HomeMy WebLinkAboutR-98-0021J-97-827 12/29/97 RESOLUTION NO. 9 8 - 21 A RESOLUTION AUTHORIZING THE CONTINUED FUNDING OF PROTRACTED, COMPLEX INVESTIGATIONS, IN AN AMOUNT NOT TO EXCEED $300,000.00; ALLOCATING FUNDS THERFOR FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NOS. 69001, 69002, AND 690003, SUCH EXPENDITURES HAVING BEEN CERTIFIED BY THE CHIEF OF POLICE AS COMPLYING WITH FLORIDA STATE STATUTES, CHAPTER 932.7055, AS AMENDED, AND THE U.S. DEPARTMENT OF THE TREASURY'S "GUIDE TO EQUITABLE SHARING." WHEREAS, Florida State Statute 932.7055, as amended, and the Department of the Treasury's "Guide to Equitable Sharing" authorizes the expenditure of Law Enforcement Trust Fund monies to defray the costs of protracted and/or complex investigations and to provide law enforcement with additional technical equipment and expertise; and WHEREAS, the need exists within the Department of Police to conduct protracted and/or complex investigations which often require additional monies for such costs as overtime, the purchase/rental of equipment and supplies, payment of confidential informants, and other investigative support expenses; and WHEREAS, it is in the best interest of the community and the City of Miami to continue to fund these expenditures through monies generated as a result of seizures authorized under the Florida Contraband Forfeiture Act and the U. S. Department of Treasury's "Guide to Equitable Sharing"; and JAN 1 3 1998 $IlWIMAM ail+. WHEREAS, funds to cover these necessary and legitimate costs and expenditures have not been included in the Department of Police's normal operating budget; and WHEREAS, the Chief of Police has recommended adoption of this Resolution and has certified that the expenditures proposed comply with Florida State Statutes 932.7055, as amended, and the U.S. Department of Treasury's "Guide to Equitable Sharing"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The continued funding of protracted, complex investigations, in an amount not to exceed $300,000.00, is hereby authorized, with funds therefor hereby allocated from the City of Miami Law Enforcement Trust Fund, Project Nos. 690001, 690002, and 690003, such expenditures having been certified by the Chief of Police as complying with Florida State Statutes, Chapter 932.7055, as amended, and the U.S. Department of Treasury's "Guide to Equitable Sharing." Section 3. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 13th day of January , 1998. Rollason City Manager RECOMMENDATION: DATE : JAN - 5 i9,98 FILE: SUBJECT: Proposed Resolution REFERENCES: Protracted, Complex ENCLOSURES: Investigations It is respectfully recommended that a Resolution authorizing the continued funding of protracted, complex investigations, in an amount not to exceed $300,000.00, be approved. Funding is to be provided from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003 . 2 BACKGROUND: The Miami Police Department is currently involved in several protracted, complex investigations, as authorized under Florida Statute 932.704, of the Florida Contraband Forfeiture Fund and the U. S. Department of Treasury's "Guide to Equitable Sharing." The monies requested will be utilized to continue these comprehensive investigations outside of normal and established operations of the Miami Police Department. Funds are required for the payment of confidential informants, the provision of buy monies, the provision of consultant/expert services, and any other special investigative expenditures required for successful completion of these protracted, complex investigations, as authorized by the Chief of Police. 98- 21 1 AFFIDAVIT STATE OF FLORIDA, SS COUNTY OF DADE Before me this, day personally appeared Donald H.
