HomeMy WebLinkAboutO-11605;t: . - J-97-490 02/02/98 ORDINANCE NO. 11605 AN ORDINANCE AMENDING SECTIONS 2-1052 AND 2-1053 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO DECREASE THE NUMBER OF BOARD MEMBERS ON THE OVERTOWN ADVISORY BOARD AND THE NUMBER OF MEMBERS REQUIRED FOR A QUORUM FOR SAID BOARD; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Ordinance No. 11211, adopted on January 12, 1995, the City Commission created and established the Overtown Advisory Board ("OAB") consisting of fifteen (15) members; and WHEREAS, in accordance with said Ordinance eight (8) members of the OAB constitute a quorum for purposes of conducting official business of the OAB; and WHEREAS, due to continued absences of certain OAB members, the OAB has not had a'quorum for a considerable period of time; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11605 Section 2. Sections 2-1052 and 2-1053 of the Code of the City of Miami; Florida,, as amended, are hereby amended in the following particulars:i./ "Sec. 2-1052. Membership. (a) Generally. The Overtown Advisory Board shall consist of fifteen (15) tbi rteen (13) members to be elected as hereinafter set forth. "Sec. 2-1053. Proceedings. (d) Voting; quorum. A majority of the member% Cnnct;tute a winrum. All recommendations of the Overtown Advisory Board shall require a concurring vote of a majority of the members present. Eight (8) members eenstitu� In case of a tie vote such vote shall be construed as a denial." Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed Section 4. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions,of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. INTER -OFFICE MEMORANDUM Honorable Chairman and February 3, 1998 TO : DATE: FILE Members of the City Commission SUBJECT: Overtown Advisory Board Membership FROM: Jose Garcia -Pedrosa REFERENCES: February 10, 1998 City Manager Commission meeting ENCLOSURES: Recommendation: It is respectfully recommended that the City Commission amend Ordinance 11211 to reduce the membership of the Overtown Advisory Board from fifteen (15) members to thirteen (13.) members. It is further respectfully requested that a majority of the members present at the Overtown Advisory Board meeting, shall constitute a quorum. Background: In 1982, the Southeast Overtown/Park West Community Development Ad Hoc Committee was created to provide a neighborhood oversight monitoring for the Urban Initiatives Project. The Committee consists of 15 member representative of Overtown residents, property owners, and the community based organizations. The Overtown Advisory Board has been functioning as an incorporated fifteen member board since its inception. Elections were held on an annual basis by the board and members were re-elected for consecutive terms. To maintain continuity and in order for the board to be effective, it was established that City related activities that impact on Overtown should not be entertained by the City commission until such activity request was brought before the Overtown Advisory Board. In January of 1996, the City Commission passed Ordinance # 11211 which named the Overtown Advisory Board as a City ordained board. A requirement of the ordinance is that members who absented themselves from four (4) meetings within the calendar year can be removed from the Board. This situation has arisen and members have been removed. On occasions, meetings have not been effectively administered because of the lack of a quorum. '' 11605 r1 Honorable Chairman and Members of the City Commission February 3, 1998 Page two During the meetings of May and June, the Board, by consensus, agreed that it would be far more productive with regard to fulfilling their commitments if they should reduce the membership of the Board from fifteen (15) to thirteen (13) members. The Overtown Advisory Board elections were held on July 31, 1997. The conditions of the nomination were advertised, announced and displayed within the community. Despite no limitations being set as to the amount of nominees who could have been candidates, only thirteen (13) persons submitted nomination forms. All thirteen were elected.
