HomeMy WebLinkAboutO-11604• E J-97-665/2 11/17/97 ORDINANCE NO. 11604 AN ORDINANCE AMENDING ORDINANCE NO. 11000, THE ZONING ORDINANCE, BY DELETING SUBSECTIONS 1104.4 THROUGH 1104.4.1 FROM ARTICLE 11 IN THEIR ENTIRETY AND SUBSTITUTING IN LIEU THEREOF NEW SUBSECTION 926.15.2.1 TO ARTICLE 9, AND AMENDING SUBSECTION 926.15.2, TO ALLOW A MAXIMUM OF TEN OUTDOOR ADVERTISING SIGNS (BILLBOARDS) CITYWIDE, WITH CERTAIN STANDARDS AND CONDITIONS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of September 17, 1997, Item No. 4, following an advertised hearing, adopted Resolution No. PAB 52-97 by a vote of four to three (4-3), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as previously set forth; and WHEREAS, the City Commission after careful consideration of this matter on October 14, 1997 deemed it advisable that the proposed amendment to Ordinance No. 11000 be modified and that said changes should be reconsidered by the Planning Advisory Board at its next meeting; WHEREAS, the Miami Planning Advisory Board, at its meeting of October 29, 1997, Item No. 2, following an advertised hearing, adopted Resolution No. PAB 60-97 by a vote of four to one (4-1), RECOMMENDING DENIAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and 11604 • 0 WHEREAS, the City Commission after careful consideration of this matter, notwithstanding the recommendation of the Planning Advisory Board, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings. contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by deleting Subsections 1104.4 through 1104.4.1 from Article 11 in their entirety as followsl/: "ARTICLE 11. " Section 3. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended as follows:2.1 "ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS Sec. 926. Signs; specific limitations and requirements. 926.15. Outdoor advertising signs. Signs used in the conduct of the outdoor advertising business shall be regulated and restricted as follows in districts in which they are permitted: 926.15.2. Limitations on location, orientation, spacing, height, type and embellishments of outdoor advertising signs in relation to limited access highways and expressways. Except as otherwise provided in section 926.15.1, outdoor advertising signs may be erected constructed, altered, maintained or relocated within six hundred sixty (660) feet but no nearer than two hundred (200) feet of any limited access highway including expressways as established. by the State of Florida or any of its political subdivisions, provided that such sign faces are parallel to or at an angle of not greater than thirty (30) degrees with the centerline of any such limited access highway and faced away from such highway; sunjeet to the height limitation in the zoning distriat . .a/ Ibid. 5 - 604 • •reTo"raFre Mn me 113/. ./ 11. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. 6 - �.1604 11 E Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. Amendment to Article 9 Section 926 and Article 11 Section 1104, of Zoning Ordinance 11000. Not applicable. PETITION Consideration of amending Ordinance 11000,as amended, the Zoning Ordinance of the City of Miami, by amending Article 9, Section 926 "Signs, specific limitations and requirements", and article 11, section 1104 regarding nonconformities in order to amend existing provisions pertaining to outdoor advertising signs (billboards), citywide. PLANNING RECOMMENDATION BACKGROUND AND ANALYSIS Denial. In 1985 outdoor advertising signs became permitted uses between 600 feet and two hundred (200) feet of the westerly side of 1-95 and .on other expressways- west -of 1-95, to a maximum height of 65 feet spaced 1,500 feet apart and facing the expressway. A maximum number of ten (10) were allowed within two hundred (200) feet of said expressways. Later that year, amendments were passed limiting the number of said outdoor advertising signs to nine (9) within two hundred (200) feet of the aforementioned expressways and expanding the eligible land for others to 660 feet from the expressway. In 1990 with the adoption of a new zoning ordinance all existing _outdoor advertising signs within two hundred (200) feet of the aforementioned expressways became legally nonconforming uses. ..................................................................
