AN ORDINANCE ABOLISHING THE TAX-EXEMPT PROPERTY STEERING COMMITTEE AND REVOKING ALL OF SAID COMMITTEE'S POWERS, DUTIES, PRIVILEGES AND FUNCTIONS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, pursuant to City Code provision, the City Commission may abolish existing boards if it is determined that the board is not serving the purpose for which it was created; and WHEREAS, it is the decision of the City Commission to abolish the Tax -Exempt Property Steering Committee established by Resolution No. 93-285, on May 13, 1993, and amended by Resolution Nos. 94-183, 94-363, 94-761 and 96-522, and by Ordinance Nos. 11130 and 11154; NOW, THEREFORE,.BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference 11710 thereto and incorporated herein as if fully set forth in this Section. Section 2. The Tax -Exempt Property Steering Committee of the City of Miami is hereby abolished and all powers, duties, privileges and functions of the Tax -Exempt Property Steering Committee are hereby revoked. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.1/ PASSED ON FIRST READING BY TITLE ONLY this 8th day of September, 1998. FOEMAN CITY CLERK i APPROV S F 3:CHA:BSS CORRECTNESS : (146- - 3 - 1.1710, Honorable Members of TO the City Commission F Walte eman City Clerk CITY OF MIAMI, FLORIDA7 INTER -OFFICE MEMORANDUM August 14, 1998 DATE: FILE: SUBJECT: Abolishment of the Tax -Exempt Property Steering Committee REFERENCES: ENCLOSURES: September 8, 1998 Agenda Ordinance The Tax -Exempt Property Steering Committee was created to monitor the level of tax-exempt property within the City and the fiscal import of said property to the City,'s tax base and to recommend procedures to the Commission for monitoring such uses and actively engage in negotiations leading to reasonable property tax reimbursement for tax revenues lost from existing tax-exempt institutions in the City, as well as actively pursuing PILOT program participation by tax-exempt institutions seeking to build up, expand, or significantly alter its holdings in the City. The commission was to issue general guidelines to be followed in negotiating voluntary agreements for payment in lieu of taxes, and was to be responsible for making a recommendation by a majority vote of the membership, to the City Manager on all such agreements. It was to monitor the progress of all PILOT Agreements and provide the Commission with an annual report on tax-exempt properties, and was to work with the City Manager, the City's lobbyists, the Miami - Dade County Legislative Delegation, and such other organizations as may be necessary to effectuate legislation necessary to reduce the negative effect on the City's tax base that tax-exempt uses cause. During the Commission meeting of March 10, 1998, Commissioner Plummer, as chairperson of the Tax -Exempt Property Steering Committee, recommended to the City Commission to have said committee abolished and directed the City Attorney to prepare appropriate legislation to do same. It is now appropriate for the Commission to consider adoption of the attached ordinance on first reading, abolishing the committee. By copy of this memorandum, we are requesting the Agenda Office to schedule this issue on the September 8, 1998 Commission agenda.
