HomeMy WebLinkAboutO-11656J-98-342 4/20/98 ORDINANCE NO. 116 v C 6 AN ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED "SOUTH FLORIDA URBAN SEARCH AND RESCUE FL-TF2" FOR THE PURPOSE OF RECEIVING AND DISBURSING FUNDS TO BE PAID TO THE CITY BY THE FEDERAL EMERGENCY MANAGEMENT AGENCY, ("FEMA") AND/OR THE STATE OF FLORIDA ("STATE") AS REIMBURSEMENTS FOR ACTIVITIES UNDERTAKEN BY THE CITY PURSUANT TO THE TERMS OF THE MEMORANDUM OF AGREEMENT, ENTERED INTO BY AND BETWEEN THE CITY, THE STATE AND FEMA, UNDER WHICH THE CITY RECRUITS, AND SPONSORS AN URBAN SEARCH AND RESCUE TASK FORCE; AND APPROPRIATING_ FUNDS THEREFOR, IN THE AMOUNT OF $1,032,154, FOR THE OPERATION OF SAME; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the on October 5, 1993, the City of Miami and the Federal Emergency Management Agency, ("FEMA") and the State of Florida ("State") entered into a Memorandum of Understanding (11MOA11) for purposes of setting forth responsibilities and procedures for Urban Search and Rescue Activities under the authority of "The Robert T. Stafford Disaster Relief and Emergency Act," Public Law 93-288, as amended, 42 U.S.C. §5121, Pt spa; and WHEREAS, under the MOA the City is required to serve as the agency which recruits and administers an Urban Search and Rescue Task Force which is capable of call -out and mobilization to the site of a catastrophic disaster within six (6) hours of receiving 11656 an alert and/or activation request from either the State or FEMA; and WHEREAS, the Urban Search and Rescue Task Force was activated for disaster response for Hurricane Opal on October 4, 1995, pre -positioned for disaster response during the Atlanta Centennial Olympics on July 2, 1996, and activated for a building collapse in San Juan, Puerto Rico on November 23, 1996; and WHEREAS, FEMA has reimbursed the City for expenses incurred as a result of these events in the amount totaling $2,128,000.00 for Fiscal Years 1994 through 1997; and WHEREAS, it is now necessary to establish a new special revenue fund entitled "South Florida Urban Search and Rescue FL-TF2" for the purpose of receiving and disbursing funds to be paid to the City of Miami by FEMA and/or the State as reimbursements for activities undertaken by the City pursuant to the terms of said MOA, as well as to accommodate a carry-over fund balance from previous reimbursements; and WHEREAS, there is a balance from the previous special revenue fund established to receive and disburse funds for the Urban Search and Rescue Task Force activities, in the amount of $1,032,154, which shall be carried -over to the new fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: - 2 - 11656 Section 1. The following new Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: South Florida Urban Search and Rescue FL-TF2 RESOURCES: Federal Emergency Management Agency State of Florida Carry-over Fund Balance $1,032,154 APPROPRIATION: South Florida Urban Search $1,032,154 and Rescue FL-TF2 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. The ordinance establishes a special project / account fund for the Urban Search and Rescue Task Force. BACKGROUND: The City of Miami, through the Fire Department, participates in the FEMA sponsored Urban Search and Rescue Task Force. The City is the Task Force leader of FL-TF2, a task force comprised of several local municipalities including Coral Gables, Key Biscayne, Hialeah, and others. The Task Force acts under the authority of the "Robert T. Stafford Disaster Relief and Emergency Act," Public Law 93-288, as amended, 42 U.S.C. 5121, et seq. The purpose of establishing this fund is to receive and disburse funds to be paid to the City by the Federal Emergency Management Agency ("FEMA") and/or the State of Florida ("State") as reimbursements for activities undertaken by the City pursuant to the terms of the memorandum of agreement, entered into by and between the City, the State, and FEMA; under which the City recruits and sponsors an Urban Search and Rescue Task Force.
