THE CITY'S FIRE -RESCUE FEE
We are tenants in an apartment building which has five or
more units and is serviced by a private garbage hauler. The currently
approved fire rescue fee for buildings such as ours will be $160 per year for
each of our apartment units as of January 1, 1998. We feei that the owner
of our building will be forced to pass this charge on to us which will result in
a rent increase of over $13.00 a month for each of us.
Homeowners, under the Ordinance you have approved, will
receive as net increase in fire -rescue and garbage fees over the garbage
fees which they are now being charged.
This is not fair. We ask you to repeal the fire -rescue fee or to
reduce the amount which tenants like us will and up paying.

We are tenants in an apartment building which has five or

AGAINST ADOPTION
OF
CITY OF MIAMI FIRE - RESCUE FEE
This so called "Fire Rescue Fee" is not a fee only for
the Emergency Medical Rescue Service provided by
the Miami Fire Department. This so called fee is
intended to ultimately pay the entire Miami Fire
Department budget, WHICH IS NOW BEING PAID
FOR BY THE AD VALOREM TAX paid by each
taxpayer in the City of Miami.
II. What is called a "fee" by the City is not related to the
users of the services provided. The justification given
is that the services of the fire department, including
both fire response and emergency rescue services, are
available to whoever might need it, however, unlike
the garbage fee or a water/sewer fee, or a waste pick
up fee - all of which are paid only by the person or
business receiving the benefit of such services - the
Fire Rescue Fee is being imposed on selected groups
of property owners who are to pay the fee, whether
or not they "use" or "receive the benefits" of the
service.
The City is quick to counter and say that all property
owners receive the benefits of reduced fire insurance
rates, quick response in the event of emergency, etc.,
However, so does every other building or structure in
the City. So does every non -taxpayer, non -property
owner, non -tenant and tourist in the City. Every
person, whether homeowner or homeless, resident or
visitor, worker or retired, even people walking biking
or driving through the City of Miami on the way to
points beyond, are fully entitled to and will receive
the full benefit of the emergency rescue service or
fire service when and/or if the need ever arises,
without any obligation to pay this new user "Fee"
proposed by the City either for the availability and/or
use of such service.
III. All of the current Fire Department and Emergency
Rescue Services are being provided and paid for
100% by the ad valorem tax structure and other
revenue sources of the City, and have been so funded
since the inception of the modern ad valorem tax
system in Miami. All of the current fire and rescue
support facilities, infrastructure, buildings, equipment,
etc., have been paid for and provided under the ad
valorem tax structure, subject to the caps and
limitations and restrictions of that taxing structure
and the other revenue sources of the City.
IV. No new Fire Department services or facilities are
being proposed by the City of Miami as justification
for the adoption and imposition of this fire and
rescue service fee. No new fire engines, fire houses,
Fire Rescue vehicles and/or any of the supporting
infrastructure of that department is given as the
justification for the imposition of this new fee.
Instead the cost of the Fire Department/Emergency
Rescue Service is simply and openly being removed
from those services currently supported by the ad
valorem tax base and other revenue sources, and
declared by legislative fiat and slight of hand of the
City Commission to be no longer included in the ad
valorem tax funded tax services, but henceforth
subject to funding only by the imposition of a special
user's fee.
V. The transfer of the fire and rescue service costs from
those items supported by the ad valorem tax revenues
is a flagrant act designed to nullify the millage cap
mandated by the citizens of the State of Florida on
ad valorem taxes and on the value, force and effect of
the constitutionally created homestead exemption
from ad valorem taxes.
VI. Had the City never established and provided fire
and/or fire rescue services, and now decided that it
wished to establish and provide such a service within
the City, it would not be inappropriate, under current
law, to consider utilizing a Fire and Rescue service
fee, tied and related to the annual cost of providing
such a service, plus the amortization cost of the
infrastructure which would have to be established and
constructed and/or acquired to provide such service.
As such items would never have been part of the ad
valorem tax base, and the benefits to the property
owners within the taxing district, whether it be a
special taxing district, a City or a county, such a fee
would probably be valid under the recent Lake
County v. Water Oak Management Corp. line of
cases. As in that situation, the services were not
previously available, and not provided, and therefore,
each and every property upon which the fee was to
be imposed, was receiving the very real and tangible
benefits of the services to be provided from the fees

assessed. Those facts are ,aite unique to that
particular water management district, and have not
even a scintilla of a resemblance of what is being
perpetrated by the City commission in trying to
impose the Fire and Fire Rescue fee for what already
exists and has existed for years under the ad valorem
tax base.
The City commission is saying to the property owners
- until today, the residents of the City of Miami have
received fire protection services and Fire Rescue
services from the City and have paid for those
services as part of the ad valorem tax assessment and
payment.
But - from now on, everyone in the City, whether
resident or visitor or just passing through will receive
those same services, but each property owner, and
tenant is going to receive them and pay a new fee
separate and apart from the monies paid, directly as
taxes or indirectly as rent and/or common area pass
through, and of course, you will still pay the full
amount of your ad valorem taxes.
What the City is not telling the voters is that now
that we are going to be paying for the fire and rescue
services by a new and separate fee, the City will
continue to impose the same high ad valorem taxes
and use those same ad valorem tax dollars to pay for
some other program or give away.
VII. What do some of the City Commissioners really want
to do?
What is it that some of the City Commissioners are
afraid to do?
Why does the City commission give away free services
worth a minimum of $370.00 to each and every one
of approximately 70,000 single familv home owners
and the owners of small apartment buildings of up to
four units, in the City of Miami?
Why is this same gift of $370 per living unit not given
to the voters who live in condominiums and/or rental
apartments. Why is not a similar gift not given to the
owners of businesses. Everyone is paying the same
ad valorem taxes. The people living in condominiums
and the owners of business properties and office
buildings are paying the same level of taxes, but are
paying more if not most of the ad valorem taxes
being used by the City to give away the free or
subsidized gift of garbage service to people who own
single family residences. WHY?
The City commission is currently making a gift of not

less than $:.., To each and every single family home
and/or owner and/or tenants of small (up to 4 unit)
rental apartment buildings in the City. The cost of
that gift from the City of Miami is between
$26,000,000, yes TWENTY SIX
MILLION DOLLARS to $27 million per
year. $26-$27 Million is the current approximate cost
to the City of Miami to provide garbage service and
waste pickup to the approximately 70,000 single
family homes and up to quadriplex apartments in the
City of Miami.
In every other City in Miami -Dade County, and in
the County itself, the fee charged for garbage and
waste service is $400+ per single family home, and is
paid by everyone. It is a reality of life, the same as
ad valorem taxes are a reality of life.
If you create garbage, you pay for its disposal,
EXCEPT IN THE CITY OF MIAMI. In Miami if
you live in a single family home, someone else pays
most (currently) or all (if the fire rescue fee passes)
of the cost of disposing of your garbage. The very
concept is unbelievable. A single family home owner
can make a mess and someone else will have to pay
to clean it up. How much longer must this City be
the butt of our Nation's humor.
For larger structures, office buildings, buildings not
on the tax roll, governmental, charitable, high rise
rental or condominium, etc. Those garbage removal
services are paid for by the individual buildings,
usually for less cost per resident or unit, than the cost
per unit for the same service from government.
Gentlemen, The t'`ommission has discussed
privatization. Is the Commission so afraid of a Union
that it cannot not or will not do what is best for the
majority of the Citizens of this City. If private
industry takes over garbage collection, the same
people who are working for the City can apply for
jobs in the private sector, which would be
immediately created. It is almost axiomatic that the
service will be better, the cost less and the tax burden
eliminated. People will begin paying their bills. Not
like now, where so many recipients of garbage service
have never paid anything. It seems that in Miami,
the drivers of the garbage trucks decide who is going
to get service, not the City itself.
Everywhere else, people who live in a City or
unincorporated area pay their taxes for the fire and
rescue services and other municipal or governmental
services, such as police, building and zoning,
minimum housing, youth services, sanitation service,
parks and recreation, etc. Those same people pay the
taxes imposed by the school board, the South Florida

Water Management Distrk the library, lighting
districts, special taxing districts, etc., And they pay for
all of those things as part of their ad valorem taxes
each year.
These same people also pay for specific services they
receive, water, sewer, garbage removal, waste
removal, etc. No one gives any of these people,
residents or tenants, a gift of free or subsidized
garbage services, EXCEPT IN THE CITY OF
MIAMI.
No City or county says to their single family residents
and people living in up to four unit apartment
buildings, that only because you live in a single family
home or an apartment building of four units or less,
we, your City Commissioners, who you have been so
nice to elect, are going to give you free garbage
service - no City, village or town except the City of
Miami would even propose such impropriety.
Why?
Votes!
What we are witnessing with this proposal, whether
realized or not, is in reality an attempt to influence the
votes of the single family residents and owners and/or
occupants of apartment buildings of up to four unit, by
members of this commission who would vote to approve
the Fire Rescue Fee. In a City where the last election
was decided by questionable absentee votes (still the
subject of court action) they will now by implication be
able to say to a potential 150,000 voters, "vote for me,
because I gave you the gift of free garbage service."
What they are not saying is that while they were giving
that gift to 70,000 single family residences, which we
should regard as at least two or more potential voters
minimum in each house, they will be taking that money
from the pockets of all of the other property owners,
taxpayers and voters in the City. Because of economic
reality, the average single family home in the City of
Miami does not pay as significant an amount of ad
valorem taxes because of the Homestead Exemption,
while the multi -family high rises and office and industrial
buildings, carry the large portion of the ad valorem tax
burden for the entire City as well as paying most of the
other revenues received by the City. The high rise
buildings, the large rental apartments, the
condominiums, the office buildings, get no free garbage
pickup or waste collection services. They must pay for
all of those services privately. Who pays for all of those
services, the residents and the owners and the tenants
who live and/or work in those buildings. They pay the
ad valorem taxes, and get nothing back. With this
proposal they will have to pay the same high ad valorem

tax, plus t. new Fire Rescue fee, not only for
themselves, but they will now have to fund and pay for
the gift of completely free garbage service to be given to
the single family residence owners under this new
proposal.
What is this Proposal Today?
1. Abolish what is left of the garbage fee to single
family residents, thereby increasing the existing
deficit from the operation of the garbage
service from its present level to approximately
$26 to $27 million per year, and in so doing,
gifting to each single family resident and
occupant of apartment buildings with no more
than 4 units, a minimum of $370 per year.
Actual value in Miami -Dade county, a
minimum of $400.00.
Total amount of the deficit from provided free garbage
services to single family homes -
$26,000,000 to $27,000,000
Potential number of votes influenced - up to 150,000
persons.
How do they propose to pay for this newly
increased deficit?
2. Pass a new fire and rescue service tax which
will raise how much the first year?
$2790009000.00
How many votes will the commissioners voting to
approve this fee lose? Surely not 150,000. Why,
because there are not as many condominium residents
who vote as there are single family homeowners. The
owners of commercial buildings are not by virtue of that
ownership, voters within the City.
WHAT ABOUT THE PEOPLE WHO PAY RENT?
What about the voters who are tenants and live in
apartment buildings of more than four units. The
number of voting tenants paying rent in apartment
buildings with more than 4 units may well be as
numerous as the single family residentialvoters, BUT no
one speaks for them. They will not know about this new
Fire Rescue Fee until the landlord has to raise the rent
at the next lease renewal to cover the cost of the new
Fire Rescue Fee being charged on a per unit basis.
Remember that those tenants are already paying the ad
valorem tax through their rent, but they are not getting
any free gift of garbage service. But they do vote and
perhaps they ultimately will understand how they have
been abused and ignored by their elected
representatives.

You will be told by those who favor this .z, that if it passes, the
single family residents will pay a Fire Rescue fee in the same
manner and amount as the people living in high rises, and based
on a sliding scale, to the apartment building office building and
industrial users. That is true!

Only the single family residents get the reduction in their
garbage fee equal to the amount of the new Fire Rescue fee
plus the continuing subsidy of what will now become a fully
free garbage service worth a minimum of $400.00 Per year.
Up until now the Commission has been subsidizing more than
half of the cost of the garbage services provided. Now to help
the City of Miami financially, they propose to subsidize 100%
of the cost of the garbage services provided.
If something costs $370, and you give it away for free, you
lose $370 by giving it away. If you give that $370 away to
70,000 home owners, then you are losing TWENTY FIVE
MILLION NINE HUNDRED THOUSAND DOLLARS
($25,900,000). In the rest of Miami -Dade County, single
family homeowners pay an average of $400 per year for
garbage service (some more). Why not the City of Miami.
Instead of losing $25,900,000 per year, the City would take in
$28,000,000.
Is this equal protection under the law? No!
Is this due process of law? No!
Is this taxation without representation? Yes!
Is this pandering to a special interest group? Yes!
Does this border on vote buying? Yes!
Is this fair government? No!
WHAT THEN IS THIS SO CALLED FIRE -RESCUE FEE
PROPOSAL?
WHAT WILL IT ACCOMPLISH?
NOTHING! All they are going to do is find a way to give
away free garbage and waste fee to single family residents.
They will have done nothing to increase the income
desperately needed by this City now, to pay its bills. The final
tax impact ZERO. All they will have done is more unfairly
allocate the tax burden.
If this commission enacts this proposal, they will have opened
a flood gate which v� _ . permit them to impose fees at will and
to increase the Fire Rescue service fee every time they need
money for another one of their pet projects. They will violate
the constitutional value of the Homestead Exemption and they
will violate the Constitutionally imposed cap on ad valorem
taxation.
As of the writing of this Memorandum, Commissioner
Plummer has announced his opposition to this proposal.
Mayor Suarez's most recent proposal advocates a garbage fee
and cost efficiency in the City. It is only hoped that his veto
will be there if the Fire Rescue Fee is approved by a majority
of the Commission.
Find a competent and qualified attorney who is not biased on
the issue, and ask if the proposal is legal. Ask Broward
Circuit Judge Herbert Moriarty, who has already ruled that it
is not, when a Fire Rescue Fee was enacted by the City of
Pembroke Pines.
Don't ask the Tallahassee lawyers who would try to get a
lucrative and far reaching contract worth millions of dollars
over the years if this Fire Rescue Fee is adopted.
Find and ask an attorney with municipal and constitutional
law experience, whose job now or in the future is not
dependent on your votes, to give you an objective opinion.
Step back from self interest and look at what you are doing,
and ask yourselves if it is fair and equal treatment to all of the
people of this City? If you can still say yes, that you are being
fair, then be prepared to be further humiliated both in the eye
of public opinion and by the courts of this State, neither of
which will tolerate further abuses of due process and equal
protection by the City of Miami.
Do not rely on the prior approval of the Oversight Committee
unless and until you have determined that they have bothered
to consider the laws of this State and the fact that you are
giving away garbage service as a quid pro quod to the
enactment of the Fire Rescue Fee.
Mayor Suarez, Commissioner Plummer and those other
members of the Commission, who have the courage and
decency to stand with you, can stand tall and proud. You are
acting according to law. You are ensuring equal protection
and due process to all of the residents, voter and non-voter
alike of the City. You are upholding you oath of office.

THE UNDERSIGNED HEREBY PROTEST THE UNJUST AND DISCRIMINATORY PROCEDURE
IN WHICH THE MIAMI CITY COMMISSION VOTED TO LEVY A FEE TO A SPECIFIC
SEGMENT OF TAXPAYERS, NAMELY CONDO UNITS OWNERS.
COMMISSIONERS NOT ONLY HAVE DISCRIMINATED AGAINST THEM, BUT ALSO THEY

PETITION TO REPEAL OR MODIFY
THE CITY'S FIRE -RESCUE FEE
We are tenants in an apartment building which has five or
more units and is serviced by a private garbage hauler. The currently
approved fire rescue fee for buildings such as ours will be $160 per year for
each of our apartment units as of January 1, 1998. We feel that the owner
of our building will be forced to pass this charge on to us which will result in
a rent increase of over $13.00 a month for each of us.
Homeowners, under the Ordinance you have approved, will
receive aQ net increase in fire -rescue and garbage fees over the garbage
fees which they are now being charged.
This is not fair. We ask you to repeal the fire -rescue fee or to
reduce the amount which tenants like us will end up paying.
