ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 54/ARTICLE IX
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "STREETS AND
SIDEWALKS/COCONUT GROVE SPECIAL EVENTS
DISTRICT", TO PROVIDE THAT THE CITY
COMMISSIONER APPOINTED AS THE EX OFFICIO
NONVOTING MEMBER OF THE COCONUT GROVE
STANDING FESTIVAL COMMITTEE MAY BE DESIGNATED
BY THE CITY COMMISSION AS THE CHAIRPERSON OF
SAID COMMITTEE; MORE PARTICULARLY BY AMENDING
SECTION 54-342 (c) OF SAID CODE; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, Ordinance No. 10764, adopted by the City Commission
on July 12, 1990, established a Coconut Grove Special Events
District and a Coconut, Grove Standing Festival Committee (the
"Committee") to serve as an instrument of advice and
recommendation to the City Commission on the expenditure of the
monies deposited into the Coconut Grove Special Events District
Fund; and
WHEREAS, it is necessary to amend Article IX,.
Chapter 54, Section 54-342(c), to provide that the City
Commissioner appointed as the ex officio nonvoting member of said
Committee may be designated by the City Commission as the
chairperson;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 54, Article IX, Section 54-342(c), of
the Code of the City of Miami, Florida, as amended, is hereby
amended in the following particulars:1'

STREETS AND SIDEWALKS

ARTICLE IX. COCONUT GROVE SPECIAL EVENTS DISTRICT
Sec. 54-342. Coconut Grove standing festival
committee.
* * *
(c) Composition; organization; terms of members;
officers. The committee shall consist of five members.
Each member of the committee shall reside, own real
property or have his principal place of business in the
Coconut Grove area of the city and shall be an
individual of outstanding reputation for integrity,
responsibility and commitment to serving the community.
One city commissioner may be an ex officio nonvoting
member of the committee and may be designated by the
city commission as the committee's chairperson. Each
member of the city commission shall appoint one member
to the committee. The terms of office of the membership
of the committee shall be of one year or until the

appointing commissioner leaves office, whichever occurs
first.
Any person appointed to fill a vacancy due to the
death, resignation or removal of any member of the
committee shall serve only for the unexpired term.
If the chairperson i s not the appointee designated by
the city comaiission, T.the committee shall select a
chairperson from among its members and may create and
fill such other offices as it may determine.
The director of the community development department
shall be the executive secretary of the committee.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21
PASSED ON FIRST READING BY TITLE ONLY this 8th day
Z/ This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein,,_,whichever is later.

ENCLOSURES: Ordinance
The Coconut Grove Standing Festival Committee was created to make recommendations to the
City Commission concerning the expenditure of the Coconut Grove Special Events District Fund.
Since -May 7, 1997, Commissioner Regalado has been appointed by the Commission as
chairperson of said committee, but the ordinance which created the committee provided for a
Commissioner to sit as ex-officio nonvoting member. The attached proposed ordinance provides
that a City Commissioner may be designated by the Commission as the committee's nonvoting
chairperson.
By copy of this memorandum to the Agenda Office, we are requesting that this issue be placed on
the September 8, 1998 agenda for Commission consideration.

FLORIDA, AS AMENDED, ENTITLED:. "ADMINISTRATION /
BOARDS, COMMITTEES, COMMISSIONS / MIAMI SPORTS
AND EXHIBITIONAUTHORITY,° TO (1) ALLOW FOR EACH
MEMBER OF THE CITY COMMISSION TO SERVE ON THE
MIAMI SPORTS. -AND EXHIBITION AUTHORITY ("MSEA")
FOR A PERIOD _ OD -ONE :(1). YEAR, (2) DELETE` i
REQUIREMENT THAT THE APPOINTED COMMISSIONER
BE PRESIDING OFFICER OF -THE CITY COMMISSION,
AND (3) DESIGNATE THAT THE MEMBERS APPOINTED
TO THE MSEA SHALL SERVE.FOR A TERM OF NOT LESS
