In reference to your letter, please stand corrected that this application has nothing to do with "Celebration Excursions of Miami, Inc.". My application was made on March 18, 1998 with a operating Certificate of Public Convenience and Necessity issued by the City of Miami submitted to your office under the name of Michael A. Dudik with the Vessel M/Y Friendship operating as "Floribbean Hospitality Cruises", Celebration Charters, Inc., a total independent company from Celebration Excur- sions of Miami, Inc. Please check your files for clarity. As per the City of Miami Code CD50:9 - Section 50 - 64 Same - Investigation; approval or rejection, I'm requesting a City of Miami Commission Hearing according to the City of Miami Code, paragraph (b) states, "The applicant shall be entitled to a hearing before a board, comprised of the city commission". Please find this letter a "NOTICE OF REQUEST" for a public City Commission Hearing, which notice is within the 30 days of rejection. I also have a few other concerns in your corre- spondence that I feel need to be addressed which I will do at a later date. (a) Upon the filing of an application for a certificate under this division, and the.payment of the fee therefor, the director shall investigate the applicant as to moral fitness, character, business experience and any other matter deemed neces- sary for the best interests of the public in general. If within ten days from the receipt of such rejection the appli- cant requests in writing to have the director state the reasons for such rejection, the director shall furnish such reasons in'wriiing within ten days from receipt of such request. Abrams, Director Conferences, Conventions & Public Faciliti:7 DATE: June 30,1998 FILE : SUBJECT: Ordinarim Amending Section 53-161 Of the City Code by Changing hate Schedule at Miami Convention Center RSRR CES : ENCLOSURES: This will serve as response to and clarification of assertions by Mr. Michael Dudik in his correspondence to your office dated June 22, 1999 (attached), regarding commercial dockage at Miamarina at Bayside. Tlfcs department has not denied dockage at Miamarina, or any other City marina., to Mr. Dudik. He had requested a specific slip at Miamarim and it is the opinion of the Marinas Manager of that facility that the slip requested by Mr. Dud& would be best served by another vessel. I& Dudik has been welcome to berth has vessel at one of several other slips suitable and available, but he has chosen not to. Mr. Dudik currently berths th = vessels at City marinas. The sightseeing vessel "Celebration" is berthed at and operates from the inside basin at Miamarina, mobile the sightseeing vessel "°Friendship" and sailing vessel "Almedin" are berthed at and operate from Dinner Key Marina. The City of Miami and Mr. Dudik are currently operating under the terms of a three year Stipulated Settlement of Agreement with regard to his vessels' operations at Miamarina at Bayside. These teams regulate the number of vessels Mr. Dudik may operate within the inside basin at Miamarina. Mr. Dudik feels that the dockage slip he is seeking (along the IntmCoastal Waterway adjacent to the Hard Rock Caf6) would best suit his interests to expand his business at Miamanw. This department feels that the Iong-berm interests of Miamarina, and the City, would be best served with another vessel in that particular berth. Mr. Dudik's claim that Miamarina is only twelve percent occupied is untrue. There are currently 35 long-term pleasure and commercial vessels licensed at Miamarina (or twenty seven percent of the 130 slips at the Marina). There are several other vessels currently berthed at Miamarina on a monthly and semi-annual basis. Additionally, several other commercial businesses have expressed strong interest in bringing their vessels (and businesses) to Miamarina. Separataely, this department is proposing modification to cunem City Code that will make it easier to bring new commercial businesses to City marinas. I fully anticipate Mr. Dudik's strong objection to this department's progressive approach to increase jobs and revenue for the City. Mr. Dudik currently holds Certificates for two of the three commercial vessels berthed at City facilities, and this department has never denied him a Certificate. Mr. Dudik does not have an application for a third Certificate of Public Convenience & Necessity on file at any City marina. Tbais department has simply made a business decision regarding a specific slip at that facility that Mr. Dudik does not agree with. Mr. Dudik's request for hearing based on City Code Section 50-64 is not applicable in this case. It is my intention to assign a 167' luxury yacht to the outside slip known as ICW 1. This vessel will provide the Marina with a generous monthly revenue stream, while serving to attract other vessels of similar size and style. It is the unanimous opinion of the Director, Assistant Director, and myself that Miamarina's (and the City's) long-term interests would be best served by the addition of several "mega yacht" type vessels on the outside seawall. These vessels would not only provide significant revenue, but would provide the marina with an image that will attract additional customers to our facility. I have enclosed with this letter copies of correspondence and payment records for your business dating back to 1996. I have documented at least twenty five late payments from u since that time, some more than four months east due. On that date and on two other separate occasions earlier in that week the subject vessel was operated in an unsafe manner. On those occasions it passed very close to our dock (within approximately 10 yards). With a approach that close not only does a vessel of that size operating at its normal cruising speed create a very large wake, if the vessel were to experience a casualty Cie: a steering failure) the result could be catastrophic. There is no need to pass in such close proximity to fixed structures. For your information, subsequent to our call to you, the subject vessel was observed on several occasions as it passed through the bay behind our home well off shore and near the center of the bay. Finally, yesterday, when one of my staff, Manuel Maldonado bumped into you, you advised him that you are "working on" changes to the sianage. It is my understanding that, per Bayside's Agreement with the sightseeing businesses, that an off -duty City Police officer was a mandatory requirement for operations on Friday, Saturday, and Sunday nights. If my understanding of your policy is not correct, please let me know. It is very important to me that my customers all work off of the same set of rules and guidelines- I am working hard to fulfill my end of this policy, and I appreciate you help with regard to Bayside. She asked to be considered for the"newly opened slip on the ICW. I am in possession of corres- pondence and documentation from Ms. Massa supporting her claim. On Monday March 2, 1998 I called the telephone number listed on .Ms. Massa's letterhead to acknowledge receipt of her correspondence and left a brief message on an unidentified woman's answering machine. On March 4 I called again, to find that that number had been disconnected. A search of her business and personal telephone number in the phone bock was unsuccessful, On March 3, 1998 I received a call from Natalia Calderoni, requesting a meeting with Christina Abrams and myself. When asked what this was in reference to, she replied that she understood that Walter Fortunato was moving into her unoccupied slip and that she wanted to put another sightseeing vessel into "miami Queen's" vacant space until her lease expired. After consulting with Christina Abrams, I set a meeting date of Friday, March 6, 1998 for the three of us to meet. On March 4, 1998 Terry Buice and I met with Joe Rugare, President of Lady Lucille Cruises, to discuss the possibility of bringing his sightseeing business to Mamarina,Mr, Rugare has been bringing the "L&dji Lucille" into Miamarina on a transient basis for several years, and has operated several.other sightseeing vessels that have called on Miamarina since prior to 1988. He gave us his professional and persQn41 bAckground, outlined hio businaaB plans oh©uld he be admitted Imes the Marina, and provided us with detailed photographs of his vessel. He also showed Terry and I copies of correspondence dating back to October of 1990 supporting his assertion that he has been trying (unsuccessfully) with previous Marina management to bring his business to Miamarina. I was impressed with the professionalism of both Mr. Rugare and his operation, having seen and assisted his vessel in previous visits to Miamarina since my arrival. I believe that Mr. Rugare's operation would tie in nicely with my plans to favorably improve the business complexion of the ICW slips as they pertain to Miamarina and the City.
