HomeMy WebLinkAboutO-11667J-98-548 5/14/98 ORDINANCE NO. 11667 AN ORDINANCE AMENDING CHAPTER 40, ARTICLE III, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED: "PERSONNEL/CIVIL SERVICE RULES AND REGULATIONS", TO REDUCE THE NUMBER OF PERSONS TO BE CERTIFIED AS CANDIDATES FOR POLICE OFFICER ON OPEN COMPETITIVE REGISTERS; MORE PARTICULARLY BY AMENDING SUBSECTION 40-88 (a) (1) AND REPEALING SUBSECTION 40-88(a)(2); CONTAINING A REPEALER PROVISION AND A SEVERABILITY.CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Civil Service Board, at its regular meeting of January 15, 1998, unanimously voted to amend Rule 8, Section 8.3, of the Civil Service Rules in an effort to reduce the number of persons who shall be certified as candidates for police officer on open competitive registers; and WHEREAS, it is now necessary to amend Section 40-88(a)(1) and (2) of the Code of the City of Miami, Florida, as amended to reflect the Civil Service Board's action for said Rule; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the employees of the City of Miami to amend said Section; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11667 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 40, Article III, of the Code of the City of Miami, Florida, as amended, entitled "Personnel/Civil Service Rules and Regulations", is hereby amended in the following particulars:l/ "CHAPTER 40 ARTICLE III. CIVIL SERVICE RULES AND REGULATIONS Sec. 40-88. Manner of certification of eligibles for appointment. (a) From open competitive registers. (1) F-er i9esiti&B9-etheE than r='-iee officer. The director of the personnel management department shall certify from the appropriate eligible register the five persons who stand the highest thereon. Eligibles not selected shall be returned to the register in accordance with their relative grades. Only under unusual and exceptional conditions satisfactory to the board shall the names of eligibles be passed over. -(2)--F-er-pes-i the ti persennel en ef manageraeatz peliee effreerc. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Warshaw REFERENCES: City Manager ENCLOSURES: (6) It is recommended that an amendment to Rule 8, Section 8.3, Sub -sections (a) and (b) of the Civil Service Rules and Regu- lations, per the attached Ordinance, be approved which would require that certification for the classification of Police Officer be executed in accordance with Civil Service Rules 8.3, Sub -section (a) and 8.7 as currently written, thereby re- ducing the number of persons certified as candidates for Po- lice Officer. During the Civil Service Board meeting of December 4, 1997, Police Chief Donald Warshaw submitted a proposed amendment to Civil Service Rule 8, Section 8.3, Sub- sections (a) and (b) which would require that certification for the classification of Po- lice Officer be executed in accordance with Civil Service Rules 8.3, Sub -section (a) and 8.7 as currently written. Chief Warshaw believes that such action would facilitate the expeditious processing of applicants for the position of Police Officer and allow those candidates who have earned higher ratings on their examinations to be re- ferred to the Police Department first, thus providing for a higher caliber of candidates to be given the opportunity to be processed first. Personnel and union representatives indicated no objection to the proposed rule change at the Public hearing held on January 15, 1998. The Civil Service Board unanimously voted to amend Rule 8, Section 8.3, Sub -sections (a) and (b) at the same hearing. Therefore, it is recommended that an amendment to Rule 8, Section 8.3, Sub -sections (a) and (b) of the Civil Service Rules and Regulations, per the attached Ordinance, be approved to provide for the certification of the classification of Police Officer in ac- cordance with Rules 8.3 (a) and 8.7 as currently written.
