HomeMy WebLinkAboutO-1173341 J-98-1192 12/8/98 ORDINANCE NO. 11733 AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND, ENTITLED: "LOCAL LAW ENFORCEMENT BLOCK GRANT III PROGRAM", AND APPROPRIATING FUNDS FOR THE OPERATION OF SAME, IN THE AMOUNT OF $3,937,993.00, CONSISTING OF A GRANT FROM THE U.S. DEPARTMENT OF JUSTICE, IN THE AMOUNT OF $3,544,194.00, PLUS INTEREST, AND REQUIRED MATCHING FUNDS FROM THE CITY, IN THE AMOUNT OF $393,799.00; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS PURPOSE; FURTHER AUTHORIZING THE ALLOCATION OF MATCHING FUNDS, IN THE AMOUNT OF $393,799.00, FROM THE POLICE. DEPARTMENT GENERAL OPERATING BUDGET, ACCOUNT CODE NO. 001000.290301.6.050; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City of Miami ("City") has a commitment to reduce crime, improve public safety, and expand its crime prevention programs; and WHEREAS, the City applied for, and received, a grant in the amount of $3,544,194.00, plus accrued interest, from the United States Department of Justice, Local Enforcement Block Grant Program which can be used for said purposes; and WHEREAS, matching funds are required from the City, in the amount of $393,799.00, as a condition of accepting said grant; and WHEREAS, all purchases expending grant funds shall comply with applicable City Code purchase requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: LOCAL LAW ENFORCEMENT BLOCK GRANT III PROGRAM RESOURCES: U.S. Department of Justice $ 3,544,194.00 Police Department General Operating Budget (matching funds) 393,799.00 APPROPRIATIONS: Local Law Enforcement Block Grant III Program $ 3,937,993.00 Section 3. The City Manager is hereby authorizedll to accept said grant as set forth in the Preamble to this Ordinance and to execute the necessary documents, in a form acceptable to the City Attorney, for this purpose. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 11733 9 . 0 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative -vote of not less than four -fifths of the members of the Commission. Section 8. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor2-/. Warshaw REFERENCES: Local Law Enforcement City Manager Block Grant III Program ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance which establishes initial resources and initial appropriations entitled: "Local Law Enforcement Block Grant III Program" accepting a grant from the U.S. Department of Justice, in the amount of $3,544,194 and allocating a required cash match in the amount of $393,799, from the Police Department General Operating Budget, Account Code No. 001000.290301.6.050. BACKGROUND The Local Law Enforcement Block Grant Program is administered by the U.S. Department of Justice, Bureau of Justice Assistance (BJA). The Miami Police Department is eligible for $3,544,194 in funding during fiscal year 1998-99. The City of Miami is required to provide a cash match in the amount of $393,799. These funds were not budgeted for, however, it was determined that the Police Department General Operating Budget could support the required match. The purpose of this grant is to fund local governments to underwrite projects to reduce crime, improve public safety, and start or expand crime prevention programs. Application requirements include a non -binding review by an Advisory Board that has already been done. Also required is a public hearing regarding the proposed use of said funds. This Ordinance is hereby declared to be an emergency measure on the basis that the City of Miami has declared a financial emergency exists and the use of these funds are to aid in reducing crime, improving public safety, and expanding crime prevention programs. A final report on the programmatic activities is due 120 days following the end of the grant period. 7. The recipientagrees to submit quarterly financial reports. The financial report is due 45 days after the end of each calendar quarter. A final financial report is due 120 days following the end of the grant period. 8. The recipient agrees to establish a trust fund in which all payments received under this Program, including match, must be deposited. For the purposes of this grant, a trust fund is an interest bearing account that is specifically designated for this Program. Only allowable program expenses can be paid from this account. This fund may not be used to pay debts incurred by other activities beyond the scope of the Local Law Enforcement Block Grants Program. The recipient also agrees to obligate and expend the grant funds in the trust fund (including match and interest earned) during the 24 month term of the award. Grant funds (including earned interest) not obligated by the 24th month must be returned to BJA by the last day of the 27th month. The recipient agrees to supplement and not supplant state or local funds. 10. The recipient acknowledges that failure to submit an acceptable Equal Employment Opportunity Plan (if recipient is required to submit one pursuant to 28 CFR section 42.302), that is approved by the Office for Civil Rights, is a violation of its Certified Assurances and may result in funds from the award being frozen, until such time as the recipient is in compliance. 11. The recipient agrees, if the funds are used for the hiring and employing of new, additional law enforcement officers and support personnel, as described in the applicable purpose area of Subpart A section 101 (a)(2), that the recipient unit of local government will achieve a net gain in the number of law enforcement officers who perform nonadministrative public safety service. The recipient agrees, if the funds are used for the hiring and employing of new, additional law enforcement officers and support personnel, that the units of local government will establish procedures to give members of the Armed Forces who, on or after October 1, 1990, were or are selected for involuntary. separation (as described in section 1141 of Title 10, United States Code), approved for separation under section 1174a or 1175 of such title, or retired pursuant to the authority provided under section 4403 of the Defense Conversion, Reinvestment,. and Transition Assistance Act of 1992 (division D of Public Law 102-484; 10 U.S.C. 1923 note), a suitable preference in the employment of persons as additional law enforcement officers or support personnel. 13. The recipient agrees if funds are used for enhancing security or crime prevention, that the unit of local government -- (a) has an adequate process to assess the impact of any enhancement of a school security measure that is undertaken under subparagraph (B) of section 101(a)(2), or any crime prevention programs that are. established under subparagraphs (C) and (E) of section 101(a)(2), on the incidence of crime in the geographic area where the enhancement is undertaken or the program is established; (b) will conduct such an assessment with respect to each such enhancement or program; and .(c) will submit to the Bureau of Justice Assistance an annual written assessment report. 14. The recipient agrees that prior to the obligation and expenditure of any Local Law Enforcement Block Grants (LLEBG) funds, at least one (1) public hearing will be held regarding the proposed use(s) of the grant funds. The recipientwillprovide to BJA, through the submission of the Follow -Up Information Form, information on the contents of the hearing. BJA will review the form for compliance with enabling legislation and issue to the recipient a Grant Adjustment Notice (GAN). Until the issuance of the GAN, the recipient may not obligate or expend LLEBG funds. At that hearing, persons shall be given an opportunity to provide written and oral views to the recipient on the proposed use(s) of the grant funds. The recipient will hold the public hearing at a time and place that allows and encourages public attendance and participation. The recipient agrees that prior to the obligation or expenditure of any Local Law Enforcement Block Grants (LLEBG) funds, a designated or newly established advisory board will meet to discuss the proposed (purpose area) use of the grant funds. The recipient will designate the advisory board to make nonbinding recommendations to the recipient to the use of funds under the LLEBG Program. Membership on the advisory board must include a representative from the following, however it may be broader: a) the local police department or sheriffs department; b) the local prosecutor's office; c) the local court system,- d) the local school system; and e) a local nonprofit, educational, religous, or community group active in crime prevention or drug use prevention or treatment. The advisory board must review the proposed use of the funds under the LLEBG Program. . The recipient will provide notification to BJA, through the submission of the Follow -Up Information Form, on the advisory board. BJA will review the form for compliance with enabling legislation and issue to the recipient a Grant Adjustment Notice (GAN). Until the issuance of the GAN, the recipient may not obligate or expend LLEBG funds. 16. The recipient has certified it is not in compliance with Public Safety Officers Health Benefits Provision (section 615 of the FY 1998 Omnibus Appropriations Act). Therefore, the recipient will receive not more than 90 percent of the eligible award amount (or, if less than the eligible amount was requested, of that amount). The provision makes no allowances for a unit of local government to come into compliance during the life of the award, consequently BJA will not consider request to adjust the funded award amount. 17. Criminal Intelligence Systems operating with support of Federal funds, must comply with 28 CFR, Part 23, if the recipient chooses to implement this project.
