AN ORDINANCE AMENDING SECTION 18-182 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "AUTHORITY TO SELL," TO INCLUDE THE REQUIREMENT THAT ALL CONVEYANCES OF REAL PROPERTY BY THE CITY OF MIAMI SHALL BE SUBJECT TO A DEED RESTRICTION THAT REQUIRES GRANTEES WHO ARE LEGALLY IMMUNE OR EXEMPT FROM TAXATION TO PAY TO THE CITY AN ANNUAL MUNICIPAL SERVICE PAYMENT IN AN AMOUNT EQUAL TO WHAT THE CITY WOULD RECEIVE IN AD VALOREM TAXES; FURTHER PROVIDING FOR A WAIVER OF SAID REQUIREMENT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, real property owned and used by certain designated entities and for certain designated purposes is immune or exempt by federal and Florida law from the imposition of ad valorem taxes; and WHEREAS, the City of Miami provides municipal services including, but not limited to, police and fire protection, emergency medical services, garbage disposal (for certain residential properties), sewer improvement, street improvement, and parking facilities, to all property within its jurisdiction; and WHEREAS, Section 29-A(e)(2) of the City Charter requires that all persons who purchase real property from the City shall 11640 be obligated to pay an amount equal to what the ad valorem taxes would be if the property were privately owned and used for profit making purposes; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Code of the City of Miami, Florida; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 18-182 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:/ "Sec. 18-182. Authority to sell. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Manager RECOMMENDATION CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM 14 DATE: DFILE: SUBJECT: Amendment of Section 18-182 of the City Code REFERENCES: ENCLOSURES: City Commission Meeting 3/10/98 Ordinance It is respectfully recommended that the City Commission adopt the attached Ordinance to amend Section 18-182 of the Code of the City of Miami, to include the requirement that all conveyances of real property by the City of Miami shall be subject to a deed restriction. The deed restriction will require grantees, who are legally immune or exempt from taxation, to pay to the City an annual municipal service payment in an amount equal to what the City would receive in ad valorem taxes. BACKGROUND Real property owned and used by certain designated entities and for certain designated purposes is immune or exempt by federal and Florida law from the imposition of ad valorem taxes. The City of Miami provides municipal services such as police and fire protection, emergency medical services, garbage disposal (for certain residential properties), sewer and street improvements, and parking facilities to all property within its jurisdiction. Section 29-A(e)(2) of the City Charter requires that all persons who purchase real property from the City shall be obligated to pay an amount equal to what the ad valorem taxes would be if the property were privately owned and used for profit making purposes. It is in the best interest of the City of Miami to amend the Code of the City of Miami to reflect the Charter requirement. Section 18-182(a) would also be amended to authorize the City Manager, not the chief procurement officer, to sell real property owned by the City. The Office of Procurement is not involved in property sales. Further, Section 18-182(a) (2) is revised to reflect City Commission Resolution No. 97-208 regarding the establishment of values for properties to be sold. c: Christina M.
