AN ORDINANCE AMENDING SECTION 18-84 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "EMERGENCY PURCHASES", THEREBY AUTHORIZING THE CITY MANAGER TO EXPEND UP TO ONE HUNDRED FIFTY THOUSAND DOLLARS ($150,000) FOR PURCHASES OF GOODS AND/OR SERVICES REQUIRED PURSUANT TO AN ACTIVATION OF THE URBAN SEARCH AND RESCUE TASK FORCE, PURSUANT TO THE TERMS OF THE MEMORANDUM OF UNDERSTANDING, ENTERED INTO BY AND BETWEEN THE CITY OF MIAMI, THE STATE OF FLORIDA, AND THE FEDERAL EMERGENCY MANAGEMENT AGENCY, AND TO WAIVE COMPETITIVE BIDDING METHODS IN CONNECTION WITH SUCH PURCHASES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the on October 5, 1993, the City of Miami and the Federal Emergency Management Agency, ("FEMA") and the State of Florida ("State") entered into a Memorandum of Understanding ("MOA") for purposes of setting forth responsibilities and procedures for Urban Search and Rescue Activities under the authority of "The Robert T. Stafford Disaster Relief and Emergency Act," Public Law 93-288, as amended, 42 U.S.C. §5121, et s( Q; and WHEREAS, pursuant to said MOA the City is required to serve as the agency which recruits and administers an Urban Search and Rescue Task Force which is capable of call -out and mobilization 11657 to the site of a catastrophic disaster within six (6) hours of receiving an alert and/or activation request from either the State or FEMA; and WHEREAS, pursuant to said MOA, expenses for the mobilization and activation of the Task Force are to be reimbursed to the City by either the State or FEMA; and WHEREAS, in order to comply with the City Is responsibility under the MOA, it is necessary to amend the Code of the City of Miami to authorize the City Manager, in the event of a State or Federal activation, as such term is described in the MOA, to expend up to $150,000 for the purchase of goods and services required for the immediate mobilization of the Urban Search and Rescue Task Force, and to waive competitive bidding in connection therewith thereby assuring the immediate procurement of such goods and services; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 18-84 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:1' 1' Words and/or figures stricken through shall be deleted. Emergency Purchases. _Cal In case of emergency, it is not advantageous or practicable for the city to use competitive bidding methods. Therefore, the city manager may direct the chief procurement officer to purchase directly those goods or services whose immediate procurement is essential to the life, health, welfare, safety or convenience of the city. Such emergency purchases shall nevertheless be made with such competition as may be practicable under the circumstances. In seeking a waiver of competitive bidding methods, the head of the using department or office shall submit to the chief procurement officer and the city manager in writing a full explanation of the circumstances of the emergency and the reasons for selection of a particular firm, along with a list of others which may have been solicited, with a confirming requisition attached thereto. The city manager may then waive competitive bidding requirements after making a written finding, supported by reasons, that an emergency exists. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. - 3 - 11657 Section 5. The ordinance establishes a procedure by which emergency purchases may be made in response to the activation of the Urban Search and Rescue Task Force. BACKGROUND: In order to comply with the City's responsibility pursuant to a memorandum of agreement entered into between the City and FEMA, it is necessary to authorize the City Manager, in the event of a State or Federal activation, to expend up to $150,000.00 dollars for the purchase of goods and services required for the immediate mobilization of the Urban Search and Rescue Task Force, and to waive competitive bidding in connection therewith.
