ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 35, ENTITLED
"MOTOR VEHICLES AND TRAFFIC" OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, BY AMENDING
ARTICLE VIII ENTITLED "VALET PARKING"
PROVIDING FOR THE ESTABLISHMENT OF VALET
PARKING IN THE SD-5, SD-6 AND SD-7 ZONING
DISTRICTS, AS DEFINED IN ORDINANCE NO. 11000,
AS AMENDED, THE ZONING ORDINANCE OF THE CITY
OF MIAMI, FLORIDA; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE;, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Article VIII of Chapter 35 of the City Code
established the Central Business District. (CBD) of Downtown Miami
as a valet parking zone; and
WHEREAS, the nature of other development within the special
districts surrounding the Central Business District also warrant
consideration of valet parking; and
WHEREAS, the existing provisions should be expanded to
include the Special Districts surrounding the Central Business
District of Downtown Miami;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 35 of the Code of the City of Miami,
Florida, as amended, is hereby amended by amending Article VIII,
entitled "Valet Parking" to read as follows:1'
"CHAPTER 35
MOTOR VEHICLES AND TRAFFIC
ARTICLE VIII. VALET PARKING
Sec. 35-302. Definitions.
"Valet parking zone" means the area those areas within the
following zoning districts: central business district (CBD), SD-5

rommprcial-r sid ntial district; and D-7 central Brickell rapid
transit conunprcial r sid n ial dis ri as defined in Ordinance
No. 11000, as amended, the zoning ordinance of the City of Miami,

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with. the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

ANALYSIS FOR
AMENDMENT TO CHAPTER 35 OF CITY CODE
APPLICATION: No. 98-016
The proposed Amendment to Chapter 35 of the City Code is in order to allow valet parking zones
within the SD-5, SD-6 and SD-7 Zoning Districts (see copy of zoning atlas pages attached).
Chapter 35 of the City Code currently allows valet parking zones within the Central Business
District (CBD Zoning District) of Downtown Miami; at the time of the adoption of this valet parking
ordinance, it was deemed necessary that downtown Miami allow valet parking in order to facilitate
the establishment of quality businesses within the district.
The 3 Special Districts referenced above are specifically the Brickell, Central Brickell and Omni
area Districts within Downtown Miami; these districts, like the CBD, require the ability to provide
valet services in order to attract the quality establishments which will help them to remain
competitive with the remainder of Miami -Dade County. The proposed Performing Arts Center is a
specific example of the type of facility which really should provide valet parking services to ensure
its success.
The following findings have been made:
• It is found that the proposed amendment is in keeping with the intent of the City of Miami's
Downtown Masterplan and Comprehensive Plan by enabling Downtown Miami to fulfill it's role
as Miami's Central Urban Core by allowing the necessary diversity of quality establishments
necessary for such a role.
• It is found that the proposed amendment has the necessary conditions and safeguards to
ensure that the intent of the ordinance is properly implemented with no adverse impacts to the
downtown area.
Based on these findings, the Department of Planning and Development is recommending approval
of the proposed amendment to Chapter 35 of the City Code.
