AN ORDINANCE AMENDING THE FUTURE LAND USE MAP OF THE COMPREHENSIVE NEIGHBORHOOD PLAN BY CHANGING THE LAND USE DESIGNATION OF THE PROPERTY LOCATED AT APPROXIMATELY 666 BISCAYNE BOULEVARD, FROM RESTRICTED COMMERCIAL TO CENTRAL BUSINESS DISTRICT; MAKING FINDINGS; DIRECTING TRANSMITTALS TO AFFECTED AGENCIES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning Advisory Board, at its meeting of January 14, 1998, Item No. 1, following an advertised hearing, adopted by Resolution No. PAB 06-98, by a vote of seven to zero (7-0), RECOMMENDING APPROVAL of an amendment to the Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this Comprehensive Plan change as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11650 Section 2. The Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, is hereby amended by changing the land use designations from Restricted Commercial to Central Business District for the property located at approximately 666 Biscayne Boulevard, Miami, Florida, more particularly described as Lots 2 and 3 and the North 105 feet of lots 4, 5 and 6, less the west 10 feet thereof, on Block 60N, in the City of. Miami as recorded in Plat Book B at page 41 of the Public Records of Dade County, Florida. Section 3. It is hereby found that this Comprehensive Plan designation change: (a) is necessary due to changed or changing conditions; (b) involves a residential land use of more than 10 acres or a density of more than 10 units per acre or involves other land use categories, singularly or in combination with residential use, of more than 10 acres; (c) is one which involves property that has not been the specific subject of a Comprehensive Plan change within the last year; (d) is one which does not involve the same owner's property within 200 feet of property that has been granted a Comprehensive Plan change within the prior twelve months; (e) the proposed amendment does not involve a text change to goals, policies, and objectives of the local government's comprehensive plan, but proposes a land 2 _ 11650 • use change to the future land use map for a site -specific development; (f) is one which is not located within an area of critical state concern; Section 4. The City Manager is hereby directed to instruct the Director of the Department of Planning and Development to immediately transmit a certified copy of this Ordinance, upon approval on First reading a-Z after its adoption on Second Reading to: James F. Murley, Secretary, Florida Department of Community Affairs, Tallahassee, Florida; Carolyn Dekle, Executive Director, South Florida Regional Planning Council, Hollywood, Florida; Sam, E. DISCUSSION The proposal has been reviewed for a change to the Future Land Use Map of the Miami Comprehensive Neighborhood Plan 1989-2000 from Single Family Residential to Restricted Commercial . The subject property consists of a .6 acre parcel, Lots 2 and 3 and the North 105 feet of lots 4, 5 and 6, less the west 10 feet thereof, on Block 60N, in the City of Miami as recorded in Plat Book B at page 41 of the P.R.D.C. Miami Comprehensive Neighborhood Plan (MCNP) Land Use Policy 1.6.1., established future land use categories according to the Future Land Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The subject property is currently designated Restricted Commercial. The Restricted Commercial category accommodates commercial activities that generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto and often located along arterial or collector roadways. Residential uses equivalent to High Density Multifamily Residential, up to 150 dwelling units per acre, including hotels, are also permissible within this land use category. Commercial uses include general retailing, personal and professional services; real state; banking and other financial services; restaurants; saloons and cafes; general entertainment facilities and private clubs and recreation facilities whose scale and land use impacts are similar in nature to those uses described above. Other permissible land uses include motels and hotels; community based residential facilities; offices; major sports and exhibition or entertainment facilities; places of worship and primary and secondary schools. Mixed - uses containing commercial, office and/or residential are also permissible within this land use designation. 11650 The Central Business District category is intended to apply to the central commercial, financial and office core of the metropolitan region, and allows all activities included in the "Office", "Restricted Commercial", "Major Institutional, Public Facilities, Transportation and Utilities" designations. Residential facilities (except rescue missions) alone or in combination with other uses are allowable to a maximum density of 1,000 dwelling units per acre, subject to the detailed provisions of the applicable land development regulations and the maintenance of required levels of service for facilities and services included in the City's adopted concurrency management requirements. Also permitted is a mix of uses ranging from high density multifamily residential to high intensity office uses with retail uses on the lower floors of structures. Intensity of uses within the CBD land use designation are generally higher than those allowed in other areas of the city. The Department of Planning and Development is recommending Approval of the application as presented based on the following findings: • It is found that the Department of Planning and Development, upon receiving this application for a Land Use amendment to "Central Business District" conducted a study of the Biscayne Boulevard corridor in this area in order to determine whether the request was appropriate or whether another zoning classification which increased intensity of development while maintaining a "Restricted Commercial" Land Use Designation was more appropriate. It was determined that a Zoning Classification of SD-6 Central Commercial -Residential District, which maintains a Land Use Designation of "Restricted Commercial" was more appropriate and allowed a much more flexible development program than the C-1 Restricted Commercial zoning classification for the remainder of the Biscayne Boulevard Corridor in this area, however, a Land Use and Zoning Classification of "Central Business District" is appropriate for the subject property given the fact that the remainder of the block is already designated "Central Business District" and the proposed change would unify the block under one designation which would therefore make the entire block much easier to develop in a unified fashion. • It is found that the requested change to Central Business District on the subject property will unify the Land Use classifications for the entire block and therefore allow for a more unified development proposal to serve the downtown core. • It is found that the requested change to Central Business District on the subject property is consistent with Objective LU-1.4 of the Miami Comprehensive Neighborhood plan which requires the city to "Continue the growth of Downtown Miami, expand its role as a center of domestic and international commerce, further its development as a regional center for the performing arts and other cultural and entertainment activities and develop an urban residential base." 2 11650 These findings support the position that the existing land use pattern in this neighborhood should be changed. It also should be stated, that whereas MCNP Land Use Policy I.I.I. requires development or redevelopment, that results in an increase in density or intensity of land use, to be contingent upon availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) (CIE Policy 1.2.3.).
