AN ORDINANCE AMENDING CHAPTER 2, ARTICLE IV, DIVISION 2, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION, DEPARTMENTS, PLANNING, BUILDING AND ZONING DEPARTMENT", TO ESTABLISH INSPECTION AND SERVICE FEES FOR TRANSFERS OR CHANGES OF NAMES FOR CERTIFICATES OF USE; MORE PARTICULARLY BY AMENDING SECTION 2-207(a); CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, every business located in the City of Miami, Florida ("City"), is required to have a valid Certificate of Use issued by the Department of Building and Zoning ("Department"); and WHEREAS, from time to time the name or ownership of a business may change but the actual commercial enterprise will remain the same; and WHEREAS, the Code of the City of Miami, Florida, as amended, is silent as to whether the business in the hereinabove situation shall be required to obtain a new Certificate of Use and pay a fee associated therewith; and WHEREAS, in many cases a change of name is`actually a change in use and the Department has therefore determined that it is necessary to inspect the business that is requesting said name 11721 C� change or request for transfer of the Certificate of Use; and WHEREAS, the Department may charge a reasonable fee for the inspections of said businesses; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 2, Article IV, Division 2, of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:/ "Chapter 2 ADMINISTRATION * * * Article IV. DEPARTMENTS * * * DIVISION 2. Planning, Building And Zoning Department * * * Sec. 2-207. Zoning certificate of use required; annual reinspection of buildings and premises; fees for inspections and issuance of certificates. (a) Inspection and service fees for certificate of use. All persons applying for a certificate of use for the use of vacant or improved land or for a change of use of the land or for a change in the use of an existing building shall pay the following inspection and service fees: 1' Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. the remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. - 2 - 11721 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Warshaw Commission Meeting of City Manager ENCLosuREs: September 8, 1998 Recommendation It is respectfully recommended that the City Commission adopt the attached ordinance amending Chapter 2 of the City Code Section 2-207 to provide new fees of $250 for a change of name and transfer of certificate of use when there is no corresponding change in use. Background The City Code provides that upon payment of a $25 transfer fee the occupational license can be reissued in a new business name; however, there is no provision in the City Code relative to a transfer fee or name change for a certificate of use. City Code Section 2-207(b)(1) requires that "[n]o new buildings or premises and/or part thereof and no existing building or premises when there has been a change of use in said building or premises... shall be occupied until a zoning certificate of use shall have been issued by the ...building and zoning department." City Code Section 2-207(b)(3) states that "fa]nnual inspections will be conducted to determine that each building and/or premises complies with the regulations established in the city zoning ordinance, building code, fire code, health regulations, and such other regulations that may apply to the particular building or premises." The fee for the initial inspection and certificate of use is significantly higher than the fee for a renewal of the certificate of use. The basis for charging a fee is, among other things, to cover the cost of the inspection of the premises for code compliance. The City Code is silent, regarding situations where solely a change of name has occurred. Neither is there a provision that relates to the transfer of a certificate of use to a different business entity. 11 • Therefore, and in accordance with the City Attorney's office recommendation to implement a policy vis-a-vis the transfer of a certificate of use, _it is recommended that the City Commission adopt this ordinance establishing a policy to provide a new fee of $250 for a change in name and a transfer of certificate of use when there is no corresponding change in use. (e.g. Barnett Bank to Nationsbank) In the event of a change of use, a new certificate of use will be required when there has been a change in the name of the business or entity occupying space therein. FLOR DA INTER -OFFICE MEMORANDUM RED _ AL:-NCES : November 6,1998 Impact on Certificate of Use Funds, Pursuant to the proposed Ordinance to amend Chapter 2, of the City Code Section 2- 2073 to provide a revised fee of $250.00 for a change of name and transfer of a certificate of use when there is no corresponding change iri use, and the fiscal impact on our certificate of use monies; please be advised of the following. In order to project the fiscal impact that this ordinance %ku have on Certificates of Use revenue collection, we reviewed FV 97-98 Certificate of Use collection and concentrated or, all of the accounts that paid an amount greater than $250.00. The total amount for certificates of use that superseded the base payment of $250.00 is $x86.181.85. The percent of these certificates of use that are a change of name and that does not involve a change of use are traditionally 50%, of the certificates of use applied for each year. Therefore, the reduction to our certificate of use revenue fund will be $93,090.92. This figure was analyzed by the Department of Budget and they informed us that since actuals Certificate of Use revenues collected exceeded budgeted amount a $93,090.92 reduction would still allow the department to meet the projected revenue. Presently the rninmum charged is $250 per request up to 2,000 square feet- Beyond 2,000 square feat entities are charged extra ($5011000 square feet). This extra charge would be eliminated for those requesting a name change only. A request for change of use, with or without a name change will continue to be charged the $250 for the first 2,000 square feet and the regular extra charge. A computer report was produced by IT which identified the number of CU's issued and the amount charged for each. Using this report the B&Z Department determined that $186,181.85 was paid over the $250 minimum charge. Out of this amount the B&Z Department estimated that half of them were for name change only.
