RESOLUTION NO. 9816
A RESOLUTION ACCEPTING THE FINDINGS OF THE
SELECTION COMMITTEE THAT CATERING BY DAVID
LYNN, INC., IS THE MOST QUALIFIED FIRM TO PROVIDE
CONCESSION SERVICES AT THE ORANGE BOWL STADIUM,
PURSUANT TO THE REQUEST FOR PROPOSALS ("RFP"), FOR
A PERIOD OF FIVE (5) YEARS, WITH THE OPTION TO
EXTEND FOR ONE (1) ADDITIONAL FIVE (5) YEAR PERIOD;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE AN AGREEMENT WITH SAID FIRM, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY AND ON SUCH
TERMS AS ARE ACCEPTABLE TO THE CITY COMMISSION.
WHEREAS, Requests for Proposals were mailed to 64 firms seeking a broad range of
responses from and to afford a competitive process for the provision of concession services to the
Orange Bowl Stadium; and
WHEREAS, the Selection Committee evaluated the one (1) proposal received from
Catering by David Lynn, Inc. and found it to be responsive, responsible and adequately revenue
producing in accordance with the stipulations of RFP 96-97-015;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.

Section 2. The City Commission hereby approves the findings of the Selection Committee
that Catering by David Lynn, Inc. is the most qualified firm to provide concession services at
the Orange Bowl Stadium, pursuant to the Request for Proposals ("UP"), for a period of five (5)
years, with the option to extend for one (1) additional five (5) year period.
Section 3. The City Manager is hereby authorized' to negotiate and execute an agreement,
on behalf of the City of Miami, with Catering by David Lynn, Inc. for the provision of
concession services at the Orange Bowl Stadium, in a form acceptable to the City Attorney and
on such terms as are approved by the City Commission. In the event that the City Manager or his
designee cannot negotiate an agreement which, in his opinion, is fair, competitive and reasonable
with the first -ranked firm, then he is hereby authorized to formally terminate such negotiations
and reissue the RFP.
Section 4. This Resolution shall become effective immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached Resolution approving
the findings of a Selection Committee and authorizing the City Manager to undertake negotiations
with this recommended firm and to execute a contract, in a form acceptable to the City Attorney, to
provide concession services at the Orange Bowl Stadium for a period of five years, with an option
to extend for one additional five-year period.
BACKGROUND:
RFP 96-97-015 was issued on Wednesday, November 12, 1997 seeking a qualified concessionaire
company to provide concession services for all events and activities at the Orange Bowl Stadium for
a period of five years, with an option to extend for an additional period of five years. The RFP was
distributed to 64 potential proposers.
One proposal was received from Catering by David Lynn, Inc., the current concessionaire for the
Orange Bowl Stadium. This proposal was evaluated by a Selection Committee and it was
determined to be responsive and responsible in accordance with the criteria outlined in
RFP 96-97-015.
Conferences, Conventions and Public Facilities recommends that the City Commission accept the
findings of the Selection Committee and authorize the City Manager to enter into negotiations with
Catering by David Lynn, Inc., and to execute a contract, in a form acceptable to the City Attorney,
to provide concession services to the Orange Bowl Stadium.

This memo serves to request your approval of the Selection Committee's recommendation that the
City Manager or his designee be authorized to negotiate a contract with Catering by David Lynn,
Inc. to provide concessions services to the Orange Bowl Stadium. RFP 96-97-015 was advertised,
and distributed to 64 vendors. A mandatory pre -proposal conference, including a tour of the Orange
Bowl, was attended by 15 prospective proposers. Catering by David Lynn, Inc. was the only vendor
to submit a proposal.
The Selection Committee met to evaluate the proposal based on the criteria defined in the RFP, and
found it to be responsive, responsible and adequately revenue producing in accordance with the
stipulations of RFP 96-97-015. The Selection Committee consisted of Christina P. Abrams,
Director, and Ileana Gomez, Asst. Stadium Manager of the Orange Bowl Stadium, representing
Public Facilities, Gerald Baron, Vice President of Globe Facility Services, and David Scott, Asst.
Athletic Director, University of Miami and Wayne Roberts, CFO/Asst. to the Athletic Director,
University of Miami and Chairperson of the Selection Committee.
We request your approval of the Selection Committee's recommendation and that this item be
forwarded to the City Commission for consideration at the next available Commission agenda.
