ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, TO INTRODUCE NEW SECTION 950
TO ARTICLE 9, TO ALLOW LIMITED VENDING
ACTIVITIES WITHIN PRIVATE CONSTRUCTION SITES
UNTIL A CERTIFICATE OF OCCUPANCY IS ISSUED;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of December 17, 1997, Item No. 6', following an advertised
hearing, adopted Resolution No. PAB 79-97 by a vote of five to
zero (5-0), RECOMMENDING APPROVAL of amending Zoning Ordinance
No. 11000 as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to. this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by
adding new Section 950 as set forth in the following

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

Amendment to Article 9 of Zoning Ordinance 11000
to allow vending activities on private construction sites conditionally
within all Zoning District
The proposed amendment to the Zoning Ordinance is in order to allow vending activities
on private construction sites conditionally, within all Zoning classifications. There are
many vending vehicles, also known as lunch trucks, which make a living vending prepared
foods from vehicles to the public and in particular to "on the job" construction employees;
these vendors are providing a service to construction employees who are not always able
to leave their construction sites for breakfast or lunch. The Zoning Ordinance does not
currently address the permissibility of this activity within private property. (Vending on
public properties is addressed in Chapter 39 of the City Code). This amendment would
allow the activities described herein conditionally. The safeguards which have been built
into this ordinance include:
1. the vendor shall be required to obtain all licenses and vending approvals
as specified in Chanter 39 of the Code of the City of Mami prior to
engaging in vending activities;
2. vending activities from vehicles shall be limited to prepared foods only
and shall only be permitted on active construction sites for the
purposes of this section, an active construction site shall be defined as a
construction site on which building_ permits have been obtained and
construction is actively in progress and
3. vending activities from vehicles shall only be permitted on private
construction sites until such time that a Certificate of Occupancy is
issued for the work being conducted on the subject property_
The Planning Department is recommending approval of the proposed amendment finding
that the inclusion of prepared food vending on private construction sites, as conditioned
herein, would be beneficial to the city as a whole by providing an opportunity for
construction employees to obtain a necessary service on their job sites.
