ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE II,
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "MAYOR AND CITY
COMMISSION", BY AMENDING SECTION 2-33(e)
CONCERNING POCKET ITEMS, TO PROVIDE THAT
LEGISLATION ASSOCIATED WITH SUCH ITEMS BE
PRESENTED AND REVIEWED BY THE CITY MANAGER
AND CITY ATTORNEY IN ADVANCE OF THE MEETING
AT WHICH THE ITEM WILL BE PRESENTED;
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Chapter 2, Article II, Section 2-33(e), of
the Code of the City of Miami, Florida, as amended, is hereby
amended as follows:l'
"CHAPTER 2
ARTICLE II. MAYOR AND CITY COMMISSION
Sec. 2-33. Order of business and rules of
procedure.
1' Words and/or figures stricken through shall be deleted. Underscored
words and/or figures shall be added. the remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

(e) A copy of each resolution and ordinance shall
be furnished the members of the city commission five
days before meeting, to enable the heads of the
departments affected to prepare necessary memoranda,
data or reports. In the event a copy of each resolution
or ordinance is not furnished within the required five
days, the proposed resolution or ordinance may be heard
by the city commission provided that the city
commission unanimously deems such resolution or
ordinance to be of an emergency nature. The number of
nonscheduled ("pocket") items is limited to one that
each commissioner and the mayor may introduce and two
that the city manager may introduce for consideration
by the city commission at any city commission meeting,
unless the city commission waives said limitation by a
four -fifths vote of its members -an provided
written rnpy of the item is provided to the mayor and
each member of the city conimission prior to the
pracani-at-i on of the item- The conclusion of the
regular scheduled agenda, or at 8:00 p.m., whichever
occurs first, is designated as the time that such
nonscheduled items shall be introduced. Any non-
scheduled item which has a fiscal impact upon the city
shall be reviewed by the city manager, who shall make a
written recommendation to the city commission prior to
consideration of the items by the commission.

Section 2. All ordinances or parts of ordinances insofar

clause, phrase or word of this Ordinance is declared invalid, the

remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof2l.

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.

RE: Code Amendment - Pock this
As a result of the discussions among those who participated in the Charter Review
Work Group, the attached code amendment was drafted.
It states that any legislation (ordinances or resolutions) related to a pocket item
must be reviewed by the City Manager and City Attorney at least four days before the
meeting where it is to be presented or the item can not be considered by the commission.
The city commission can waive this rule by a unanimous vote. A provision is also added
which provides that the city commissioners and the mayor must have received the item
prior to the commission considering it.
