ORDINANCE NO. 11620
AN ORDINANCE AMENDING SECTION III OF ORDINANCE
NO. 11337, AS AMENDED, ADOPTED JANUARY 25, 1996,
THE CAPITAL IMPROVEMENTS APPROPRIATIONS
ORDINANCE, THEREBY INCREASING THE
APPROPRIATIONS TO THE EXISTING CAPITAL
IMPROVEMENT PROJECT NO. 322061 ENTITLED:"TOWER
THEATER REHABILITATION" BY AN AMOUNT OF
$250,000 FROM $2,276,800 TO $2,526,800, CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission pursuant to Ordinance No. 11337, adopted January 25,
1996, established appropriations for Capital Improvements, to continue previously approved
Capital Improvement Projects, to begin during Fiscal Year 1996-97; and
WHEREAS, the City of Miami has identified available funds from the ' Community
Development Block Grant (CDBG) funds for Capital Improvement Project No. 322061 entitled
"Tower Theater Rehabilitation"; and
WHEREAS, it is urgent for the preservation of public property to include said additional
appropriations in Capital Improvement Project No. 322061 "Tower Theater Rehabilitation"
scheduled to commence during Fiscal Year 1997-1998:

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Section III. of Ordinance No. 11337, as amended, adopted January 25,
1996, is hereby amended in the following particulars:'
"Section 1. The herein appropriations are hereby made for
implementation of all municipal Capital Improvements of the City of Miami,
including new Capital Improvement Projects scheduled to begin during fiscal year
1996-1997. The herein appropriations which are hereby designated by reference
to descriptive project title and number also include appropriations for previously
approved scheduled projects as well as reappropriations of prior fund
appropriations. The source of revenues to support the herein appropriations is
hereby identified by fund and project with the project appropriations with revenues
therefor being set forth for seven program (I - VII) areas based upon use or
functional category within said areas, as follows:

Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in
conflict with the provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective (30) days after final reading and
adoption thereof.

It is respectfully recommended that the City Commission adopt the attached Ordinance
amending Capital Improvement Ordinance No. 11337 by increasing appropriations for Project
No. 322061, Tower Theater Rehabilitation in the amount of $250,000.
BACKGROUND:
In conjunction with the Department of Planning and Development, the Office of Capital
Improvements has prepared this Ordinance amending Capital Improvements Ordinance No.
11337, adopted January 25, 1996. This amendment is critical to the continuation of the Tower
Theater Rehabilitation (Project No. 322061), since it would appropriate. funds needed for the
completion of the current construction, design revision fees, City administrative fees and
acquisition of equipment/fa niture.
The Tower Theater is a City -owned, public facility located on the corner of S.W. 8' Street and
S.W. 15'h Avenue anchoring the Latin Quarter Specialty Center in the City of Miami. Funds
available at the present time for the project are $2,276,834 which includes a $352,834 grant
from the State of Florida Historical Resources, $500,000 grant from the State of Florida
Cultural Affairs, and $1,424,000 from prior year and revenue funds from CDBG.
The $250,000 appropriated through this Ordinance is the balance required for completion of
the project, bringing the total amount appropriated to $2,526,800 for the rehabilitation of the
Tower Theater.
