AN ORDINANCE AMENDING SECTION 40-245 OF THE CODE OF THE CITY OF MIAMI, FLORIDA AS AMENDED, BY PROVIDING FOR INVESTMENTS TO BE MADE IN ASSET BACKED SECURITIES FOR MEMBERS OF THE CITY OF MIAMI GENERAL EMPLOYEES' AND SANITATION EMPLOYEES' RETIREMENT TRUST ("GESE TRUST"); CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of Trustees for the City of Miami General Employees' and Sanitation Employees' Retirement Trust recommends a modification to Section 40-245 of the Code of the City of Miami, Florida, relating to General Employees' and Sanitation Employees' retirement concerning types of funds where investments may be made; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 40-245 of the Code of the City of Miami, Florida, as amended, are hereby amended in the following particulars:!/ '-� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 11589 "Sec. 40-245. Trust fund. (c) Investments. (1) Trust funds may be invested without limitation in: (2) Not more than five (5) percent of the fund may be invested in any one (1) entity of the categories listed below: C. Interest -bearing obligations with a fixed maturity of any corporation and asset backed securities within the United States; provided that such obligations are rated by at least two nationally recognized rating services in any one of the four highest classifications approved by the comptroller of the currency for the investment of funds of national banks, or if only one nationally recognized rating service shall rate such obligations, such rating service must have rated such obligations in any one of the three highest classifications heretofore mentioned. Any security downgraded subsequent to purchase which results in the security falling below the recommended guidelines may be held at the investment manager's discretion. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any sections, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. The correction would allow for the purchase of asset backed securities.- The administration recommends the amendment. BACKGROUND On November 17, 1994 the City Commission adopted an amendment to Section 40- 229 (now . Section 40-245), as recommended by the GESE Trust, relating to investment guidelines and types of funds where investments may be made. At the GESE Trust's board meeting on June 27, 1997 it was brought to the board's attention that in amending Section 40-229 (now Section 40-245) certain language, allowing for the purchase of asset backed securities, was inadvertently struck from the section.
