AN ORDINANCE AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS, TO ESTABLISH THE CULTURAL AND FINE ARTS BOARD; SET FORTH SAID BOARD'S PURPOSE, POWERS, AND DUTIES; PROVIDE FOR TERMS OF OFFICE, OFFICERS, MEETINGS; QUORUMS, REQUIREMENTS ' ._FOR MEMBERSHIP, ATTENDANCE, AND FILLING OF VACANCIES AND TO PROVIDE FOR THE "SUNSET" REVIEW OF SAID BOARD EVERY FOUR YEARS; MORE PARTICULARLY BY ADDING NEW DIVISION 9, CONSISTING OF SECTIONS 2-1140 THROUGH 2-1143, AND AMENDING SECTION 2-892 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission wishes to establish a Cultural and Fine Arts Board to enhance art and culture in the City of Miami and to communicate with other municipalities within and throughout Miami -Dade County concerning similar cultural goals; and WHEREAS, because numerous groups have expressed a desire to donate or sell artworks to the City of Miami, the City Commission wishes to have advice from individuals who evaluate the appropriateness of design, location, and costs of such 11716 acquisitions; and WHEREAS, the provisions of City Code -Section 2-833 require that all City boards be created by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The, recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 2/Article XI/Section 2-892, entitled °ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS/"Sunset" review of boards.", is hereby amended in the following particulars:/ "Chapter 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS DIVISION 1. GENERALLY Sec. 2-892. "Sunset" review of boards. Commencing with the year 1995, each city board shall be reviewed in the following manner: Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. - 2 - 11716 (4) The following boards shall initially be reviewed in the following years and shall be reviewed every four years thereafter: d. 1998: 9_ Cultural and Fin- Arts oard_" Section 3. Chapter 2/Article XI, entitled "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS, is hereby amended by adding new Division 9, consisting of Sections 2-1140 through 2-1143, to the Code of the City of Miami, Florida, as amended, in the following particulars:' "Chapter 2 ADMINISTRATION ARTICLE XI. All ordinances or parts of ordinances or resolutions insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.a/ PASSED ON FIRST READING BY TITLE ONLY this 28th day of September , 1998.
