDS AND OTHER DOCUMENTATION NECESSARY TO TRANSFER OWNERSHIP TO FLORIDA DEPARTMENT OF TRANSPORTATION FOR ROADWAY PURPOSES. WHEREAS, the State of Florida Department of Transportation (FDOT) is finalizing plans for the construction of an access road to Watson Island from State Road No. A-1-A (MacArthur Causeway), in Dade County, Florida; and WHEREAS, it is necessary that certain lands on Watson Island, now owned by the City of Miami, be acquired by FDOT to enable the construction by FDOT of said access road and associated drainage and lighting improvements to serve Watson Island; and WHEREAS, in conformance with Section 337.29, Florida Statutes, a right-of-way map of the subject road, more accurately described on the attached legal descriptions, has been prepared and will be duly recorded in the Public Records of Dade County, Florida by the Florida Department of Transportation; =T COMMSION KEETING OF JAN 1 3 1998 Rawhifan No. 98- 23 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Portions of City -owned property on Watson Island, within the City of Miami, Florida, are hereby transferred to the jurisdiction of the State Highway System in conformance with Section 337.29, Florida Statutes. Section 3. The Florida Department of Transportation is hereby authorized to properly record a right-of-way map of the subject road in the Public Records of Dade County, Florida. Section 4. The City Manager is hereby authorized to execute all deeds and other documentation necessary to transfer ownership to the Florida Department of Transportation for roadway purposes. Section 5. BACKGROUND: The State of Florida Department of Transportation (F.D.O.T.) is finalizing plans for the construction of an access road to Watson Island from State Road No. A-1-A (MacArthur Causeway) in Dade County, Florida. In order for the F.D.O.T. to complete their construction documents, it is necessary that portions of Watson Island be transferred to the jurisdiction of the State Highway System so that the F.D.O.T. may assume reconstruction and maintenance responsibility of the improved roadway. The State has prepared the necessary right-of-way map of the subject areas to be transferred and will be responsible for all costs to construct the improvements.
