ORDINANCE NO. 162 9
AN ORDINANCE AMENDING ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING ARTICLE 9,
SECTION 906.7 TO INCLUDE THE R-3 ZONING
DISTRICT; TO ADD ACCESSORY BANKING AND TRAVEL
SERVICE USES CONDITIONALLY; FURTHER AMENDING
ARTICLE 25, SECTION 2502 TO ADD NEW
DEFINITIONS FOR "ACCESSORY BANKING" AND
"TRAVEL SERVICE" USES; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of December 17, 1997, Item No. 8, following an advertised
hearing, adopted Resolution No. PAB 81-97 by a vote of five to
zero (5-0), RECOMMENDING APPROVAL of amending Zoning Ordinance
No. 11000 as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED.BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

_Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby in the
following particulars:1'
"ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
Sec. 906. Accessory uses and structures.
906.7. Convenience establishments
residential or office uses.

It is the intent of this section that convenience
establishments, accessory to residential or office uses, are
primarily intended for the use of occupants of the principal
use and their guests. In RRR-3, R-4, O and G/I districts,
convenience establishments shall be permitted as accessory
to residential or office uses, subject to the following
requirements and limitations:
906.7.2. Maximum floor area permitted in accessory
convenience establishment.
906.7.2.1. Except as specified below-, Mmaximum
total floor area in all accessory convenience
establishments permitted shall not exceed an
amount equivalent. to ten (10) percent of the

gross floor area of principal uses. Quick
copy services as an accessory to principal

shall not exceed an amount equivalent to two
(2) percent of the gross floor area of the
principal use or fifteen hundred (1500)

906.7.3 Accessory convenience establishment; uses
permitted. The following convenience establishment
uses shall be permitted in connection with the
principal uses indicated. In the case of hotels,
apartment hotels, and residence hotels involving
mixtures of uses, bars and restaurants shall be
permitted only if lodging units make up eighty (80)
percent or more of the required minimum points (as
computed at 906.7.1.1).

Section 3. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section,
paragraph, clause, phrase or word of this Ordinance is declared
invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 5. This Ordinance shall become effective
thirty (30) days after final reading and adoption thereof.

Amendment to Articles 9 and 11 of Zoning Ordinance 11000
to allow accessory banking and travel service uses conditionally
'within certain Zoning Districts
The proposed amendment to the Zoning Ordinance is in order to add "R-3" (medium
density multi -family residential) zoning districts to the list of zoning districts eligible to
allow convenience accessory uses in their projects; and in order to add accessory banking
and travel service uses to said list of permissible accessory uses.
This amendment recognizes the fact that a high density residential project (defined as a
residential project with more than 100 units), whether it is in an R-3 or an R-4 zoning
district, requires certain accessory convenience uses to be_ located on the premises.
The proposed amendment further recognizes that a satellite banking office with or
without an "Automated Teller Machine" (ATM) and a Travel Service use are types of
accessory convenience uses that merit inclusion in the zoning ordinance.
The legislation proposed herein specifies that the accessory services described above (and
on the attached legislation) shall require a Class II Special Permit when they are to be
located within residential projects.
The Planning Department is recommending approval of the proposed- amendment finding .
that the inclusion of accessory banking and travel service uses, as conditioned herein,
would be beneficial to the city `as a whole by providing an opportunity for appropriate
convenience establishments to be located in high density residential projects.
