ORDINANCE NO.
AN EMERGENCY ORDINANCE AMENDING SECTION II,
OF ORDINANCE NO. 11337, AS AMENDED, ADOPTED
JANUARY 25, 1996, THE CAPITAL IMPROVEMENTS
APPROPRIATIONS ORDINANCE, TO ESTABLISH TWO
(2) NEW CAPITAL IMPROVEMENT PROJECTS: "SOUTH
FLORIDA URBAN SEARCH AND RESCUE PROGRAM",
PROJECT NO. 313826, AND "FEMA/USAR GRANT
PROGRAM", PROJECT NO. 313827, AND
APPROPRIATING FUNDS FOR SAID PROJECTS;
CONTAINING A REPEALER PROVISION - AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission pursuant to Ordinance
No. 11337, adopted January 25, 1996, established appropriations
for Capital Improvements, and continued previously approved
Capital Improvement Projects to begin during Fiscal Year 1995-96;
and
WHEREAS, the Department of Fire -Rescue is the primary
sponsoring agency and is responsible for the continued
organization and development of the South Florida Urban Search
and Rescue ("USAR") Task Force; and
WHEREAS, the USAR Task Force is in need of purchasing
specialized equipment related to rescue, medical, technical,
communications and logistics; and

WHEREAS, in order to continue to provide said emergency
service, it is urgent for the preservation of public property to
establish the aforementioned Capital Improvement Projects
entitled: "South Florida Urban Search and Rescue Program"
Project No. 313826, in the amount of $456,000 and "FEMA/USAR
Grant Program", Project No. 313827, in the amount of $30,000
scheduled to commence during Fiscal Year 1997-1998;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section II of Ordinance No. 11337, as
amended, adopted. January 25, 1996, is hereby amended in the
following particulars:'/
"Section II. The herein appropriations are hereby
made for implementation of all municipal Capital
Improvements of the City of Miami, including new Capital
Improvement Projects scheduled to begin during fiscal year
1995-1996. The herein appropriations which are hereby
designated by reference to descriptive project title and
number also include appropriations for previously approved
scheduled projects as well as reappropriat ions of prior
fund appropriations. The source of revenues to support
the herein appropriations is hereby identified by fund and
project with the project appropriations with revenues
therefor being set forth for seven program (I - VII) areas
based upon use or functional category within said areas,
as follows:"

in effect and remain unchanged. Asterisks indicate omitted and
unchanged material. All figures are rounded to the nearest hundred

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section S. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary purchases and payments and to
generally carry out the function and duties of municipal affairs.

Section 6. The requirements of reading this Ordinance on
thetwo separate days is hereby dispensed with by a vote of not
less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached
Ordinance amending Ordinance No. 11337, the Capital Improvements
Appropriations Ordinance, thereby creating and appropriating funds in the
amount of $486,000, for two new capital improvement projects entitled:
"South Florida Urban Search and Rescue Program" Project No. 313826 and
"FEMA/USAR Grant Program", Project No. 313827. $456,000 will be
allocated to Project No. 313826 and $30,000 will be allocated to Project No.
313827 respectively. These projects will be funded by State of Florida and
FEMA Grants.
BACKGROUND:
The 'Department of Fire -Rescue is the primary .sponsoring agency and is
responsible for the continued organization and development of the South
Florida Urban Search and Rescue ("USAR") Task Force.
The Department of Fire -Rescue has been awarded a grant from the State of
Florida, Office of Tourism, Trade and Economic Development to Fund
Management, Administrative, Training and equipment acquisition cost for the
South Florida Urban Search and Rescue (USAR) Program in the amount of
$500,000. $456,000 of these funds will be allocated to CIP Project no.
313826.
The Department of Fire -Rescue has also been awarded a grant from the
Federal Emergency Management Agency (FEMA) to fund Management,
Administrative, Training and Equipment and Supplies acquisition cost for the
South Florida Urban Search and Rescue (USAR) Program in the amount of
$76,500. $30,000 of these funds will be allocated to CIP Project No.
313827.
