ORDINANCE NO. 11732
AN ORDINANCE AMENDING ORDINANCE 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, BY AMENDING ARTICLE 6, SECTION 604,
SD-4 INDUSTRIAL DISTRICT, TO PERMIT GENERAL
OFFICE. USE IN EXISTING OFFICE STRUCTURES;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of July 29, 1998, Item No. 3, following an advertised hearing,
adopted Resolution No. PAB 58-98 by a vote of five to zero (5-0),
Recommending Approval of amending Zoning Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section
Section 2. Ordinance No. 11000, as amended, the Zoning

Ordinance of the City of Miami, Florida, is hereby amended by
amending the text of said Ordinance as follows:1'
"ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS
Sec. 604.1. Intent
This district designation is intended for
application in areas appropriately located for marine
activities, including industrial operations and major
movements of passengers and commodities. In view.of the
importance of such activities, it is intended to limit
principal and accessory uses to those reasonably.
requiring location within such districts, and not to
permit residential, general commercial, service, office
or manufacturing uses not primarily related to
waterfront activities except for office uses in

Section 604.4. Principal uses and structures.
Section 604.4.2. Conditional principal uses and
structures.
2. Except as permitted generally above, or permitted
generally. as accessory uses and structures, offices, living
quarters, commercial or service establishments, manufacturing,
processing and other uses shall be permitted only by Class I
Special Permit and only upon findings by the Zoning Administrator
that, the use, as proposed, is primarily related to waterfront
activities, for which the district is reserved, and reasonably
requires location within the district, except that by a Class I

Section 3. All ordinances or parts of ordinances insofar

as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,. the
remaining provisions of this Ordinance shall not be affected.
Section 5. :This Ordinance shall become effective thirty
(30) days after final reading and adoption thereofa/.

by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.

ANALYSIS FOR SD-4 WATERFRONT INDUSTRIAL
DISTRICT
CASE NO. 98-034
The proposed amendment to Article 6, Section 604 of Zoning
Ordinance 11000, as amended, shall allow for existing office structures to
retain office uses within the SD-4 Waterfront Industrial District.
The requested amendment would. specifically allow for an existing
office structure which has lost its legal non conforming status to resume an
office use by Class I Special Permit.
The Department of Planning and Development recommends approval
of the proposed amendment to Article 6, Section 604 of the Zoning
Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami.
