ORDINANCE No . 116 66
AN ORDINANCE AMENDING CHAPTER 40,
ARTICLE III, OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, ENTITLED
"PERSONNEL/CIVIL SERVICE RULES AND
REGULATIONS", TO PROVIDE THAT SUBJECT TO ANY
PROVISION IN AN EXISTING LABOR AGREEMENT,
REAPPOINTED EMPLOYEES SHALL ONLY RECEIVE
CREDIT FOR SERVICE RENDERED PRIOR TO RE-
EMPLOYMENT FOR THE PURPOSE OF MEETING THE
TIME -IN -GRADE REQUIREMENT NECESSARY FOR
TAKING A PROMOTIONAL EXAMINATION; MORE
PARTICULARLY BY AMENDING SECTION'40-119(b) OF
SAID CODE; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Civil Service Board, at its regular meeting of
April 23, 1998, unanimously voted to amend Rule 12, Section 12.4,
to clarify the language that, subject to any provision in an
existing labor agreement, reappointed employees shall only
receive credit for service rendered prior to remployment for the
purpose of meeting the time -in -grade requirement necessary for
taking a promotional examination; and
WHEREAS, it is now necessary to amend Section 40-119(b) of
the Code of the City. of Miami, Florida, as amended, to reflect
the Civil Service Board's action for said Rule; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
employees of the City of Miami to amend said Section;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 40, Article III, of the Code of the
City of Miami, Florida, as amended, entitled "Personnel/Civil
Service Rules and Regulations", is hereby amended in the
following particulars:l/
"CHAPTER 40
ARTICLE III. CIVIL SERVICE RULES AND REGULATIONS
"Sec. 40-119. Resignation.
(b) Subsequent renewal of employment. Any employee
who resigns with a satisfactory record of service may
apply to his or her employing department to be placed
on a reemployment list. If the director of the
employing department endorses the request, said
director may submit the request to the civil service
board. If the request is approved by the civil service
board, the director of personnel management shall
certify the name together with other names certified
under section 40-88. Subject to the provisions of
existing labor agreements, the—eivil servieebeard may

who had not completed the probationary period will be
required to serve a full probationary period as
provided in sections 40-96 and 40-97. Eligibility for
reemployment shall be limited to two years following
approval by the civil service board; provided, however,
that in the case of police and fire jobs requiring
state certification, reemployment shall be limited to
two years following the effective date of resignation.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

It is recommended that an amendment to Rule 12, Section
12.4, of the Civil Service Rules and Regulations, per the at-
tached Ordinance, be approved which would clearly specify
the conditions upon which credit would be granted by the
Civil Service Board to individuals re-employed by the City of
Miami.
An amendment to Civil Service Rule 12, Section 12.4, was proposed by Civil Service
Board Member Martin Garcia at the Board meeting of March 26, 1998. At the meeting,
Member Garcia pointed out that when individuals who have been re-employed by the
City under Civil Service Rule 12.4 make requests for the crediting of previous senior-
ity, it has been the Board's practice to only grant the seniority credit for the purpose
of meeting the time -in -grade requirement necessary for taking promotional examina-
tions. The granting of such previous credit is not used for augmenting test scores or
any other scores. Member Garcia belie` es that this amendment to Rule 12.4 would
clearly show the Board's intent concerning application of the Rule.
Personnel and union representatives indicated no objection to the proposed rule
change at the Public hearing held on April 23, 1998. The Civil Service Board unani-
mously voted to amend Rule 12, Section 12.4, at the same hearing.
Therefore, it is recommended that an amendment to Rule 12, Section 12.4, of the Civil
Service Rules and Regulations, per the attached Ordinance, be approved which
would clearly specify the conditions upon which previous seniority credit would be
granted by the Civil Service Board to individuals re-employed by the City of Miami.
I shall include on the City Commission agenda of Tuesday, May 26, 1998, an Ordi-
nance concerning an amendment to Civil Service Rule 12, Section 12.4.
