ORDINANCE NO. j
AN ORDINANCE AMENDING SECTION 18-78, OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED RELATING TO
CONTRACTING METHODS AND PROCEDURES, THEREBY
STIPULATING THAT ANY PURCHASE AGREEMENT ENTERED INTO
IN A MANNER INCONSISTENT WITH PROCEDURES, AS HEREIN
SPECIFIED, SHALL NOT BE BINDING UPON THE CITY; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY CLAUSE;
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Section 18-78 of the Code of the City of Miami, Florida, as amended, is
hereby amended as follows:!/
" Sec. 18-78. Contracting methods and procedures.
(a) All purchases of goods, including but not limited to supplies,
materials, equipment, printed materials and all purchases of services, including but
not limited to personal, professional, management and technical services needed by
the city, but not including legal services, shall be made exclusively in the manner set
forth in this article. Any agreement for purchase entered into in any manner
inconsistent with the procedures stated in this article by any person shall not bind
the city. The provisions of this article relating to public notice and competitive
methods and procedures shall constitute the rules and regulations called for by
sections 3(f), 28 and 29-A of the Charter.
Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in
conflict with the provisions of this Ordinance are hereby repealed.

Section 3. If any section, part of section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.

city. The city has agreed to change cited section of the City Code to include this caveat as a result of
the external audit performed by KPMG Peat Marwick.
