HomeMy WebLinkAboutO-11680J-98-691 6/30/98 ORDINANCE NO. 11680 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 11463, ADOPTED MARCH 20, 1997, WHICH ESTABLISHED INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED "LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM", TO: (1) CORRECT AN OMISSION BY REFLECTING THE APPROPRIATION OF MATCHING FUNDS, IN AN AMOUNT OF $337,093.00 FROM THE POLICE DEPARTMENT GENERAL OPERATING BUDGET, AS APPROVED PURSUANT TO SAID, ORDINANCE; AND (2) INCREASE THE DEPARTMENT OF JUSTICE GRANT MONIES RECEIVED, IN THE AMOUNT OF $79,616.00, AS A RESULT OF ACCRUED INTEREST EARNINGS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Ordinance No 11463, adopted March 20, 1997, a Special Revenue Fund, entitled "Local Law Enforcement Block Grant Program" was established and funds were appropriated to said Fund consisting of a grant from the U.S. Department of Justice, in the amount of $3,033,834.00, and matching funds from the Police Department General Operating Budget, in the amount of $337,093.00, for a total appropriated amount of $3,370,927.00; and WHEREAS, the matching funds from the Police Department General Operating Budget, in the amount of $337,093.00, were omitted from Section 2 of Ordinance No. 11463; and WHEREAS, the grant from the Department of Justice has earned 11680 interest totaling $79,616.00, which must now be appropriated; and WHEREAS, any purchases for the expenditure of these funds will comply with applicable City Code procurement procedures; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY. OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11463, adopted March 20, 1997, is hereby amended in the following particulars:l/ "FUND TITLE: LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM RESOURCES U.S. Department of Justice e�n»n�n nn $,11104sQ_00 Paliop nepartment General Operating Budget �37, (]9� _ On APPROPRIATIONS: Necessary expenses for the operation of the Local Law Enforcement Block Grant Program $3,933,834 $1,4S0,R41_On" Section 3. The City Manager is hereby authorized to accept interest earned from said grant and to enter into the necessary contract(s) and/or agreements(s), in a form acceptable 1/ Words and/or figures stricken through shall be deleted. The remaining provisions are now in effect and remain unchanged. - 2 - 11680 to the City Attorney2./, for acceptance of the aforesaid monies for the operation of said Program. Section 4. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause,. phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. BACKGROUND The Department of Police received a Local Law Enforcement Block Grant administered by the U.S. Department of Justice, Bureau of Justice Assistance (BJA), for a total of $3,033,834.00. This grant. accrued interest totaling $79,616.00 which is available to be expended but requires appropriation. This Ordinance is hereby declared to be an emergency as funds must be expended prior to September 30', 1998 and on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. WHEREAS, the City of Miami has a strong interest in reducing crime, improving public safety, and expanding its crime prevention .program; and WHEREAS, the City applied for and. received a grant in the amount of $3,033,834.00, from the United States Department of Justice, Local Law Enforcement Block Grant Program; and WHEREAS, matching funds from the City of Miami, in the amount of $337,093.00, will be required to accept said grant; and WHEREAS, purchases would have to comply with applicable city code purchasing requirements; and WHEREAS, this Ordinance is being presented as an emergency item due, in part, to the fact that the City of Miami has declared a financial emergency exists, and the use of these funds is to aid in reducing crime, improving public safety, and expanding the crime prexention program; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1'. Section 4. The allocation of matching funds, in the amount of $337,093.00, required for said grant award, from the Police Department General Operating Budget, Account Code 001000.290301.6.056, is hereby authorized.
