AN ORDINANCE AMENDING SECTION 14-52(c) OF THE CODE 'OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO ESTABLISH THE EXPIRATION DATE FOR TERMS OF OFFICE FOR MEMBERS OF THE BOARD OF DIRECTORS OF THE DOWNTOWN DEVELOPMENT AUTHORITY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR INCLUSION IN THE CITY CODE. WHEREAS, on September 9, 1997, the Miami City Commission adopted Ordinance No. 11538 amending the procedure for the appointment of members of the Board of Director of the Downtown Develop Authority ("DDA"), and providing for said members to serve staggered terms; and a WHEREAS, the proposed certain amendments to the procedure are required to implement the provisions related to staggered terms; and WHEREAS, the Board of Directors of the DDA wishes to establish August 31 as the expiration date for the term of office of each board member in order that subsequent board members will serve from September 1 to August 31; and WHEREAS, the proposed amendments will provide uniformity in the term of office of board members and will better serve the 11734 • Ll needs of the DDA district; and WHEREAS, Chapter 14, Article II, of the Code of the City of Miami, Florida, as amended (the "Code"), governs the constitution and operations of the DDA; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are, hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 14-52. of the Code of the City of Miami, Florida, as amended, is hereby amended as follows:1/ "Sec. 14-52. Downtown development authority board -- Composition; appointment and terms of office of members and executive board; filling of vacancies. (c) Within 120 days from the effective date hereof, the board of directors of the authority, the city commission, the board of county commissioners of M amp -Dade County and the cabinet of the state shall make their respective. nominations for the board of directors of the authority. The 12 members nominated by the board of directors and confirmed by the city commission shall participate in a lottery, to be conducted by the board of directors, or such other procedure as may be agreeable to the board, to determine the term of their offices, it being the intent of this section that four of the initial 12 members shall serve one-year, until August 31, 1999, four shall serve two years, until August 31, 2000, and four shall serve three years, until August 31, 2000. Background The Downtown Development Authority Board of Directors appointed a by-laws committee to evaluate the composition, membership qualifications, rules of procedure and other matters concerning the DDA. In September 1997 the Miami City Commission passed Ordinance No. 11538 amending the composition, qualifications, appointment procedure and term of office of said board. The members of the DDA Board of Directors are to serve staggered terms under the Ordinance. The Board of Directors of the DDA wishes to establish August 31 as the expiration date of the expiration date of the term of office of each Board member in order that subsequent Board members will serve from September 1 to August 31 The changes being recommended require that the Miami City Code be amended by Ordinance adopted by the Commission of the City of Miami. Their successors will serve from September 1 through August 31. Section 2. The Commission of the City of Miami is hereby requested to adopt an ordinance establishing the expiration date of the term of office of the members of the Board of Directors of the Downtown Development Authority, as follows: 64Sec.14-52.
