Booker -1 CI _ ,T_` Analysis for a Special Exception for the SANTA MARIA MARINA PROJECT located at 1643 Brickell Avenue CASE NO: 1998-0089 Pursuant to Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal for the Santa Maria Marina Project has been reviewed to allow the following Special Exceptions: • Special Exception per Article 4, Section 401 to allow a Marina for the existing residential development; and • Special Exception per Article 9, Section 924.11 to allow and extension of a dock beyond thirty five (35) feet into Biscayne Bay. The requested Special Exceptions are for the purpose of allowing a Marina which extends more than 35 feet into Biscayne Bay at the existing Santa Maria Residential Development located at approximately 1643 Brickell Avenue within the Brickell area (see attached legal description, location maps and aerial photographs for exact property boundaries). Note: This Special Exception has a companion request for Variance. In determining the appropriateness of the attached request, the following findings have been made: • It is found that the proposed Marina project will benefit the existing Santa Maria Development by allowing residents of the project to dock boats on -site; this in turn beriefits the area by providing a high density residential project with Marina capabilities to attract new residents to the area. • It is found that the subject of these Special Exceptions, specifically -a Marina Use at an existing residential development and the extension of a dock beyond 35 feet into Biscayne Bay, for the proposed project is completely within the scope and character of the project given that it is a high density residential project to be located along a significant parcel along Biscayne Bay and the South Brickell Avenue corridor. • It is found that the proposed extension will enable the applicant to comply with regulations to preserve the existing seagrasses in the Aquatic Preserve Area adjacent to the shoreline of the Santa Maria Project. • It is found that with respect to all additional criteria as specified in Section 1305 of Zoning Ordinance 11000, the proposal has been reviewed and found to be adequate, the project, as proposed, will have no adverse effects on the adjacent area. Based on these findings, the Department of Planning and Development is recommending approval of the requested Project as presented. .. 1 . Booker, owner of apartment 601 at The Imperial Condominium at 1627 Brickell Avenue, hereby appeal the Zoning Board's decision made on March 2nd, 1999, regarding 1643 Santa Maria variance application to allow for an expanded marina. My reasons are: 1. Pollution. Large boats in a small area will create noise. They will also discharge oil and create fumes that will foul the water and the air. Refuse of all sorts from the boats will create a visual and sensorial -blight to the environment. This common area is where we all swim, play tennis, barbecue for our families and friends and generally use as our place in the sun. 2. The view. The ability to look at Biscayne Bay and Rickenbacker Causeway was a key element in the attractiveness of The Imperial when we elected to buy here. The marina as expanded will interfere with the tranquil, beautiful scene we have come to love in a major way. 3. Property values. If the primary reason many of us bought our apartments in the first place is destroyed, it is unlikely that our homes will find enthusiastic buyers without a beautiful, serene view along with the peace and quiet in our recreation areas that we have enjoyed. In support of the application, the applicant is prepared to offer the following evidence, on the point enumerated at Subsection 1903.1 of the City of Miami Zoning Ordinance. Side Setback variances for docks The proposed marina will have a setback of ten (10) from both the northeast and southwest sideyard property lines. Due to the distance of the docks from the land outward into Biscayne Bay, Section 924.1.3 of the Zoning Ordinance, requires a total 80 foot sideyard setback on the northeast and a 78 foot sideyard setback on the southwest. It is essential to have the docks extend at its furthest point, 210 feet from the land outward into Biscayne Bay for the following reasons: 1) the first 90 feet from which the dock extends from the land, is over protected Seagrass; and 2) the shallow depth of the waters adjacent to the land requires that the boats can not be docked for the first approximate 110 feet from the land, thus requiring the docks to extend at the furthest point (210 feet) into Biscayne Bay. Dade County requires that a minimum four (4) foot water level at low tide, be provided for the docking of boats. The docks are to be located in the Biscayne Bay Aquatic Preserve. The proposed docks are the most environmentally sound design, since it does not require dredging. For these reasons, the sideyard setback variances are being requested for the proposed docks. (b) The special conditions and circumstances do not result from the actions of the petitioner in that: The location of the Seagrasses and the depth of the waters does not result from the Santa Maria's actions. (c). Literal interpretation of the provisions of the Zoning Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the Zoning Ordinance and would work unnecessary and undue hardships on the petitioner in that: The Santa Maria is only requesting approval by Special Exception for 19 slips. In addition, unlike most properties within the State of Florida, the Santa Maria is the owner of the submerged lands (not the State of Florida), and the proposed docks are wholly located within the Santa Maria's property lines, so although the Santa Maria is extending at the furthest point, 210 feet into the Bay, all submerged lands under the docks are owned by the Santa Maria.
