ORDINANCE NO. .11588
AN EMERGENCY ORDINANCE AMENDING
SECTION 2-1013(a) AND (d)(1) OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO
INCREASE THE NUMBER OF MEMBERS ON THE MIAMI
SPORTS AND EXHIBITION AUTHORITY FROM FIVE TO
ELEVEN; TO PROVIDE FOR APPOINTMENT OF
CHAIRPERSON TO SAID AUTHORITY, AND TO PROVIDE
FOR THE CONSTITUTION OF A QUORUM; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 2-1013(a) of the Code of the City of
Miami, Florida, as amended, concerning the Miami Sports and
Exhibition Authority is hereby amended in the following

(3) Each city commissioner shall nominate two ()
members, except for thp city commissioner
appointed as a voting member_ The appointed

(d) Organization, powers and duties of the
authority.
(2) Seven Six members of the authority eligible
to vote shall constitute a quorum. A
majority of the quorum is empowered to
exercise all the rights and perform all the
duties of the authority, and no vacancy in
the authority shall impair the right of the
quorum to act.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.

Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become effective
immediately upon its adoption.
PASSED AND ADOPTED BY TITLE ONLY this 13th day of
January 1998.

It is respectfully recommended that the City Commission adopt the attached
Emergency Ordinance amending Section 2-1013 and (d) (1) of the Code of the
City of Miami, as amended, concerning the increase of board- members on the
Miami Sports and Exhibition Authority from five to eleven.

The Miami Sports and Exhibition Authority Board has consisted of S members for
the past several years, making it sometimes difficult to have a quorum if two or
more members are absent. Increasing the number from five to eleven would
enable the board to consistently have a quorum and would require a minimum of
six members of the authority to be present, thereby constituting a quorum. A
majority of the quorum is empowered to exercise all the right:, and perform all the
duties of the authority, and no vacancy in the authority shall impair the right of
the quorwii to act.
