ORDINANCE NO.
AN ORDINANCE AMENDING SECTIONS 2-33 AND 2-34
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TO PROVIDE THAT ANY COMMISSIONER WHO
SO DESIRES MAY BE A SIGNATORY ON CITY OF
MIAMI PROCLAMATIONS, AND FURTHER PROVIDING
FOR A CEREMONIAL HEAD OF CITY GOVERNMENT IN
THE EVENT OF A VACANCY IN THE POSITION OF
MAYOR; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Charter and Code of the City of Miami, Florida,
as amended, currently provide that the mayor is the ceremonial
head of city government; and
WHEREAS, neither the City Charter or Code specifies who
assumes and serves in the capacity of ceremonial head of city
government when a vacancy in the office'of mayor exists; and
WHEREAS, further, the Charter and Code of the City of Miami,
Florida, as amended, do not provide that any commissioner who so
desires may a'be signatory on City of -Miami proclamations; and
WHEREAS, the City Commission desires to amend said Code to
state the order of succession to the position of ceremonial head
of city government during a mayoral vacancy and to provide for
commission signatures on City proclamations;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 2, Sections 2-33 and 2-34 of the Code
of the City of Miami, Florida, as amended, is hereby amended in
the following particulars:l'

(a) In accordance with section 4 (g) (1) of the city
charter, the mayor may be the presiding officer of
the city commission with the authority to
designate another member of the city commission to
serve as presiding officer.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption there^f'

That the City Commission approve on second reading the attached Ordinance approved
by the City Commission at its meeting of March 24, 1998, amending Sections 2-33 and
2-34 of the Code of the City of Miami, Florida, as amended, to provide that any
Commissioner who so desires may be signatory on City of Miami Proclamations, and
further providing for a ceremonial head of City Government in the event of a vacancy in
the position of Mayor.
BACKGROUND
This item was introduced as a pocket item by Commissioner J.L. Plummer on March 24,
1998. The Charter and Code of the City of Miami provide that the Mayor is the head of
City government, but does not specify who serves in that capacity in the event of a
vacancy. The Charter and Code also do not provide that any Commissioner who so
desires may sign proclamations. The attached Ordinance makes provisions with respect
to both matters.
