AN ORDINANCE AMENDING PAGE NO. 34 OF THE ZONING ATLAS OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION FROM R- 1 SINGLE FAMILY RESIDENTIAL AND G/I GOVERNMENT AND INSTITUTIONAL TO C-1 RESTRICTED COMMERCIAL FOR THE PROPERTIES LOCATED AT APPROXIMATELY 2401, 2411, 2415 AND 2445 WEST FLAGLER STREET, AND 25 NORTHWEST 24 COURT, MIAMI, FLORIDA, WITH A ONE FOOT (11) RESIDENTIAL ZONING BUFFER AROUND THE PROPERTY LOCATED AT 25 NORTHWEST 24 COURT AND SUBJECT TO THE RECEIPT AND RECORDATION OF A VOLUNTARY COVENANT FROM THE PROPERTY OWNERS LIMITING THE USE OF SAID PROPERTY FOR PARKING PURPOSES ONLY; MAKING FINDINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property owner/applicant requested City approval of a change of zoning for the properties located at approximately 2401, 2411, 2415 and 2445 West Flagler Street and 25 Northwest 24th Court from R-1 Single -Family Residential and G/I Government and Institutional to C-1 Restricted Commercial; and WHEREAS, the Miami Zoning Board, at its meeting of November 17, 1997, Item No. 7, following an advertised hearing, adopted Resolution No. ZB 109-97, by a seven to one (7-1) vote, RECOMMENDING APPROVAL of a change of zoning classification with 11625 S 0 the exclusion of the R-1 Single -Family Residential lot located at 25 Northwest 24th Court, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Page 34, Article 4, Section. 401, Schedule of District Regulations, is hereby amended by changing the zoning classification from R-1 Single Family Residential and G/I Government and Institutional to C-1 Restricted Commercial for the property located at approximately 2401, 2411, 2415 and 2445 West Flagler Street, and 25 Northwest 24th Court, Miami, Florida, with a one foot (11) residential zoning buffer around the property located at 25 Northwest 24th court and subject to the receipt and recordation of a voluntary covenant from the property owners limiting the use of said property for parking purposes only, as more particularly described as Lots 241-247, of GLEN ROYAL, according to the Plat thereof, as recorded in Plat Book 5, Page 56 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this zoning classification change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; - 2 - 11625 (b) is not contrary to the established land use pattern; (c) will not create an isolated district unrelated to adjacent and nearby districts; (d) is not out of scale with the needs of the neighborhood or the City; (e) will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) is necessary due to changed or changing conditions; (g) will not adversely influence living conditions in the neighborhood; (h) will not create or excessively increase traffic congestion or otherwise affect public safety; (i) will not create a drainage problem; (j) will not seriously reduce light and air to adjacent area; (k) will not adversely affect property value in the adjacent area; (1) will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; and (m) will not constitute a grant of special privilege to an individual owner so as to compromise the protection of the public welfare. Section 3. Page No. 34 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said - 3 - 11625 Ordinance, is hereby amended to reflect the changes made necessary by this Amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective simultaneously with its companion Comprehensive Plan amendment (Ordinance No.11624 ), which takes effect thirty-one (31) days after final reading and adoption thereof pursuant to Section 163.3187(3)(c), Florida Statutes. BACKGROUND These amendments were approved at First Reading by the City Commission with a request that the Department of Planning and Development respond to several concerns raised by a neighbor on Second Reading. The specific concern which was underlying all of the doubts raised at first reading was the question of density. The attached proposal is to change the land use and zoning designations from Government/Institutional and Single Family Residential to Restricted Commercial; the density and intensity of the Government/Institutional and Restricted Commercial designations is exactly the same; both designations allow 150 units per acre and both designations have Floor Area Ratio's (FAR's) of 1.72 times the gross lot area. The inclusion of the single residential lot will only add a potential density increase of approximately 15 units; and if the zoning designation of the single lot is not changed and kept under the same ownership, it would be able to be included in the gross lot area calculations for FAR purposes; therefore, the final potential intensity would not be all that different whether the lot is included or not; it would only make it more difficult to develop the property as a unified development. Dear Teresita: On behalf of Mainstream Partners, Ltd., a Florida limited partnership, we are applying for a rezoning and comprehensive plan amendment for the vacant properties fronting on West Flagler Street between N.W. 2411 Avenue and N.W. 24th Court, Miami, Florida. Pursuant to the Application for Amendment to the Zoning Atlas, this letter serves to explain why the proposed zoning designations are inappropriate and why the proposed zoning designation is appropriate. The existing zoning for Lot 241 is R-1 (Single Family Residential) and for Lots 242 - 247 it is G/I (Govern ment/Institutional). Our application requests the zoning designations be amended to C-1 (Restricted Commercial). The G/I designation is inappropriate due to the ownership and use of -the subject property. The property is currently vacant and is owned by a private company and not a governmental entity. The property previously was a school, but has ceased operating as a school for many years. The R-1 lot is adjacent to the to the G/I lots and is a logical extension to also be designated as C-1. It is also our understanding that a variance was .granted in the past by the City of Miami for the R-1 lot to be used for certain non-residential purposes. The property is located .on a major roadway, West Flagler Street, and is adjacent to C-1 designated property on both the east and the west. The subject property is inappropriate for the G/I and R-1 designations and has a greater need for commercial uses for the surrounding neighborhood. The area is much more conducive and compatible for commercial use then G/I and R-1. For the above stated reasons, we are requesting the zoning amendments from R-1 and G/I to C-1.
