ORDINANCE NO. 11632
AN EMERGENCY ORDINANCE AMENDING CHAPTER 22,
ARTICLE I, SECTION 22-12 OF THE CODE OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED -
"WASTE FEES," BY SETTING FORTH SUPPLEMENTAL
WASTE FEES TO BE ASSESSED UPON COMMERCIAL
ESTABLISHMENTS AS SPECIFIED HEREIN;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Miami's commercial solid waste accounts
are serviced by.over 20 licensed franchise waste haulers that
remove garbage and debris that is in enclosed containers; and
WHEREAS, the City's Solid Waste Department must remove
garbage and debris that is on the ground because it has
overflowed out of the appropriate container or the private hauler
has left debris on the ground or because -it has been illegally
dumped; and
WHEREAS, the City's Solid Waste Department must ensure the
cleanliness of our streets and alleyways; and
WHEREAS, these sites continue to be a liability for the
Solid Waste Department to keep clean due to the high costs
associated with collection, cleaning, and disposal of waste
material; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the

general welfare of the City of Miami and its inhabitants to amend
the Code of the City of Miami, :Florida, as amended, as
hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 22-12 of the Code of the City of
Miami, Florida,. as amended, is hereby amended in the following
particularsl/:
"GARBAGE AND OTHER SOLID WASTE
ARTICLE I. IN GENERAL
Sec. 22-12. Waste fees.
(d) The following annual fees are hereby assessed
against all commercial establishments emeept
aparttaents, eeeperative— apartments, -and-
-- dential eendeminiuffi units as defined in F.S.
§� I8.'^—zvT, which fees are in addition to all
existing fees contained in this chapter for the
above cleaning services and are to be billed
annually in advance in accordance with the fee
schedule as set forth below:
1/ Words and/or figures stricken through shall be deleted. Underscored
words and/or figures shall be added. The remaining provisions are now in
effect and remain unchanged. Asterisks indicate omitted and unchanged
material.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of necessity of the City of
Miami to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and
required purchases of goods and supplies, and to generally carry
on the functions and duties of municipal affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the City
Commission.
Section 7. This Ordinance shall become effective
immediately upon adoption.

Solid Waste/Amendment of
Sec.22-12. Waste Fees
Commercial Properties
It is respectfully recommended that the City Commission approve a change in
the category of properties and the schedule of annual. fees assessed against all
commercial establishments for the cleaning of public right-of-way services in the
manner set forth in the attached ordinance amending Sec. 22-12. Waste Fees,
of the City Code.
BACKGROUND
• The City of Miami's commercial properties have been serviced by licensed waste
haulers exclusively for approximately four (4) years. During this time, the
Department of Solid Waste has experienced a significant increase in the amount
of illegally dumped materials on the city's rights -of -way. The Five Year Recovery
Plan identified 40,000 tons annually as the extent of this collection requirement.
This represents approximately $3 million in disposal fees and operating costs
annually that is spent to clean our rights -of -way of this material.
The City Code was amended several years ago to establish a public right-of-way
cleaning fee against certain commercial properties, but was never implemented
because of the difficulty of doing so with the fee structure which was established.
As a result, the Solid Waste Department's budget was subsidized by the general
fund to cover the cost of these services, which include mechanical street
sweeping, servicing over 400 litter containers and manual cleaning of sidewalks.
The recommended ordinance eliminates certain exclusions to the fee
assessment, including trailer parks, apartment buildings, cooperative apartments
and residential condominiums, and changes the fee structure to one based upon
the following zoning designations: CU01-20 and CU022-27. The funds
generated would offset the cost of keeping the city's streets and sidewalks clear
of litter, trash and debris.

Spinks of the Municipal Code Corporation.
As to Ordinance No. 11603, no legal issue exists related to the suggested
placement in the code of the section entitled "Exterior Facade Code" therefor adding the
provision as a new Article II in Chapter, 20, Buildings is acceptable.
As to Ordinance 11632 amending subsection 22-12(d), it is implicit that even
though the amendment does not show the specifically stricken through provisions that the
table attached to the ordinance was meant to replace those subsections therefor the tables
should be codified to replace provisions of subsections (1) - (3)
