ORDINANCE NO. 11612
AN ORDINANCE AMENDING ORDINANCE N0. 11000,
THE ZONING ORDINANCE, BY AMENDING ARTICLE 6,
TO ADD NEW SECTION 602.4.1.3, ENTITLED "SALES
DISPLAY AND SERVICE ACTIVITIES WITHIN OPEN OR
PARTIALLY OPEN SPACE," TO MODIFY EXISTING
PROVISIONS AND ALLOW CERTAIN COMPONENTS OF
SAID USES BY SPECIAL EXCEPTION AND CLASS II
SPECIAL PERMIT WITHIN OPEN SPACE FOR THE SD-2
COCONUT GROVE CENTRAL COMMERCIAL DISTRICT;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 30, 1997, Item No. 4, following an advertised hearing,
adopted Resolution No. PAB 47-97 by a vote of four. to three
(4-3), RECOMMENDING DENIAL of an amendment to Zoning Ordinance
No. 11000 as hereinafter set forth;.and
WHEREAS, the City Commission after careful consideration of
this matter, notwithstanding the recommendation of the Planning
Advisory Board, deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants to
amend Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby, adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended in the
following particulars:]-'
"ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS
Section 602. SD-2 Coconut Grove Central Commercial
District.
Sec. 602.4. Permitted principal uses and structures.
Sec. 602.4.1. Principal uses permitted on ground floor
frontage of primary pedestrian pathways.
602.4.1.1. Only the following principal uses
shall be permitted on the ground floor
frontage of primary pedestrianstireet�

Special Exception only. Off-street parking shall

602.4.1.2. The . following rules shall apply
concerning extent and location of the
following uses on ground floor frontage of
primary pedestrian pathways.
1. On corner lots adjoining pedestrian streets
on two (2) exposures, limitations as to the
uses permitted on ground floor frontage shall
apply.
2. The frontage of a lot on a pedestrian street
shall be occupied at the ground floor level
by uses permitted under the limitations of
section 602.4.1.1 for least sixty-five (65)
percent of lot width.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

LEGAL DESCRIPTION Not applicable
PETITION Consideration of amending Ordinance 11000, as amended, the
Zoning Ordinance of the City of Miami, by amending Article 6,
Section 602. "Coconut Grove Central Commercial District' in
order to add a new Section 602.4.1.3. entitled "Sales display and
service activities within open or partially open space", to modify
the existing provisions allow said uses conditionally within open
space.
PLANNING Approval.
RECOMMENDATION
BACKGROUND AND The requested amendment to the text of the SD-2 Coconut Grove
ANALYSIS Central Commercial District is in order to modify the regulations
pertaining to the outdoor display and sale of items within open
space, or partially open space on private property within the
district.
It is also intended to ensure that such vending activity is carried
out in a coherent and organized fashion that will not be in
detriment to the district by obstructing the pedestrian flow or
visually cluttering the streetscape.
