AN ORDINANCE AMENDING CHAPTERS 2, AND 18 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY ENACTING AN ANTI -DEFICIENCY ACT TO SET FORTH REGULATIONS TO ENSURE THAT DEPARTMENTS AND DEPARTMENT DIRECTORS. WITH AUTHORITY TO DIRECT OBLIGATION OR DISBURSEMENT OF CITY FUNDS DO NOT EXPEND FUNDS DURING A FISCAL YEAR IN EXCESS OF THOSE WHICH HAVE BEEN APPROVED IN A DULY ADOPTED BUDGET; MORE PARTICULARLY BY ADDING NEW SECTIONS 2-467, 2-947.1, AND 18-72.1, 2-1145, 2-1146, 2-1147, AND 2-1148; AND BY AMENDING SECTIONS 2-466, AND 2-497; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission seeks to ensure that city department directors with authority to direct obligation or disbursement of city funds, including the City Clerk, City Attorney and the Mayor and Commissioners, do not spend sums in excess of those provided for in a duly adopted budget; and WHEREAS, Section 2-497 of the City Code provides for budget appropriations, monitoring, expenditure control and forecasting 11727 of fiscal operations for all departments and funds of the City; and WHEREAS, the City Commission wishes to provide direction to be followed by department directors with authority to direct obligation or disbursement of city funds related to expenditures which will exceed an annual departmental appropriation and where authority has not been increased through budget amendments or extended or renewed to provide temporary obligational authority, by resolution of the City Commission which specifically directs the allocation, and identifies a source of funds to increase the obligation/expenditure authority; and WHEREAS, temporary obligational authority related to expenditures which exceed annual departmental appropriation may be authorized when an emergency, as defined by Florida law, occurs and said authority shall require ratification, approval and confirmation by a majority affirmative vote of the members of the City Commission at the next City Commission regular or special meeting called for such purpose; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this - 2 - 11727 Section. Section 2. Chapters 2 and 18 of the Code of the City of Miami, Florida, as amended, are hereby' -amended in the following particulars:/ "Chapter 2 Administration ARTICLE IV. Departments Division 11. FINANCE DEPARTMENT Sec. 2-466. Director as disbursing officer. The director of finance is hereby declared to be the disbursing officer in the paying of salaries or� compensation to all employees 'of the city, and in addition to his/bpr i c he/-qhe shall arrange for the payment of salaries and compensation to all employees of the city through the department of finance, in accordance with the provisions of.the Charter. MANAGEMENT AND BUDGET DEPARTMENT Sec. 2-497. Same --Budget management section. Subject to the supervision and control of the director of the management and budget department, the assistant department director in charge of budget services shall provide the services of a budget office, which shall include the formulation, preparation and evaluation of the city budget; the provision of budgetary control through constant monitoring of current fiscal operations, and the forecasting of future fiscal operations for all funds; and the functions which shall include: expenditure control of the financial management information system; citywide - 4 - 11727 position control; monitoring all legislation authorizing appropriations through its verification of the availability of funds; undertaking special fiscal management studies as requested by the mayor, city commission and/or by the.city manager;..written analysis of the budgetary i=ac,r of all proposed legislation prior to ronsidenition by the city commission; providing through the city man --Pr to the c-it.y rnmmic�;on a written budget impact analysis for all °pocketil agenda i- ms; and performing such allied duties and functions as the department ..director may specify. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Punctuation corrections have not been noted in this memo. The procedures and implementation changes as noted in § 2-1147(g) were discussed at length at the workshop. The language which requires concurrence of the member of the City Commission designated as the presiding officer in order for fourth quarter line item changes to be made by the City Manager, grants the authority to one commission member to make a decision without action by the entire Commission. Nowhere in the City Charter or Code does such. authority exist other than in the calling of a special meeting. See.2-1146. Definitions. As used in this article: Authority to direct obligation or disbursement shall mean any permission, approval, consent, or signature from a department director or an a single individual, specifically designated in writing by a department director and acknowledged and accepted in writing by the designee. and kept on file within the department, regardless of form, which permits or authorizes expenditure of funds, excluding documents or forms which process such authority. Department directors shall mean directors of all departments of the city including heads of offices, beards,- and shall include persons responsible for individual budgets as set forth in the annual appropriations ordinance. Notwithstanding any delegation of authority for the act of . budget oversight, heads of departments or offices shall not be relieved of responsibility related to this act. Sec. 2-1147. Procedures and implementation. (8) A department director with obligation or disbursement authority shall be in violation of this Act if he/she willfully withholds invoices, payments, settlement, or any other instrument of city debt which 11'72"7 Honorable Mayor and Memb�eof the CityCommission ®N v ember 6, 1998 Modifications to Anti -Deficiency Ordinance Page 2 were incurred and due in the current fiscal year in an effort to avoid exceeding the approved current year budget. (9) The city manager shall have the authority to adjust line items in an amount not to exceed ten percent (10%) of a department's budget so long as the total annual projected expenditures of a department do not exceed the department's current budget, and said adjustment is verified by the department of management and budget. Additionally, all extal proposed budget adjustments between departments, including capital improvements projects, and shall require approval bythe city commission resolution. Dtifing a eued-b . During the fourth quarter of the fiscal year, M changes or deviations from the current approved budget for those departments under the authority of the city manager shall require city manager approval, with the advice and written concurrence of the member of the city commission designated as the presiding officer, a copy of which shall be provided to the city clerk.
