ORDINANCE NO. 11633
AN EMERGENCY ORDINANCE AMENDING SECTION 5 OF
ORDINANCE NO. 6145, ADOPTED MARCH 19, 1958,
AS AMENDED, WHICH ESTABLISHED FEES FOR
BUILDING, PLUMBING, ELECTRICAL, MECHANICAL,
INCLUDING BOILER AND ELEVATOR, INSPECTION
PERMIT AND CERTIFICATE FEES (THE "BUILDING
PERMIT FEES"), THEREBY. ADDING AND INCREASING
REQUIRED FEES TO COVER COSTS FOR THE
ENFORCEMENT OF THE SOUTH FLORIDA BUILDING
CODE; FURTHER AMENDING THE CODE OF THE CITY
OF MIAMI-;—.FLORIDA, AS AMENDED, BY PROVIDING
FOR -CODIFICATION OF SAID BUILDING PERMIT FEES
AS SECTION 10-4 OF SAID CODE; CONTAINING A
REPEALER PROVISION, SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE; AND
PROVIDING FOR INCLUSION IN THE CITY CODE.
WHEREAS, Section 5 of .Ordinance No. 6145, adopted, March 19,
1958, as amended, provides fees for building, plumbing,
electrical, and mechanical, including boiler and elevator,
inspection permit and certificate fees (hereinafter referred to
as the "Building Permit Fees"); and
WHEREAS, the City Manager recommends to the City Commission
the amendment of tkie Building Permit Fees by increasing certain
fees and establish certain additional fees to cover the cost for
the enforcement of the South Florida Building Code in order to
provide much needed services for the operation of the City of
Miami and the codification of said fee schedule;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Code of the City of Miami, Florida, as amended, is hereby amended
by adding new Section 10-4 to said Code in the following
particulars:!
"Chapter 10
BUILDINGS
Sec. 10-4 Building Permit Fee Schedule
a. FEE FOR WORK WITHOUT PERMIT:
When work is commenced prior to obtaining a required
permit, a fee of two (2) times that specified herein
shall be paid. The payment of such fees shall not
relieve any person, firm, or corporation from fully
complying with all of the requirements of all applicable
regulations and codes, nor shall it relieve them from
being subject to any of the penalties therein. The fee
requirement shall be applicable to all divisions of
building and zoning department.
MINIMUM FEE.......................................$60.00

b. GENERAL FEES:
All permits will be assessed a construction debris
removal fee of 20 of the cost of construction with a
minimum fee of $20.00 and a maximum fee of $2,500.
(1) REINSPECTION FEES: FOR EACH REINSPECTION, EXCEPT
WHERE OTHERWISE NOTED .................... .$50.00

The payment of reinspection fees may be required
before any further permits will be issued to the
person or firm owing same, and further inspections
may be refused until payment of reinspection fees
has been made.
(2) REINSPECTION OF EXISTING BUILDINGS AND INSPECTION
FOR CERTIFICATE OF COMPLIANCE FEE:
(a) Reinspection of existing buildings (by all
sections) to determine compliance with the
South Florida Building Code, the City of Miami
Zoning Ordinance and other applicable
ordinances (but not the annual inspection as
required by City Code §2-87(c)) and inspection
of existing buildings after repairs,
alterations or remodeling for a certificate of
compliance, when a certificate of occupancy is
not required:
Each building up to two (2) stories and not
exceeding 20,000 square
feet ................... ..............$250.00
Additional for each story over two (2)

For each floor over 10,000 square feet,

(3) RECERTIFICATION OF PLANS AND REVISED PLANS FEE,
AND PERMIT CARD REPLACEMENT:
(a) When plans are lost by the owner or
contractor, a recertification fee is required
to recertify a new set of plans:

(5) CERTIFICATE OF OCCUPANCY AND CERTIFICATE OF USE
(a) Temporary Certificate of Occupancy

(c) Final Certificate of Occupancy
The following fee shall be required for all
groups of occupancies as defined in the
South Florida Building Code. The
Certificate of Occupancy shall remain valid
for an unlimited time unless revoked; there
is a change in the group of occupancy; an
enlargement; alteration or addition to the
occupancy or to the structure it occupies.
Single Family or
Duplex per building................$100.00
All others per building ............ $250.00
(d) Bonds required for unfinished work on
certificates of occupancy.
(i) Amount is to be established by Chief
of Section(s) involved and shall be
100% of estimated cost of required
work. Cash Bond will be refunded less
$50.00 or other bonds discharged, upon
completion of required work by owner.
(ii) Methods for placing bonds may be:
1. Surety Company issuance of bond.
2. Cash bond. Payable by cash, or
certified cashier's check. A
COPY of signed contract with a
contractor to do the work is
also required.
3. Letter of Credit from a Federally
Guaranteed Insured State
Certified Bank. The letter shall
indicate the purpose of the line
of credit. A copy of signed
contract with a contractor to do
the work is also required.

(iii) If Work is done within specified
time, the City will proceed to
have the work done (1) through
the Bonding Company if Method No.
1 was used; (2) through the
contractor specified in the
contract if Method No. 2 or
Method No. 3 was used, using the
proceeds from the cash bond or
from the Bank Letter of Credit.
(e) When a building is occupied prior to
obtaining a temporary or .final Certificate
of Occupancy, a fee double the permit
amount plus $100.00 fine shall be paid.
The payment of suchfeeshall not relieve
any person, firm or corporation from fully
complying with all of the requirements of
all applicable regulations and codes, nor
shall it relieve them from being subject to
any of the penalties therein.
(f) Temporary Certificate of Use on partial
and/or Temporary Occupancy .......... $50.00.
(6) VIOLATION NOTICE:
When a violation notice and/or notification
letter is sent ordering correction of an existing
violation, the following administrative fee is
required to be paid, such payment being
cumulative and in addition to any fines or
penalties which may be imposed as a result of a
conviction for said violation.

C. REFUNDS, TIME LIMITATION, REVOCATION, ETC.
The fees charged pursuant to this ordinance, provided
the same are for a permit required by Section 301.1 of
the South Florida Building Code, may be refunded by
the Director of the Building and Zoning Department,
subject to the following:
(1) No refunds shall be made where any work, has
commenced except where duplicate permits are
issued for the same work, in which case a refund
in accordance with paragraph (4) of subsection
(c) hereof may be granted to the original permit
holder providing that the duplicate permits were
issued within ninety (90) days of each other and

request for refund is received within ninety (90)
days of the issuance of the latter permit.
(2) No refunds shall be made where permit have become
void as provided by paragraph 304.3(a) of the
South Florida Building Code.
(3) No refunds shall be made on permit fees of
$100.00 or less.
(4) Refunds on permits or any item thereon, where
fees are over $100.00 will be refundable on a
basis of (500) of the balance over $100.00 such
refunds be made to the closest dollar.
(5) Full refunds may be granted to a permit holder
whose permit is canceled by owner authorization
where work has commenced and such owner selects a
second contractor to complete the work. The
second contractor shall pay a full fee to
complete the work unless the first contractor
waives his/her opportunity to refund in writing,
or if the property owner can provide proof that
the first permit holder was reimbursed for the
permit fee, in which case the second contractor
is entitled to a permit to cover the same work on
a 'no charge' basis. If the first payment is
expired the second contractor shall pay a full
permit fee on unstarted work or a completion
permit fee in accordance with subparagraph (b) of
paragraph (16) of subsection (d) hereof.
(6) A full refund may be granted to a permit holder
who takes out a permit covering work outside the
jurisdictional inspection area, or if permit is
canceled by the Department within ninety (90)
days with no work being done.

remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the .grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. It is the intention of the City Commission
that the provisions of this Ordinance shall become and be made a
part of the Code of the City of Miami, Florida, as amended.
Section 10. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached .
emergency Ordinance amending Section 5 of Ordinance No. 6145, adding and
increasing required fees to cover the enforcement of the South Florida Building Code.
BACKGROUND
The adoption of the attached emergency ordinance is required in order for the City of
Miami to continue to provide the level of service the citizens of Miami deserve, as well
as protect lives. The cost of properly enforcing the South Florida Building Code
continues to increase, and it has become necessary to increase some fees to reflect
the true cost of providing the service. The urgency of the increase is to cover the costs
as quickly as possible for the remaining of the fiscal year.
The Building and Zoning Department is where all major construction projects begin
and end, starting with the plans reviewed, the permits issued and the projects
inspected and finalized. The expediting of the review process gets the projects off the
ground quicker, finalized sooner and on the tax rolls. The fee being added for
expediting plans review entails subcontracting out for the service, without cost to the
City, and.thus encouraging the development to occur at an accelerated pace. The City
would subcontract two (2) reviewers for each discipline: Structural, Building,
Electrical, Mechanical, and Plumbing. A $250.00 fee would be charged per discipline
totaling $1,250 per plan, in addition to the normal costs of the permit.
The 40/50 yearcertification application fee is being increased to cover the costs
involved. The follow up involves mass mailings, inspections, review of reports, and
monitoring permits, as needed. The new fee will match the fees presently being
charged by Miami -Dade County.
The annual master premise permit is issued to any firm which performs its own
maintenance with licensed, certified maintenance personnel, as well as helpers. The
permit is issued yearly in lieu of any other permit for the erection, repair or relocation
of non -bearing interior partitions, painting, patching or stucco and plaster, the repair
of floors of all types, the repairs of awnings and canopies, the repair of wall and floor
tile. The one time permit makes it easier for the firm to pull one master permit and
assures the City the minor repairs are done by licensed personnel.

The City of Miami is adding a Construction Debris Removal Fee. This fee is necessary
to remove an enormous amount of debris generated from various types of
f4 construction activities such as building, demolition, electrical, plumbing, mechanical,
and remodeling of existing properties from back alleys and rights of ways.
City of Miami states that the City Commission finds it in the public interest to ensure
that all areas within the City limits be adequately provided with high -quality waste
collection and disposal service; that it retains regulatory authority as permitted by law
over waste collection and disposal in the interest of public health, safety, welfare and
ecological considerations associated with the provision of this service; and retains
control over the use of public rights of ways to ensure against interference with the
public's convenience, and to protect the public investment in rights of way property.
The addition of a "Construction Debris Removal Fee" to help offset the enormous costs
related to the collection and disposal of illegally dumped construction related debris
within the City of Miami is the best means of assuring that the above described
interest of the City are protected.
The Construction Debris Removal Fee is charged on all building, electrical, plumbing,
mechanical and demolition permits. The fee is based upon a 0.20% projected cost of
the project for which the permit is being applied, with a minimum fee of $20 and a
maximum fee of $2,500. The rate for the Construction Debris Removal Fee would
generate approximately $1.4 million annually which helps offset the costs presently
borne by the City related to the collection and disposal of construction related debris
illegally dumped in the City of Miami and is therefore in the best interests of the City.
