AN ORDINANCE AMENDING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, BY AMENDING ARTICLE 6, SECTION 614, LATIN QUARTER COMMERCIAL -RESIDENTIAL AND RESIDENTIAL DISTRICTS, IN ORDER TO MODIFY CONDITIONAL USES PERTAINING TO COIN LAUNDRY AND DRY CLEANING OPERATIONS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE-- . WHEREAS, the Miami Planning Advisory Board, at its meeting of January 14, 1998, Item No. 6, following an advertised hearing, adopted Resolution No. PAB 12-98 by a vote of six to zero (6-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED.BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11628 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:1' "ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS Sec. 614. SD-14, 14.1: Latin Quarter Commercial -Residential and Residential Districts. Sec. 614.3. Commercial -residential district (SD-14). 614.3.1 Permitted principal uses and structures in SD-14. Permitted principal uses and structures shall be the same as permitted in C-1 except the following uses shall not be allowed inpedestrian eriented streets along primary pedestrianpathways.: 1. Private clubs, lodges, fraternities and sororities. 2. Lein laundry and dry lean e e - iens . 614.3.3 Conditional Principal Uses. Same as the C-1 District, except the following uses shall not be permitted en pedestrian—e re streets alongprimary pedestrian pathways unless otherwise provided by special permit as designated herein: 1� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. -2- 11628 0 - % 1. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. The Latin Quarter District is a very unique mixed use district in which commercial and residential uses are mixed to allow for the type of community in which one can live within sufficient proximity to daily service needs that they can walk. The SD-14 zoning district is currently written to prohibit coin laundry and dry cleaning operations along "Primary Pedestrian Pathways", however, the Department of Planning and Development has identified this particular use to be one which should continue to be accessible by foot to the adjacent community. This amendment would allow coin laundry and dry cleaning operations along "Primary Pedestrian Pathways" within the SD-14 District conditionally and contingent on certain conditions as safeguards for the community.
